Common use of Overtime and Overtime Compensation Clause in Contracts

Overtime and Overtime Compensation. (a) Employees requested to work in excess of the normal daily full shift hours, as outlined in Article 23.02, or who are requested to work on their scheduled off-duty days. (b) Employees shall be paid the rate of time-and-one-half (1½) of their basic hourly rate of pay for the first four (4) hours in excess of eight (8) hours per day or forty (40) hours per week, and double-time (2x) thereafter. (c) Employees required to work on a scheduled day off shall receive the overtime rate, but shall not have the day off rescheduled. (d) If an employee works overtime on a statutory holiday they will be paid time and one half the statutory rate of pay (2.25 times the rate of straight-time pay) for the first four (4) hours in excess of eight (8) hours, and at the rate of double-time (2x) the statutory rate of pay (3 times the rate of straight-time pay) thereafter. (e) Overtime pay shall be paid to the employee in the next pay period in which the overtime was earned. (f) An employee who works four (4) hours of overtime immediately before or following their scheduled hours of work shall be provided with a meal. One-half (½) hour with pay shall be allowed the employee in order that they may take a meal break either at or adjacent to their place of work.
