Owner Representation. The Owner shall designate, when necessary, representatives authorized to act in the Owner's behalf with respect to the Project. The Owner or such authorized representative shall examine the documents submitted by the Professional Consultant and shall render decisions pertaining thereto promptly, to avoid unreasonable delay in the progress of the Professional Consultant services. Instructions by the Owner to the Professional Consultant relating to services performed by the Professional Consultant shall be issued or made by or through in accordance with procedural, organizational, and documentation standards established by the Owner. Communications and submittals of the Professional Consultant to the Owner and Contractor shall be issued or made in accord with similar procedural and documentation standards established by the Owner. The Owner shall have the authority to establish procedures, consistent with this Agreement, to be followed by the Professional Consultant and to call periodic conferences to be attended by the Professional Consultant, and his subconsultants, throughout the term of this Agreement.

Owner Representation. The Owner shall designate a Project Manager to serve as the Owner’s Representative. The Owner’s Representative has no design responsibilities of any nature. None of the activities of the Owner’s Representative supplant or conflict with the design, budget or any other services and responsibilities customarily furnished by the Design Consultant or sub- consultants in accordance with generally accepted architectural/engineering practices except as otherwise modified by this Agreement. Instructions by the Owner to the Design Consultant relating to services performed by the Design Consultant will be issued or made by or through and in accordance with procedural, organizational, and documentation standards established by the Owner’s Representative. Communications and submittals of the Design Consultant to the Owner and Contractor shall be in writing and issued or made in accord with similar procedural and documentation standards established by the Owner’s Representative. The Project Manager shall have the authority to establish procedures, consistent with this Agreement, to be followed by the Architect and Contractor and to call periodic conferences to be attended by the Architect and his subconsultants, throughout the term of this Agreement, as described in Article 3.4.
Owner Representation. Owner represents to Uppity Pup that: Emergency: Owner must provide the name and contact information of an adult, over the age of 18, to make decisions on behalf of Pet in the case we are unable to reach Owner in the event of an emergency. In an emergency, Uppity Pup will use reasonable efforts to contact the Owner, Pet’s personal veterinarian, or the emergency contact provided to Uppity Pup by the Owner. You hereby authorize, acknowledge and agree that Pet’s personal veterinarian or Owner’s emergency contact person has your full complete authority to make all decisions, including expenditure of funds, for and on behalf of Owner and Pet. In certain situations an emergency might not provide the time for Uppity Pup to contact Owner, Pet’s personal veterinarian or Owner’s emergency contact person prior to the administration of care. Owner therefore authorizes Uppity Pup to obtain medical attention for Pet from any qualified veterinarian and to transport Pet to and from such veterinarian when Uppity Pup, at its sole discretion, deems such medical care to be important to Pet’s health. Owner grants Uppity Pup and its employees or agents full authority, at its sole discretion, to make decisions involving the medical treatment of Pet and agrees to pay for all related costs. This applies to any claims for injuries or damages related to such medical care or that arise due to the transport of Pet. Pet shall then remain at a veterinary hospital or similar location for supervision and hospice care until such time as Owner, Pet’s personal veterinarian or Owner’s emergency contact can retrieve Pet. In the event of a Pet’s death, we will attempt to immediately contact the Owner or the Owner’s emergency contact. In the even that complications, injury or the death of Pet may occur due to the Owner refusing veterinarian recommended care, Uppity Pup shall not be held responsible. Additionally, if medical treatment is refused for Pet, Uppity Pup, at its sole discretion, may engage the services of a veterinarian and/or administer medicine in an effort to help make Pet as comfortable as possible until picked up by Owner or Owner’s emergency contact, and Owner hereby agrees to fully pay for the expenses thereof.
Owner Representation. Licensee represents and warrants to Licensor that he/she is the legal owner or otherwise are in lawful possession of all of the property that shall be stored in the Container, and have the legal right and authority to maintain and store the property upon the provisions, limitations, terms and conditions set further, herein, and that there are and will be no existing or hereinafter created liens, mortgages or encumbrances on said property.

Owner Representation. Owner represents and warrants that Owner is the owner of (or owner of the rights to placement of the System) on the Property. Owner is required to allow PowerLutions onsite access to the Property in order to install and operate the System. To the best of Owner’s knowledge, there are no conditions, concealed or otherwise, that would or may impede or delay the Installation or cause the Property to be unsuitable for the Installation, including but not limited to dry rot, termites or mold. If the Installation is to a roof, Owner acknowledges and accepts that any roof penetrations necessary to complete the Installation of a System may void any existing warranty of the roof manufacturer or roof installer. In the event of any conflict between the terms of this Solar Installation Agreement and any other agreement between Owner and PowerLutions, the terms of this Solar Installation Agreement shall control.
