Observer Reports. The Contractor shall ensure that observer reports are received after each scheduled monitoring activity. Observer reports should be in the format as outlined in the Regulation and include the following information: (a) The vessel identity; (b) The name of the observer and the period during which the observer was on board; (c) The type of fishery concerned; (d) The duration of the fishing trip and the fishing effort (number of fishing hours for towed gear; for fixed gear, total net length x fishing hours); (e) The number of bycaught cetaceans, including species and, where possible, information on size or weight, sex, age, and indications of animals lost during hauling of gear or whether released alive; and (f) Any additional information deemed useful, such as sightings of cetaceans or particular behaviour in relation to fishing operations.

Observer Reports. 7.1 Reports from ACAP Observers at international meetings 7.1.1 No reports were submitted for consideration under this agenda item. 7.2 Reports from Observers to AC8 7.2.1 BirdLife International (BLI) reported that together with local in-country partners, it has continued with the ATF programme in six countries in South America (Argentina, Brazil, Chile, Ecuador, Peru and Uruguay) and in two African countries (South Africa and Namibia). In all countries, XXX has continued working on trials and experiments on mitigation measures in different fisheries (pelagic longliners, trawlers, and recently gillnets and purse seine vessels). During the last year particularly, XXX has been working on supporting partners and governments in developing new regulations on mitigation measures and compliance, engaging with Argentina, Brazil and Namibia in the last few months in particular. XXX was deeply involved in all the tuna RFMOs, working in coordination with ACAP in a number of them, and some good advances were achieved. The seabird-tracking programme of BLI continued to be active, providing information to support some of ACAP’s stated objectives. 7.2.2 Projeto Albatroz reflected that it was created 24 years ago in Xxxxxx, in southeastern Brazil, with the aim of reducing seabird bycatch. Sponsored by Petrobras through Programa Petrobras Socioambiental, nowadays it has bases in five states in Brazil covering the most important part of the Brazilian coast in terms of seabirds, maintaining its own observer program to study seabird interactions and developing mitigation techniques with the support of fishermen. Projeto Albatroz works in partnership with governmental agencies, but also with fisheries industries, captains and crewmembers. It has also recently commenced an education program with school children in Xxxxxx and will extend this program to other ports in due course. Projeto Albatroz is also a partner of Royal Society for the Protection of Birds (RSPB), Birdlife International and the Albatross Task Force Program. 7.2.3 American Bird Conservancy (ABC) provided an opening statement to the meeting (ANNEX 7) and expressed appreciation for the opportunity to contribute to the work of the meeting.

Observer Reports. 7.1 Reports from ACAP Observers at international meetings 7.1.1 The SBWG Convenor reported that he represented ACAP at a two-day workshop hosted by the CMS in April 2016 entitled “CMS Daughter Agreements and their Management of Bycatch – a Workshop to Explore Synergies.” The aims of the workshop were to present and discuss the bycatch issues facing the CMS daughter agreements and MoUs, and to share lessons and investigate opportunities for collaboration. Topics covered included engagement with RFMOs, development of technical bycatch mitigation solutions, observer data collection and reporting protocols, sharing of bycatch resources (such as guidelines and mitigation fact sheets) and compliance monitoring. The workshop provided a good opportunity to initiate discussion of these topics, and is intended to serve as the basis for further engagement between the CMS family to explore opportunities for synergies and collaborations on bycatch issues. Once the workshop report is available, it will be provided to the ACAP Secretariat.

Documents required to be delivered pursuant to Section 6.01 or Section 6.02 shall be delivered electronically to the Administrative Agent for further distribution to each Lender; provided that upon written request by the Administrative Agent, Borrower shall deliver paper copies of such documents to the Administrative Agent for further distribution to each Lender until a written request to cease delivering paper copies is given by the Administrative Agent. Each Lender shall be solely responsible for timely accessing electronically provided documents or requesting delivery of paper copies of such documents from the Administrative Agent and maintaining its copies of such documents. Notwithstanding the foregoing, Parent’s filing of notice of any event described in Section 6.02 with the SEC shall be deemed to satisfy the requirements of this Section 6.02 on the date on which such report is first available via the SEC’s EXXXX system or a successor system related thereto.

  • Financial Statements; Accountants’ Reports; Other Information The Guarantor shall keep and maintain at all times complete and accurate books of accounts and records in sufficient detail to correctly reflect all of the Guarantor’s financial transactions and assets. In addition, the Guarantor shall furnish, or cause to be furnished, to the Lender the following: (i) So long as Guarantor is a reporting company under the Securities and Exchange Act of 1934 (the “’34 Act”), promptly upon their becoming available, copies of (A) all 10K’s, 10Q’s, 8K’s, annual reports and proxy statements, and all replacement, substitute or similar filings or reports required to be filed after the date of this Guaranty by the SEC or other Governmental Authority exercising similar functions, and (B) all press releases and other statements made available generally by Guarantor to the public concerning material developments in the business of Guarantor. (ii) In the event Guarantor is not a reporting company under the ‘34 Act,

  • Budgets, Forecasts, Other Reports and Information Promptly upon their becoming available to the Borrower: (i) any reports, notices or proxy statements generally distributed by the Borrower to its stockholders on a date no later than the date supplied to such stockholders, (ii) regular or periodic reports, including Forms 10-K, 10-Q and 8-K, registration statements and prospectuses, filed by the Borrower with the SEC, (iii) to the extent not previously reported in regular or periodic reports, including Forms 10-K, 10-Q and 8-K, registration statements and prospectuses, filed by the Borrower with the SEC, the Borrower shall notify the Banks promptly of the enactment or adoption of any Law which may result in a Material Adverse Change, (iv) to the extent requested by the Agent or any Bank, the annual budget and any forecasts or projections of the Loan Parties, and (v) with respect to the Hedging Transaction activities of the Loan Parties and their Subsidiaries, to the extent not previously reported in regular or periodic reports, including Forms 10-K, 10-Q and 8-K, registration statements and prospectuses, filed by the Borrower with the SEC, such other reports and information as any of the Banks may from time to time reasonably request.
