Common use of Payment for period of leave Clause in Contracts

Payment for period of leave. (a) Payment to an Employee in respect of long service leave will be made in one of the following ways: (i) in full in advance when the Employee commences his/her leave; or (ii) at the same time as payment would have been made if the Employee had remained on duty; in which case payment will, if the Employee in writing so requires, be made by cheque posted to a specified address; or (iii) in any other way agreed between the Employer and the Employee. (b) Where the employment of an Employee is for any reason terminated before he/she takes any long service leave to which he/she is entitled, or where any long service leave accrues to an Employee pursuant to subclause 82.1(b)(ii), the Employee will subject to the provisions of subclause 82.4(c) be entitled to pay in respect of such leave as at the date of termination employment. (c) Where any long service leave accrues to an Employee pursuant to subclause 82.1(b)(iii) the Employee will be entitled to pay in respect of such leave as at the date of termination of employment. (d) Provided in the case of an Employee of an Institution or Statutory Body who accrues entitlement pursuant to subclause 82.1(b)(iii) and who intends to be re-employed by another Institution or Statutory Body: (i) such an Employee may in writing request payment in respect of such leave to be deferred until after the expiry of the Employee's allowable period of absence from employment provided in subclause 82.2(d)(vii); and (ii) except where the Employee gives the Employer notice in writing that the Employee has been employed by another Institution or Statutory Body, the Employer will make payment in respect of such leave at the expiry of the Employee's allowable period of absence from employment; and (iii) where the Employee gives the Employer notice in writing that the Employee has been employed by another Institution or Statutory Body the Employer is no longer required to make payment to the Employee in respect of such leave. (e) Where an increase occurs in the ordinary time rate of pay during any period of long service leave taken by the Employee, the Employee will be entitled to receive payment of the amount of any increase in pay at the completion of such leave.

(dc) Provided in the case of an Employee of an Institution or Statutory Body who accrues entitlement pursuant to subclause 82.1(b)(iii) clause 27.2 and who intends to be re-employed by another Institution or Statutory Body: (i) such Such an Employee may in writing request payment in respect of such leave to be deferred until after the expiry of the Employee's allowable period of absence from employment provided provided, in subclause 82.2(d)(viiclause 27.3(e)(vii); and. (ii) except Except where the Employee gives dies the Employer gives notice in writing that the Employee has been employed by another Institution or Statutory Body, Body the Employer will shall make payment in respect of such leave at the expiry of the Employee's allowable period of absence from employment; and. (dii) Provided in the case of an Employee of an Institution or Statutory Body the Employer who accrues entitlement pursuant to subclause 82.1(b)(iiiClause 57.1(b)(iii) and who intends to be re-employed by another Institution Facility or Statutory Bodyother entity of the Employer: (iA) such Such an Employee may in writing request payment in respect of such leave to be deferred until after the expiry of the Employee's allowable period of absence from employment provided in subclause 82.2(d)(viiClause 57.2(b)(vii); and. (iiB) except Except where the Employee gives the Employer notice in writing that the Employee has been employed by another Institution of the Employer’s facilities or Statutory Bodyentities, the Employer will shall make payment in respect of such leave at the expiry of the Employee's allowable period of absence from employment; and. (iiiC) where Where the Employee gives the Employer notice in writing that the Employee has been employed by another Institution or Statutory Body facility of the Employer, the Employer is no longer required to make payment to the Employee in respect of such leave. (ec) Where an increase occurs in the ordinary time rate of pay during any period of long service leave taken by the Employee, the Employee will shall be entitled to receive payment of the amount of any increase in pay at the completion of such leave.

(dii) Provided in the case of an Employee of an Institution or Statutory Body the Employer who accrues entitlement pursuant to subclause 82.1(b)(iiiClause 57.1(b)(iii) and who intends to be re-employed by another Institution Facility or Statutory Bodyother entity of the Employer: (iA) such Such an Employee may in writing request payment in respect of such leave to be deferred until after the expiry of the Employee's allowable period of absence from employment provided in subclause 82.2(d)(viiClause 57.2(b)(vii); and. (dii) Provided in the case of an Employee of an Institution or Statutory Body the Employer who accrues entitlement pursuant to subclause 82.1(b)(iii) and Clause 59.1and who intends to be re-employed by another Institution Facility or Statutory Bodyother entity of the Employer: (iA) such Such an Employee may in writing request payment in respect of such leave to be deferred until after the expiry of the Employee's allowable period of absence from employment provided in subclause 82.2(d)(viiClause59.2(c)(ii); and. (iiB) except Except where the Employee gives the Employer notice in writing that the Employee has been employed by another Institution of the Employer’s facilities or Statutory Bodyentities, the Employer will shall make payment in respect of such leave at the expiry of the Employee's allowable period of absence from employment; and. (iiiC) where Where the Employee gives the Employer notice in writing that the Employee has been employed by another Institution or Statutory Body facility of the Employer, the Employer is no longer required to make payment to the Employee in respect of such leave. (ec) Where an increase occurs in the ordinary time rate of pay during any period of long service leave taken by the Employee, the Employee will shall be entitled to receive payment of the amount of any increase in pay at the completion of such leave.

(b) Where the employment of an Employee is for any reason terminated terminates before he/she takes they take any long service leave to which he/she is entitled, they are entitled or where any long service leave accrues to an Employee pursuant to subclause 82.1(b)(ii), Clause 58.1 (b)(i) the Employee will shall, subject to the provisions of subclause 82.4(c) this clause, be entitled to pay in respect of such leave as at the date of termination of employment.: (ci) Where any long service leave accrues to an Employee pursuant to subclause 82.1(b)(iiiClause 58.1 b)(i) the Employee will shall be entitled to pay in respect of such leave as at the date of termination of employment. (dii) Provided in the case of an Employee of an Institution or Statutory Body Baptcare who accrues entitlement pursuant to subclause 82.1(b)(iii) Clause 58.1 b)(i). and who intends to be re-employed by another Institution Facility or Statutory Bodyother entity of Baptcare: (i) such A. Such an Employee may in writing request payment in respect of such leave to be deferred until after the expiry of the Employee's allowable period of absence from employment provided in subclause 82.2(d)(viiClause 58.3 b); and (ii) except B. Except where the Employee gives the Employer Baptcare notice in writing that the Employee has been employed by another Institution of Baptcare’s facilities or Statutory Bodyentities, the Employer will Baptcare shall make payment in respect of such leave at the expiry of the Employee's allowable period of absence from employment; and. (iii) where C. Where the Employee gives the Employer Baptcare notice in writing that the Employee has been employed by another Institution or Statutory Body the Employer facility of Baptcare, Baptcare is no longer required to make payment to the Employee in respect of such leave. (ec) Where an increase occurs in the ordinary time rate of pay during any period of long service leave taken by the Employee, the Employee will shall be entitled to receive payment of the amount of any increase in pay at the completion of such leave.

(c) Where any long service leave accrues to an Employee pursuant to subclause 82.1(b)(iiisub- clause 60.1(b)(iii) the Employee will shall be entitled to pay in respect of such leave as at the date of termination of employment. (d) Provided that in the case of an Employee of an Institution or Statutory Body who accrues long service leave entitlement pursuant to subclause 82.1(b)(iiisub-clause 60.1(b)(iv) and who intends to be re-employed by another Institution or Statutory Body: (i) : such an Employee may in writing request payment in respect of such leave to be deferred until after the expiry of the Employee's allowable period of absence from employment employment, as provided in subclause 82.2(d)(viiclause 60.2(d)(ii); and (ii) except where the Employee gives the Employer notice in writing that the Employee has been employed by another Institution or Statutory Body, the Employer will shall make payment in respect of such leave at the expiry of the Employee's allowable period of absence from employment; and (iii) and where the Employee gives the Employer notice in writing that the Employee has been employed by another Institution or Statutory Body Body, the Employer is no longer required to make payment to the Employee in respect of such leave. (e) Where an increase occurs in the ordinary time rate of pay during any period of long service leave taken by the Employee, the Employee will shall be entitled to receive payment of the amount of any increase in pay at the completion of such leave.

(a) Payment to an Employee employee in respect of long service leave will Long Service Leave shall be made in one of the following ways: (i) in full in advance when the Employee employee commences his/her their leave; or (ii) at the same time as payment would have been made if the Employee employee had remained on duty; in which case payment willshall, if the Employee employee in writing so requires, be made by cheque posted to a specified address; or (iii) in any other way agreed between the Employer and the Employeeemployee. (b) Where the employment of an Employee employee is for any reason terminated before he/she takes they take any long service leave Long Service Leave to which he/she is entitled, they are entitled or where any long service leave Long Service Leave accrues to an Employee employee pursuant to subclause 82.1(b)(ii), clause 65.3(b) the Employee will employee shall subject to the provisions of subclause 82.4(c65.3(b)(iii) be entitled to pay in respect of such leave as at the date of termination of employment. (c) Where any long service leave Long Service Leave accrues to an Employee employee pursuant to subclause 82.1(b)(iii) the Employee will 65.3(b)(iii),the employee shall be entitled to pay in respect of such leave as at the date of termination of employment. (d) Provided in the case of an Employee employee of an Institution or Statutory Body who accrues entitlement pursuant to subclause 82.1(b)(iii65.3(b)(iii) and who intends to be re-re- employed by another Institution or Statutory Body: (i) such an Employee employee may in writing request payment in respect of such leave to be deferred until after the expiry of the Employee's employee’s allowable period of absence from employment provided in subclause 82.2(d)(vii65.4(d)(vii); and; (ii) except where the Employee employee gives the Employer notice in writing that the Employee employee has been employed by another Institution or Statutory Body, Body the Employer will shall make payment in respect of such leave at the expiry of the Employee's employee’s allowable period of absence from employment; and (iii) where the Employee employee gives the Employer notice in writing that the Employee employee has been employed by another Institution or Statutory Body the Employer is no longer required to make payment to the Employee employee in respect of such leave. (e) Where an increase occurs in the ordinary time rate of pay during any period of long service leave Long Service Leave taken by the Employeeemployee, the Employee will employee shall be entitled to receive payment of the amount of any increase in pay at the completion of such leave.
