Notice of Mortgage. The Borrower shall keep the Mortgage registered against the Ship as a valid first priority mortgage, carry on board the Ship a certified copy of the Mortgage and place and maintain in a conspicuous place in the navigation room and the Master’s cabin of the Ship a framed printed notice stating that the Ship is mortgaged by the Borrower to the Security Trustee.
Notice of Mortgage. The Borrower shall procure that each Owner shall keep the Mortgage registered against the Ship owned by it as a valid first preferred mortgage, carry on board the Ship a certified copy of the relevant Mortgage and place and maintain in a conspicuous place in the navigation room and the Master's cabin of the Ship a framed printed notice stating that the Ship is mortgaged by that Owner to the Security Trustee.
Notice of Mortgage to place and at all times and places to retain a properly certified copy of the Mortgage (which shall form part of the Ship's documents) on board the Ship with her papers and cause such certified copy of the Mortgage to be exhibited to any and all persons having business with the Ship which might create or imply any commitment or encumbrance whatsoever on or in respect of the Ship (other than a lien for crew's wages and salvage) and to any representative of the Mortgagee and to place and keep prominently displayed in the navigation room and in the Master's cabin of the Ship a framed printed notice in plain type reading as follows:
Notice of Mortgage. The Shipowner will place, and at all times and places will retain a properly certified copy of this Mortgage on board the Vessel with her papers and will cause such certified copy and the Vessel’s marine document to be exhibited to any and all persons having business therewith which might give rise to any lien thereon other than liens for crew’s wages and salvage, and to any representative of the Mortgagee. The Shipowner will place and keep prominently displayed in the chart room and in the Master’s cabin on the Vessel a framed printed notice in plain type reading as follows: THIS VESSEL IS OWNED BY [SHIPOWNER], AND IS SUBJECT TO A FIRST PREFERRED MORTGAGE IN FAVOR OF NORDEA BANK FINLAND PLC, NEW YORK BRANCH, AS TRUSTEE/MORTGAGEE UNDER AUTHORITY OF CHAPTER 3 OF THE XXXXXXXX XXXXXXX XXXXXXXX XXX 0000, AS AMENDED. UNDER THE TERMS OF SAID MORTGAGE, NEITHER THE SHIPOWNER, ANY CHARTERER, THE MASTER OF THE VESSEL, NOR ANY OTHER PERSON HAS ANY RIGHT, POWER OR AUTHORITY TO CREATE, INCUR OR PERMIT TO BE PLACED OR IMPOSED UPON THE VESSEL, ANY ENCUMBRANCES WHATSOEVER OR ANY OTHER LIEN WHATSOEVER OTHER THAN FOR CREW’S WAGES AND SALVAGE.
Notice of Mortgage. Each Guarantor shall keep the Mortgage recorded against the Ship owned by it as a valid first preferred mortgage, carry on board that Ship a certified copy of the Mortgage and place and maintain in a conspicuous place in the navigation room and the master’s cabin of that Ship a framed printed notice stating that that Ship is mortgaged by that Guarantor to the Security Trustee.
Notice of Mortgage. A framed printed notice of the Ship’s Mortgage shall be prominently displayed in the navigation room and in the Master’s cabin of the Ship. The notice must be in plain type and read as follows:
Notice of Mortgage. The Landlord hereby gives notice to the Tenant and the Tenant hereby accepts receipt of such notice that the Landlord may recover possession of the Room and Flat under Grounds 28 and 10 - 16 inclusive of the Housing Xxx 0000 and Ground 17 of the Housing Xxx 0000. The Landlord further gives notice that the Building is subject to a mortgage granted before commencement of this Agreement and possession may be also be recovered under Ground 2 in part One of schedule Two of the Housing Xxx 0000 where:
a) the mortgagor is entitled to exercise a power of sale conferred by mortgage deed or by section 101 of the Law of Property Xxx 0000
b) the mortgagee requires possession of the property to dispose of it with vacant possession
Notice of Mortgage. This Ship is subject to a first mortgage in favour of [here insert name of mortgagee] of [here insert address of mortgagee]. Under the said mortgage and related documents, neither the Owner nor any charterer nor the Master of this Ship has any right, power or authority to create, incur or permit to be imposed upon this Ship any commitments or encumbrances whatsoever other than for crew’s wages and salvage”. No-one will have any right, power or authority to create, incur or permit to be imposed upon the Ship any lien whatsoever other than for crew’s wages and salvage.
Notice of Mortgage procure that each Owner places and, at all times and places, uses due diligence to retain a properly certified copy of the Mortgage and (if applicable) Deed of Covenant relative to its Ship (which shall form part of its Ship’s documents) on board its Ship with her papers and causes such certified copy of the relevant Mortgage and (if applicable) Deed of Covenant to be exhibited to any and all persons having business with its Ship which might create or imply any commitment or encumbrance whatsoever or in respect of its Ship (other than a lien for crew’s wages and salvage) and to any representative of the Security Trustee and to further procure that each Owner places and keeps prominently displayed in the chart room and in the Master’s cabin of its Ship a framed printed notice in plain type reading as follows: This Vessel is covered by a [[First][Second] Preferred Mortgage][[First][Second] Priority Mortgage and Deed of Covenant] to [here insert name of Security Trustee] of [here insert address of Security Trustee] (as security agent and trustee on behalf of itself and certain other creditors parties) [under authority of Title 21 of the Liberian Code of Laws of 1956 as amended]. Under the terms of the said Mortgage [and Deed of Covenant] neither the Owner nor any charterer nor the Master of this Vessel nor any other person has any right, power or authority to create, incur or permit to be imposed upon this Vessel any lien or encumbrance whatsoever other than for crew’s wages and salvage” and in terms of the said notice it is hereby agreed that save and subject as otherwise herein provided, neither any Owner nor any charterer nor the Master of any Ship nor any other person has any right, power or authority to create, incur or permit to be imposed upon any Ship any lien whatsoever other than for crew’s wages and salvage. For the avoidance of doubt, in relation to the Additional Second Lien Vessels only, reference to “Second” in the said notice shall be retained and references to “First” deleted;
Notice of Mortgage. 26.1 The Landlord hereby gives notice to the Tenant that possession of the Room might be recovered under Ground 2 of Schedule 2 of the Housing Xxx 0000 because
26.1.1 the Building is subject to a mortgage granted before the beginning of the tenancy;
26.1.2 the mortgagee is entitled to exercise a power of sale conferred on him by the mortgage or by section 101 of the Law of Property Xxx 0000; and
26.1.3 the mortgagee will require possession of the Room for the purpose of disposing of the Building with vacant possession if that power of sale is exercised.
