Paid Leave. 19.01 On January 1st 5.1 For the purposes of each calendar year, a regular full-time employee who has successfully completed probation shall receive a calculating entitlement to paid leave credit equivalent pursuant to their full time weekly hours (35 hours) of paid leaveWorking Time Regulations under this clause, the leave year commences on 1 February and ends on 31 January.

In certain circumstances the Employment Business may give counter- notice to the Temporary Worker to postpone or reduce the amount of hours leave that the Temporary Worker wishes to take and in excess such circumstances the Employment Business will inform the Temporary Worker in writing giving at least the same length of 35 shall be paid out notice as the period of leave that has been reques ▇▇▇.
5.4 Entitlement to current employees payment for leave accrues in proportion to the amount of time worked continuously by the Temporary Worker on December 31st of each calendar Assignment during the leave year. The amount of payment which the Temporary Worker will receive in respect of periods of paid leave taken during the course of an Assignment will be based on the pay out of received by the unused credits Temporary Worker for hours worked over the previous 52 weeks prior to for the paid leave. 5.5 Where this contract is terminated by either party and a P45 is requested, in writing, the Temporary Worker shall be made by January 31st entitled to a payment in lieu of any untaken leave where the following year.

The Employer understands the importance of time employee off from work and the important safety benefit resulting from such time off, and encourages employees to utilize their vacation time for rest and relaxation. Section 5. The Manager and the Union Representative will cooperate to be absent from work without loss ensure that employees are permitted to take vacation leave of pay in their choice to the extent possible. In the event of a conflict between vacation leave requests, seniority shall prevail.

In those cases where an employee with at least one (1) year of continuous service resigns or is otherwise terminated, the Employer shall pay out all earned but unused vacation leave to the employee. In the event of death of an employee, the Employer shall pay out all unused vacation leave to the employee’s designated beneficiary or, if not otherwise designated, to the employee’s estate.
Section 7. During periods of stress caused by the death of a family member, an employee, upon request, shall be excused from work with pay for three days. For purposes of this section, a family member is defined as an employee’s spouse, domestic partners (both same sex and opposite), child (to include step and adoptive children), mother, father, sister, brother, grandparents, grandchildren and like in-laws. Employees must promptly notify their ATM of their request for bereavement leave. The employee must complete a Request for Leave form and submit to the Project Management Office (“PMO”). Bereavement leave will not be paid if it occurs when the employee is on vacation or leave of absence, absent due to illness or disabilityinjury, medical/dental appointments and special leaveor not working due to a regularly scheduled day off or a paid holiday.
19.04 After Section 8. Performance of jury duty is considered a basic civic responsibility. When an employee has completed is summoned for jury duty and is required to serve on a regular work day during work hours which the probationary periodemployee would otherwise be scheduled to work, the employee shall be paid the difference between their regular hourly rate of pay not exceeding eight hours per day and the pay for jury service. Any employee who reports for such service and is excused from service early enough to work two (2) hours or more of his shift shall immediately report to work. Employees receiving a jury summons must present the summons and a leave request to the ATM promptly after receipt of such summons and must furnish the ATM with proper written documentation of
Section 9. For the purposes of Section 8 of this Article, and to the extent feasible, an employee’s shift shall be changed so that his regular days off coincided with those of the court.
Section 10. Employees enlisted or entering the military or naval services of the United States shall be granted a pro-rated amount all rights and privileges provided by the applicable federal laws.
Section 11. In the event of credit fire, earthquake, storm, power outage or other emergency which requires the temporary closing of the tower, employees scheduled for paid leave and who report to work (excluding employees on overtime) during such closure shall receive up to four (4) hours of straight time pay for loss of scheduled work. Employees who receive notification from their date of acquiring permanent status. Section 14. Paid leaves shall be used to replace scheduled work hours and may not be used to bring the start of their shift employee’s total paid hours in order that one week to an amount above forty (40). If an employee’s approved paid leave will result in more than forty (40) paid hours in a replacement may be arranged for or duties redistributed. Failing to do sowork week, the approved leave over forty (40) hours will be treated as leave without pay. Any benefit plan(s) and/or accrual of leave shall continue in force during any period an employee shall be considered absent without leave and the Employer shall make a deduction in pay is on paid leave.

Upon retirement from City service, your unused sick leave will be converted to additional service credits at the rate of .004 years of service credit for each day of unused sick leave. If you are going to be absent, you must notify your supervisor as soon as possible before of your inability to work, normally no later than the start of their shift your shift. Sick leave is a privilege. Violations or abuse will result in order that a replacement may be arranged for or duties redistributed. In instances where more days are needed due to critical illnesses/disabilities (i.e. requiring hospital confinement, life threatening situations, etc.), the employee may request additional days in writing to the superintendent. This applies to the spouse, child residing at home or other family member referenced in section h below. Such requests will be reviewed on a case by case basis and the determination of the superintendent is not subject to the grievance procedure.
3. Up to three (3) days per year, of accumulated sick days, may be used for prearranged absences not covered by personal illness or family illness as described in this article. Employee shall give written notice at least five days in advance of taking a prearranged absence day. Consecutive prearranged absence days require prior approval by the Superintendent. The district reserves the right to limit the number of prearranged absence days when multiple employee absences within a classification or building would cause a substitute shortage. Preference will be given to earliest dated request. Prearranged absences may not be used for Association business or extending a vacation, holiday or extending calendar days off. The Superintendent may waive the above guidelines if circumstances warrant it.
4. Employees are allowed to use up to five (5) excused leave days over winter break and three (3) excused leave days over spring break. The number of allowed days will be reduced by each excused leave day used before winter break and from winter break to spring break respectively. Employees may also use their two (2)inclement weather days over spring break if they have not used them for inclement weather. (Sick leave days used for inclement weather will not count against these days.)
D. Except in the case of emergency, the employee shall give the immediate supervisor twenty-four (24) hours written notice of their intent to use Excused Leave and shall state, in general terms, the reason for the use. Employees who are absent due to the illness or disability of the employee for five (5) or more consecutive work days, will provide a doctor’s statement indicating the employee has been approved to return to work and a general statement of the cause of the absence. Once an employee has used six (6) absence days for sick leave in one year, the employee will submit a doctor’s excuse or appropriate documentation when they are absent for more than two (2) consecutive days, or more than three (3) days in a seven (7) calendar day period. Days used for inclement weather or prearranged absence days shall not count towards the six (6). If doctor’s excuses are required at other times, the employee will be advised accordingly.
E. Unused excused leave may be accumulated to a maximum equal to one hundred (100) workdays.
F. Any employee who is summoned for jury duty and as a result is unable to work all or part of their normal workday shall suffer no loss of pay. The employee shall advise the employer of any compensation he/she shall receive from the court, excluding reimbursement for travel or other related expense. The employee shall be absent paid the difference between their regular gross pay and the court compensation. Such leave for jury duty shall not be deducted from work excused leave.
G. Any employee who is requested to appear as a witness in a court case involving the school district and at the request of the school attorney or is requested and/or approved to attend an educational conference by their supervisor, shall not suffer a loss of pay and such time shall not be deducted from their accumulated excused leave.
H. Up to five (5) days per occurrence in the event of a death in the immediate family which necessitates the employee’s absence from work, without loss of pay and without deduction from excused leave. Additional time may be granted by the Superintendent in extenuating circumstances or where extensive travel is required. Such time will be without pay or deducted from excused leave. Immediate family shall be defined as parents, brother, sister, spouse, child, grandchild, grandparents, brother-in-law, sister-in- law, legal guardian, mother-in-law, father-in-law, son-in-law, daughter-in-law of the event employee or, at the Superintendent’s discretion, any other person.
I. At the end of illness the school year, of the first four (4) days provided in Article 18.B. any employees who are absent four (4) days or disabilityless, medical/dental appointments and special may, at their option, be paid their current rate per unused day. (i.e. an employee who had no absences would be paid four (4) times their current daily rate).

Paid Leave. 19.01 On January 1st The Employer shall continue to pay premiums for benefit plans for employees who are on paid leave of each calendar yearabsence or if the employee continues their contribution towards said benefits. It is understood that the obligation of the Employer, to pay the aforesaid benefits while on shall continue for up to thirty (30) months following the date of the injury. For purposes of this provision, it is understood and agreed that absence on Weekly Indemnity shall be considered a regular fullleave with pay. Paid Leave. 19.01 On January 1st 16.1 The College shall make available to each employee and immediate supervisor a statement as requested setting forth the total earned sick leave credit and accumulated vacation time in a timely fashion.
16.2 An employee unable to work because of each calendar yeara medical illness or disability shall, upon return, be placed in his/her former position if return is within one year of commencement of the illness or disability.
16.3 In any case where an employee is absent from his/her employment by reason of an injury compensable under the Workers Compensation Act, such employee shall be paid the amount payable under the existing leave time policy, less the amount of compensation payable to such employee under this Act. The number of scheduled workdays deductible from such employee’s accumulated leave time, computed on the basis of the amount of compensation paid under the Act, as measured by the employee’s regular wage daily rate, shall not be deducted from accumulated leave time. In cases where the amount of compensation paid equals more than a half-day (1/2), but less than a whole day, the whole day shall be allowed.
16.4 All regular full-time employee who has successfully completed probation employees shall accumulate one (1) day of paid leave time for each month worked, with a maximum of twelve (12) per year. Regularly scheduled part-time employees shall receive proportionate paid leave time based on the number of scheduled work hours per week. Annual paid leave time advanced and used but unearned at termination shall be deducted in the employee’s final pay calculation. Such deduction of any unearned paid leave time shall be an authorized deduction from the employee’s final pay. The College retrains the right to use available means to collect overpayment not recovered in final pay.
16.5 One-hundred fifty (150) days shall be the maximum leave time accumulation. Part-time maximum accumulation shall be prorated according to hours worked. No payout of unused paid leave time will be made upon separation of employment.
16.6 Employees must work the scheduled workday before and the scheduled workday after a holiday or vacation in order to receive their holiday/vacation pay except where there are mitigating circumstances as determined by payroll. The recommendation of payroll may be appealed to the Head of Human Resources, who shall make the final decision. The following guidelines will be used for implementation to ensure proper use of paid leave (sick) days.
A. Language will apply to those individuals designated by Human Resources Department as improperly using paid leave before and/or after holidays or vacations as evaluated through the Human Resources guidelines. The Human Resources Department will designate individuals that improperly use paid leave and discuss those issue(s) with the employee and supervisor. A memo indicating designation will be sent to employee, supervisor and personnel file.
1. Individuals designated as improperly using a paid leave credit equivalent before/after holiday/ vacation must submit absence form to their full time weekly hours appropriate ▇▇▇▇/Vice President.
2. ▇▇▇▇ or Vice President in conjunction with Human Resources must determine if absence is due to a mitigating circumstance.
3. Loss of pay for improper use of paid leave under 16.6 will be the loss of pay, for one day, with the one (35 hours1) of sick day(s) still charged to paid leave.

C. If the eligible employee or the eligible employee’s family member is a victim of domestic violence or sexual assault, the medical care or psychological or other counseling for physical or psychological injury or disability; to obtain services from a victim services organization; to relocate due to domestic violence or sexual assault; to obtain legal services; or to participate in any civil or criminal proceedings related to or resulting from the domestic violence or sexual assault. The College may require an employee to provide documentation that the paid leave creditshas been used for this purpose.

For closure of the eligible employee’s primary workplace by order of a public official due to a public health emergency; for an eligible employee’s need to care for a child whose school or place of care has been closed by order of a public official due to a public health emergency; or if it has been determined by the health authorities having jurisdiction or by a health care provider that the eligible employee’s or eligible employee’s family member’s presence in the community would jeopardize the health of others because of the eligible employee’s or family member’s exposure to a communicable disease, whether or not the eligible employee or family member has actually contracted the communicable disease. The College may require an employee to provide documentation that the paid leave has been used for this purpose. For purposes of the above leaves (paragraphs A-D), family member is defined as: a) a biological, adopted or ▇▇▇▇▇▇ child, stepchild or legal ▇▇▇▇, or a child to whom the employee stands in loco parentis; b) a biological parent, ▇▇▇▇▇▇ parent, stepparent, or adoptive parent or legal guardian of an employee or an employee’s spouse or an individual who stood in loco parentis when the employee was a minor; c) an individual to whom the employee is legally married under the laws of any state; d) a grandparent; e) a grandchild; f) a biological, ▇▇▇▇▇▇, or adopted sibling.
E. Death of a father, mother, son, daughter, stepchild, legal ▇▇▇▇ or spouse, brother, sister, father-in-law, mother-in-law, sister-in-law, brother-in-law, son-in-law, daughter-in-law, grandparents and grandparents in-law, and grandchildren with a limit of five (5) workdays allowed per occurrence. Paid Leave. 19.01 On January 1st (a) At the beginning of each calendar payroll year, a regular fullRegular Full-time employee Employee who has successfully completed probation shall will receive a paid leave credit equivalent to their full time weekly of fifty-four point two five (54.25) hours (35 hours) of paid leave. Paid leave entitlements for a Regular Part-time Employee shall be pro-rated in accordance with his/her regularly scheduled hours of work (FTE).
19.02 Paid leave credits will accumulate to (b) Where a maximum of 35 hours. Where an employee Regular Employee has unused paid leave credits in excess at the end of 35 hoursthe payroll year, the amount of hours in excess of 35 shall he/she will be paid out to current employees on unused credits at his/her basic rate of pay as December 31st of each that calendar year. The pay out of the unused credits to for shall will be made by January 31st March 1st of the following calendar year.
19.03 (c) Notwithstanding (b), an employee may request in writing that unused hours of paid leave be carried forward into the next year, providing that the request is made prior to October 1st of any year. A Regular Full-time employee may carry forward unused hours, provided that the employee has not more than ninety-three (93) hours in his/her bank at any time. Maximum hours for a Regular Part-time employee shall be pro-rated in accordance with his/her regularly scheduled hours of work (FTE). If the addition of the next year’s credits under (a) takes an employee beyond that employee’s allowable maximum credits, the difference shall be paid out to the employee in accordance with (b).
(a) Paid leave credits may be used by an employee Employee to be absent from work without loss of pay in the event of illness or disability, medical/dental appointments and special leaveor illness in the immediate family requiring the Employee’s personal attention.
19.04 After (b) In the first year of employment, after an employee Employee has completed the probationary period, the employee Employee shall be granted allowed a pro-rated amount of credit for paid leave from their the date of acquiring permanent statusemployment, prorated to the number of months remaining in the calendar year. However, the Employee shall not be entitled to apply paid leave credits shall not be applied retroactively prior to their hire datethe completion of the probationary period.
(i) Part-time employees shall be granted paid leave credits on a pro-rated basis in accordance with hours worked.
(ii) Part-time employees who post into a temporary vacancy will accumulate paid leave in accordance with the hours of the temporary position.
19.06 An employee 29.03 Employees reporting absent due to illness or injury or illness in the immediate family requiring the Employee’s personal attention shall do so to the Employer as soon as possible before the start of their shift in order that a replacement may be arranged for or duties redistributed. Failing to do so, the employee Employee shall be considered absent without leave and the Employer shall may make a deduction in pay for the time which expires between the time the employee Employee should have reported for work and the time at which the employee Employee reported absent. An employee will obtain prior permission from her supervisor to be absent for a medical or dental appointment.
19.07 29.04 Subject to the aboveArticle 29.01, 29.02 and 29.03, an employee Employee granted paid leave shall be paid, at her basic rate of pay for regularly scheduled shifts hours absent due to illness or disability, medical/dental appointments, and illness in the immediate family requiring the employee’s personal attentionspecial leave, and the number of hours thus paid shall be deducted from his/her accumulated paid casual leave credits up to the total amount of his/her available credits at the time the leave commenced. Employees may use paid leave or unpaid at their discretion until July 31st of each year after which the employer may require the use of paid leave rather than unpaid leave.
19.08 Employees who are off because of sickness or accident shall at the expiration of paid leave benefits, be continued on the payroll under the heading of leave of absence without pay for a period of not less than one (1) month plus an additional one (1) month for each additional three (3) years of service, or proportion thereof, beyond the first fiscal year of service.
