Objectives of this Policy. The objectives of this Policy are: (a) to establish a fair, transparent and accountable framework governing the use of Planning Agreements by the Council; (b) to explore the range and extent of development contributions made by development towards public facilities and other public benefits in the Council’s area; (c) to set out the Council’s specific policies and procedures relating to the use of Planning Agreements within the Council’s area; (d) to give all stakeholders in development greater involvement in determining the type, standard and location of public facilities and other public benefits; and (e) to facilitate public participation and to allow the community to gain an understanding of the benefits of appropriate Planning Agreements for the provision of public benefits. (f) to enhance the understanding within Council’s area as to possibilities for development and associated public benefits and planning benefits facilitated by Planning Agreements.

Objectives of this Policy. The purpose of this policy is to provide a fair, transparent and standard procedure and framework for the making and assessment of an offer to enter into a planning agreement. This document provides an overview of the legal requirements of planning agreements under the applicable legislation and guidelines for negotiating planning agreements as well as the approval process for planning agreements internally within Council. In particular: (a) the circumstances in which the Council would consider entering into a planning agreement; (b) the matters ordinarily covered by a planning agreement; (c) the form of development contributions ordinarily sought under a planning agreement; (d) the kinds of public benefits ordinarily acceptable to Council and whether they involve a planning benefit; and (e) the procedures for negotiating and entering into planning agreements.
Objectives of this Policy. The objectives of this policy are: (a) to provide a transparent framework for the use of voluntary planning agreements by Council; (b) to allow greater flexibility in the way development contributions are charged and the type of facilities and services for which contributions can be received; (c) to set out Council’s policy and procedures relating to the use of planning agreements; (d) to facilitate public and stakeholder involvement in determining the provision of public benefits; and (e) to provide a fair, equitable and accountable system for the provision of public planning benefits.

  • Benefits of this Agreement Nothing in this Agreement shall be construed to give to any person or corporation other than the Company, the Rights Agent and the registered holders of the Right Certificates (and, prior to the Distribution Date, the Common Shares) any legal or equitable right, remedy or claim under this Agreement; but this Agreement shall be for the sole and exclusive benefit of the Company, the Rights Agent and the registered holders of the Right Certificates (and, prior to the Distribution Date, the Common Shares).

  • SCOPE OF THIS AGREEMENT 2.1. This Agreement, including Parts A through L, Tables One and Two and exhibits, specifies the rights and obligations of each Party with respect to the establishment, purchase, and sale of Local Interconnection, Collocation, resale of Telecommunications Services and Unbundled Network Elements.   • Duration of this Agreement The Term of this Agreement shall be as specified in Schedule A hereto.

  • Effective Period of this Agreement This Agreement shall take effect upon its execution and shall remain in full force and effect for a period of two (2) years from the date of its execution (unless terminated automatically as set forth in Section 10), and from year to year thereafter, subject to annual approval (i) by Underwriter, (ii) by the Board of Trustees of the Trust or a vote of a majority of the outstanding Shares, and (iii) by a majority of the Trustees of the Trust who are not interested persons of the Trust or of Underwriter by vote cast in person at a meeting called for the purpose of voting on such approval.

  • Nature of this Agreement 3.1. This Agreement is a framework agreement within the meaning of regulation 2(1) of the Public Contracts (Scotland) Regulations 2015. Call-off Contracts are public contracts within the meaning of that regulation. 3.2. This Agreement is a multi-supplier framework agreement and the contractors that are party to it are the Framework Contractors. No other contractors are party to the Framework Agreement. 3.3. This Agreement is a multi-user framework agreement and the public bodies that are party to it are the Framework Public Bodies. No other public bodies are party to the Framework Agreement. 3.4. The Contractor acknowledges that it is not the exclusive supplier of the Services to Framework Public Bodies and as such no guarantee of work or volume of work has been granted by any Framework Public Body. 3.5. The Contractor acknowledges that the Framework Public Bodies are separate legal persons and as such the Authority has no liability in relation to the performance or non- performance of other Framework Public Bodies' obligations under this Framework Agreement or any Call-off Contracts.

  • Performance of this Agreement Buyer shall have duly performed or complied with all of the obligations to be performed or complied with by it under the terms of this Agreement on or prior to the Closing Date.

  • Effective Date of this Agreement This Agreement shall become effective (the "Effective Date") upon the date of your acceptance hereof, as set forth below.
