Over Budget Options. 6.8.1 If the Construction Budget is exceeded by the total of the lowest responsive and responsible Bids and any legally negotiated prices for the Project, the Contracting Authority and Owner shall, at their option:
6.8.1.1 Approve in writing an increase in the Construction Budget and rebid the Project;
6.8.1.2 Authorize rebidding or renegotiation for some or all parts of the Project within a reasonable time without an increase in the Construction Budget;
6.8.1.3 Abandon the Project, in whole or in part, and terminate this Agreement; or
6.8.1.4 Cooperate in the revision of the Project Scope as defined in Section 5.3.2.3.1 to reduce the actual cost of construction to the Construction Budget.
6.8.2 If the Contracting Authority and Owner adopt the option in Section 6.8.1.1 above and such increase in the Construction Budget is more than 10 percent, the A/E may request, in writing, an adjustment to the Basic Fee.
6.8.3 If the Contracting Authority and the Owner adopt the option in Section 6.8.1.4 above, the A/E shall appropriately modify the Approved Program of Requirements, Project Schedule, and Contract Documents and cooperate in any necessary bidding or negotiation without additional charge.
Over Budget Options. If the Construction Budget is exceeded by the total of the lowest responsive and responsible bids and any legally negotiated prices for the PROJECT, the COUNTY may, at its option (1) approve in writing an increase in the Construction Budget; (2) authorize rebidding or renegotiation for some or all parts of the PROJECT within a reasonable time without an increase in the Construction Budget; (3) abandon the PROJECT, in whole or in part, and terminate this Agreement in accordance with Paragraph 5., Termination ; and/or (4) cooperate in the revision of the Scope of the Project as defined in Subparagraph 2.2., Recommendations and Costs, to reduce the actual cost of construction to the Construction Budget. If any of the scenarios above occur, the County will review and discuss with the CM to determine a mutually agreeable solution to all parties as it relates to project schedule, CM fee and the overall project budget.

If the Construction Budget is exceeded by the total of the lowest responsive and responsible bids and any legally negotiated prices for the Project, the University shall, at its option (1) approve in writing an increase in the Construction Budget; (2) authorize rebidding or renegotiation for some or all parts of the Project within a reasonable time without an increase in the Construction Budget; (3) abandon the Project, in whole or in part, and terminate this Agreement in accordance with Subparagraph 8.1.2 or Subparagraph 8.1.4, as applicable; and/or

.1 Approve in writing an increase in the Construction Budget and rebid the Project;
.2 Authorize rebidding or renegotiation for some or all parts of the Project within a reasonable time without an increase in the Construction Budget;
.3 Abandon the Project, in whole or in part, and terminate this Agreement in accordance with subparagraph 8.1.2 or 8.1.4, as applicable; or .4 Cooperate in the revision of the Project Scope as defined in subparagraph 2.2.2 to reduce the actual cost of construction to the Construction Budget .2 If the Owner adopts the option in subparagraph 2.6.8.1.1 above and such increase in the Construction Budget is more than 10 percent, the A/E may request, in writing, an adjustment to the Basic Fee in accordance with subparagraph 5.4.5.

If the Construction Budget is exceeded by the total of the lowest responsive and responsible bids and any legally negotiated prices for the Project, the Commission and the School District Board shall, at their option (1) approve in writing an increase in the Construction Budget; (2) authorize re-bidding or re-negotiation for some or all parts of the Project within a reasonable time without an increase in the Construction Budget; (3) abandon the Project, in whole or in part, and terminate this Agreement in accordance with Subparagraph 8.1.2 or Subparagraph 8.1.4, as applicable; or (4) cooperate in the revision of the Scope of the Project as defined in Subparagraph 2.2.2 to reduce the actual cost of construction to the Construction Budget. If the Commission and the School District Board elect option (1) and such increase in the Construction Budget is more than ten percent (10%), the Architect may request, in writing, an adjustment to the Basic Fee in accordance with Subparagraph 5.4.5 of this Agreement. If the Commission and the School District Board elect options (2), or (4), the Architect shall modify the Program of Requirements, the Project Schedule and the Contract Documents and cooperate in any necessary bidding or negotiation without additional compensation.

If the Maximum Cost of Work threshold would be exceeded as a result of accepting the lowest responsive and responsible bid, the Agency shall, at its option (1) approve in writing an increase in the Preliminary Budget; (2) authorize rebidding or renegotiation for some or all parts of the Project within a reasonable time without an increase in the Preliminary Budget; (3) abandon the Project, in whole or in part, and terminate this Agreement in accordance and/or (4) cooperate in the revision of the scope of the Project to reduce the actual cost of construction.

If the Contracting Authority and Owner adopt the option in Section 6.8.1.1 above and such increase in the Construction Budget is more than 10 percent, the A/E may request, in writing, an adjustment to the Basic Fee. If the Contracting Authority and the Owner adopt the option in Section 6.8.1.4 above, the A/E shall appropriately modify the Approved Program of Requirements, Project Schedule, and Contract Documents and cooperate in any necessary bidding or negotiation without additional charge. Further Revisions to Cost Estimate and Project Schedule If necessary, the A/E shall inform the Contracting Authority and Owner of the need for any adjustments in the Detailed Estimate of Construction Cost and Project Schedule. Upon approval of the Contracting Authority and Owner of any such adjustments, the A/E shall prepare a revised Detailed Estimate of Construction Cost or revised Project Schedule, as applicable, incorporating such adjustments, obtain the Owner’s signature thereon, and deliver the signed, revised Detailed Estimate of Construction Cost or Project Schedule to the Contracting Authority. Conformed Documents During the entire bidding and award Stage, the A/E shall incorporate all Addenda information into the Contract Documents; and, between the date that the Contracting Authority issues a Notice of Intent to Award for the first construction contract for the Project and the effective date of the first construction contract Notice to Proceed, the A/E shall provide updated Contract Documents that conform in every regard to the documents originally issued for bidding purposes plus all of the information in all Project Addenda and accepted Alternates (“Conformed Documents”).
