Common use of Overtime on a Holiday Clause in Contracts

Overtime on a Holiday. (a) Where an Employee is required to work overtime on a paid holiday, as defined in Article 18.01, they will receive compensation equal to 3.33 times their regular rate as follows: (i) compensation at 2.33 times their regular rate of pay, including the holiday pay, for the hours worked on the holiday; and (ii) time off with pay in lieu of the holiday on an hour for hour basis at a mutually acceptable time in accordance with Article 18.11. (b) Where time off with pay in lieu of the holiday has not been granted in accordance with Article 18.06 (a)(ii), compensation shall be granted at the Employee’s regular rate of pay for those hours worked on the holiday.

(b) which the holiday fell. Where time off with pay in lieu of the holiday has not been granted in accordance with Article 18.06 19.06 (a)(iib), compensation shall be granted at the Employeeemployee’s regular rate of pay for those hours worked on the holiday.

Where time off with pay in lieu of the holiday has not been granted in accordance with Article 18.06 20.06 (a)(iib), compensation shall be granted at the Employeeemployee’s regular rate of pay for those hours worked on the holiday.

(b) which the holiday fell. Where time off with pay in lieu of the holiday has not been granted in accordance with Article 18.06 (a)(ii)6(b) above, the compensation shall be granted at the Employeeemployee’s regular rate of pay for those hours worked on the holiday.

(a) Where When an Employee employee is required to work overtime on a paid holiday, as defined in Article 18.0119.01, they he/she will receive compensation equal to 3.33 three (3) times their his/her regular rate as follows: (ia) compensation at 2.33 two (2) times their his/her regular rate of payrate, including the holiday pay, for the hours worked on the holiday; and (iib) time off with pay in lieu of the holiday on an hour for hour basis at a mutually acceptable time in accordance with Article 18.11. (b) prior to the end of the second calendar month Where time off with pay in lieu of the holiday has not been granted in accordance with Article 18.06 19.06 (a)(iib), compensation shall be granted at the Employeeemployee’s regular rate of pay for those hours worked on the holiday.

(a) Where an Employee employee is required to work overtime on a paid holiday, as defined in Article 18.0122.01, they he/she will receive compensation equal to 3.33 three (3) times their his/her regular rate as follows: (ia) compensation at 2.33 two (2) times their his/her regular rate of payrate, including the holiday pay, for the hours worked on the holiday; , and; (iib) time off with pay in lieu of the holiday on an hour for hour basis at a mutually acceptable time prior to the end of the calendar month immediately following the month in accordance with Article 18.11. (b) which the holiday fell. Where time off with pay in lieu of the holiday has not been granted in accordance with Article 18.06 (a)(ii22.06(b), compensation shall be granted at the Employee’s employee's regular rate of pay for those hours worked on the holidaypay.
