OPINION OF PROBABLE COSTS. Opinions of probable construction and related costs, financing and acquisition of land and rights-of-way prepared by ARRO represent its judgment as a design professional and are supplied for the general guidance of the Client. Since ARRO has no control over cost of labor, materials, equipment or services furnished by others, over contractors’ methods of determining prices, over costs of financing, acquisition of land or rights-of-way or over competitive bidding, market or negotiating conditions, ARRO does not guarantee that any such opinions will not vary from actual costs or contractors’ bids to the Client.

OPINION OF PROBABLE COSTS. FNI will furnish an opinion of probable project development cost based on present day cost, but does not guarantee the accuracy of such estimates. Opinions of probable cost, financial evaluations, feasibility studies, economic analyses of alternate solutions and utilitarian considerations of operations and maintenance costs prepared by FNI hereunder will be made on the basis of FNI’s experience and qualifications and represent FNI's judgment as an experienced and qualified design professional. It is recognized, however, that FNI does not have control over the cost of labor, material, equipment or services furnished by others or over market conditions or contractors' methods of determining their prices.
OPINION OF PROBABLE COSTS. Notwithstanding anything to the contrary, Consultant’s opinions of probable total project costs, construction costs, and/or estimates of quantities, if any, provided as part of the services under the Agreement are made on the basis of Consultant’s knowledge, experience and qualifications and represent Consultant’s judgment as an experienced professional. Consultant does not guarantee that proposals, bids, actual total project costs, total construction costs or quantity estimates will not vary from the opinions provided by Consultant.

OPINION OF PROBABLE COSTS. Gensler will provide the Design Development Documents in PDF. Gensler will meet with Town up to two times to present and review the material, including the Opinion of Probable Costs. Town and Gensler will agree upon any changes, consistent with the Program, and Gensler will incorporate such changes in the Construction Documents, unless it would otherwise be an Optional/Additional Service (as defined in Section B.3 below).
