Order of Delivery. For purposes of determining the amount of liquidated damages for late delivery to be made by Seller hereunder, all Equipment shall be deemed to be delivered in the order of their respective requested shipment dates as set forth in the Purchase Orders, regardless of the Purchaser to whom or the destination to which the Equipment is shipped. Accordingly, Equipment with the earliest requested shipment date as set forth in the Purchase Orders must be delivered (or will be deemed delivered for purposes of calculating liquidated damages for Late Delivery Occurrences) prior to Equipment with a later requested shipment date.

Order of Delivery. Energy forecasted and Scheduled by NLH under this Agreement for delivery by Muskrat to NLH in each Operating Year until the end of the 50th Operating Year, shall come first from Base Block Energy, then from Supplemental Block Energy and then from NLH Deferred Energy.   • Manner of Delivery All notices communications and other materials to be given or delivered under the Loan Papers shall, except in those cases where giving notice by telephone is expressly permitted, be given or delivered in writing. All written notices, communications and materials shall be sent by registered or certified mail, postage prepaid, return receipt requested, by telecopier, or delivered by hand. In the event of a discrepancy between any telephonic notice and any written confirmation thereof, such written confirmation shall be deemed the effective notice except to the extent Administrative Agent, any Lender or the Borrower has acted in reliance on such telephonic notice.

  • Terms of Delivery The Terms of Delivery are contained in the General Conditions of Contract (GCC) and Special Conditions of Contract.
