Common use of Paid Compassionate Leave Clause in Contracts

Paid Compassionate Leave. (a) An Employee (other than a Casual Employee) will be entitled to paid compassionate leave in accordance with the Act and subject to the terms of the Act. (b) Subject to clauses 30.1(d) and (e), a Full-Time or Part-Time Employee is entitled to a period of two days of compassionate leave for each occasion when: (i) a member of the Employee's immediate family (as defined by section 12 of the Act) or a member of the Employee’s household: (A) contracts or develops a personal illness that poses a serious threat to his or her life; or (B) sustains a personal injury that poses a serious threat to his or her life; or (ii) a child is stillborn, where the child would have been a member of the Employee's immediate family (as defined by section 12 of the Act) or a member of the Employee's household; or (iii) the Employee or their spouse or de facto partner has a miscarriage. (c) Subject to clauses 30.1(d) and (e), a Full-Time or Part-Time Employee is entitled to a period of three days of compassionate leave for each occasion when a member of the Employee's immediate family (as defined by section 12 of the Act) or a member of the Employee's household dies. (d) An Employee may be required to provide the Employer with satisfactory evidence of such illness, injury, death, stillbirth or miscarriage. (e) Subject to clause 30.1(f), an Employee shall not be entitled to compassionate leave under this clause during any period in respect of which the Employee has been granted other leave or is otherwise stood down on leave of absence without pay. (f) Compassionate leave may be taken in conjunction with leave available under clause 27

(c) Subject to clauses 30.1(d) and (e), a Full-Time or Part-Time Employee is entitled to a period of three days of compassionate leave for each occasion when a member of the Employee's immediate family (as defined by section 12 of the Act) or a member of the Employee's household dies. (d) An Employee may be required to provide the Employer with satisfactory evidence of such illness, injury, death, stillbirth injury or miscarriage.death.‌ (e) Subject to clause 30.1(f), an Employee shall not be entitled to compassionate leave under this clause during any period in respect of which the Employee has been granted other leave or is otherwise stood down on leave of absence without pay.pay.‌ (f) Compassionate leave may be taken in conjunction with leave available under clause 2727 Carer’s Leave. In determining such a request the Employer will give consideration to the circumstances of the Employee and the reasonable operational requirements of the Employer.

(b) For the purposes of this clause, compassionate leave is paid leave taken by an Employee for the purposes of: (i) spending time with a person who is a member of the Employee’s Immediate Family (as defined by section 12 of the Act) or a member of the Employee 's household; and has a personal illness, or injury, that poses a serious threat to his or her life; or (ii) after the death of a member of the Employee's Immediate Family or a member of the Employee's household; or (iii) after the stillbirth of a child where the child would have been a member of the Employee's Immediate Family or a member of the Employee's household; or (iv) After the Employee or their spouse or de facto partner has a miscarriage. (c) Subject to clauses 30.1(d18.1(e) and (ef), a Full-Time time or Part-Time time Employee is entitled to a period of two days of paid compassionate leave for each occasion when: (i) a member of the Employee's immediate family (as defined by section 12 of the Act) or a member of the Employee’s household:household (as defined in the Act): (A) contracts or develops a personal illness that poses a serious threat to his or her life; or (B) sustains a personal injury that poses a serious threat to his or her life; or (ii) a child is stillborn, where the child would have been a member of the Employee's immediate family (as defined by section 12 of the Act) Immediate Family or a member of the EmployeeEmployees's household; or (iii) the Employee or their spouse or de facto partner has a miscarriage. (cd) Subject to clauses 30.1(d18.1(e) and (ef), a Full-Time time or Part-Time time Employee is entitled to a period of three days of compassionate leave for each occasion when a member of the Employee's immediate family (as defined by section 12 of the Act) or a member of the Employeeemployee's household (as defined in the Act) dies. (de) An Employee may be required to provide the Employer Centre with satisfactory evidence of such illness, injury, injury or death, stillbirth or miscarriage. (ef) Subject to clause 30.1(f18.1(g), an Employee shall not be entitled to compassionate leave under this clause during any period in respect of which the Employee has been granted other leave or is otherwise stood down on leave of absence without payleave. (fg) Compassionate leave may be taken in conjunction with leave available under clause 2715.

Paid Compassionate Leave. (a) 24.1.1 An Employee (other than a Casual Employee) will be entitled to paid compassionate leave in accordance with the Act and subject to the terms of the Act. (b) Subject to clauses 30.1(d) and (e)24.1.2 For the purposes of this clause, a Full-Time or Part-Time Employee is entitled to a period of two days of compassionate leave is paid leave taken by an Employee for each occasion whenthe purposes of: (ia) spending time with a person who is a member of the Employee's immediate family ’s Immediate Family (as defined by section 12 of the Act) or a member of the Employee’s household: (A) contracts or develops ; and has a personal illness illness, or injury, that poses a serious threat to his or her life; or (Bb) after the death of a member of the Employee’s Immediate Family or a member of the Employee’s household; or (c) after the stillbirth of a child where the child would have been a member of the Employee’s household; or (d) after the Employee or the Employee’s spouse or de facto partner has had a miscarriage. 24.1.3 Subject to clauses 24.1.5 and 24.1.6 a Full-Time, Fixed Term or Part-Time Employee is entitled to a period of 3 days of compassionate leave for each occasion when a member of the Employee’s immediate family or a member of the Employee’s household: (a) contracts or develops a personal illness that poses a serious threat to life; or (b) sustains a personal injury that poses a serious threat to his or her life; life or (iic) after the stillbirth of a child is stillborn, where the child would have been a member of the Employee's immediate family (as defined by section 12 of the Act) or a member of the Employee's ’s household; or (iiid) after the Employee or their employee’s spouse or de facto partner has had a miscarriage. (c) 24.1.4 Subject to clauses 30.1(d) 24.1.5 and (e)24.1.6, a Full-Time Time, Fixed Term or Part-Time Employee is entitled to a period of three days of compassionate leave for each occasion when a member of the Employee's ’s immediate family (as defined by section 12 of the Act) or a member of the Employee's ’s household dies. (d) 24.1.5 An Employee may be required to provide the Employer with satisfactory evidence of such illness, injury, injury or death, stillbirth or miscarriage. (e) 24.1.6 Subject to clause 30.1(f)24.1.7, an Employee shall not be entitled to compassionate leave under this clause during any period in respect of which the Employee has been granted other leave or is otherwise stood down on leave of absence without payleave. (f) 24.1.7 Compassionate leave may be taken in conjunction with leave available under clause 2721 Personal/Xxxxx's Leave. In determining such a request, the Employer will give consideration to the circumstances of the Employee and the reasonable operational requirements of the Employer.

Paid Compassionate Leave. (a) 19.1.1 An Employee (other than a Casual Employee) will be entitled to paid compassionate leave in accordance with the Act and subject to the terms of the Act. (b) Subject to clauses 30.1(d) and (e)19.1.2 For the purposes of this clause, a Full-Time or Part-Time Employee is entitled to a period of two days of compassionate leave is paid leave taken by an Employee for each occasion whenthe purposes of: (ia) spending time with a person who is a member of the Employee's immediate family ’s Immediate Family (as defined by section 12 of the Act) or a member of the Employee’s household: (A) contracts or develops ; and has a personal illness illness, or injury, that poses a serious threat to his or her life; or (Bb) after the death of a member of the Employee’s Immediate Family or a member of the Employee’s household; or (c) after the stillbirth of a child where the child would have been a member of the Employee’s household; or (d) after the Employee or the Employee’s spouse or de facto partner has had a miscarriage. 19.1.3 Subject to clauses 19.1.5 and 19.1.6 a Full-Time, Fixed Term or Part- Time Employee is entitled to a period of two days of compassionate leave for each occasion when a member of the Employee’s immediate family or a member of the Employee’s household: (a) contracts or develops a personal illness that poses a serious threat to life; or (b) sustains a personal injury that poses a serious threat to his or her life; life or (iic) after the stillbirth of a child is stillborn, where the child would have been a member of the Employee's immediate family (as defined by section 12 of the Act) or a member of the Employee's ’s household; or (iiid) after the Employee or their employee’s spouse or de facto partner has had a miscarriage. (c) 19.1.4 Subject to clauses 30.1(d) 19.1.5 and (e)19.1.6, a Full-Time Time, Fixed Term or Part-Part- Time Employee is entitled to a period of three days of compassionate leave for each occasion when a member of the Employee's ’s immediate family (as defined by section 12 of the Act) or a member of the Employee's ’s household dies. (d) 19.1.5 An Employee may be required to provide the Employer with satisfactory evidence of such illness, injury, injury or death, stillbirth or miscarriage. (e) 19.1.6 Subject to clause 30.1(f)19.1.7, an Employee shall not be entitled to compassionate leave under this clause during any period in respect of which the Employee has been granted other leave or is otherwise stood down on leave of absence without payleave. (f) 19.1.7 Compassionate leave may be taken in conjunction with leave available under clause 2716 Personal/Xxxxx's Leave. In determining such a request, the Employer will give consideration to the circumstances of the Employee and the reasonable operational requirements of the Employer.
