Payments from the Special Account. Each agency or other provider receiving funding to perform functions under the Joint Field Management Program will enter into a Memorandum of Understanding, service agreement or contract for the provision of those services and functions specifying:  the outputs and activities to be delivered;  the funding to be allocated;  the resources, agencies and operational units responsible for performing specified activities; and  the performance indicators for monitoring, evaluating and reporting on the delivery of the outputs and activities identified. Payments to instrumentalities and other providers performing functions and activities under the Joint Field Management Program will be made by the Authority on receipt of an invoice prepared in accordance with the terms of the service-level agreement, Memorandum of Understanding or contract for that agency or other provider. All money paid directly or indirectly to an agency or other provider pursuant to this agreement must be expended in accordance with this agreement, the relevant Field Management Annual Plan and the relevant service-level agreement, Memorandum of Understanding or contract for that agency or other provider. Unless otherwise agreed, any money paid to an agency or other provider pursuant to this agreement but not spent in the financial year for which it is provided must be made available to the Authority for reallocation by the Field Management Strategy Group in the following financial year.

Payments from the Special Account. The Solicitor’s Opinion also provided recommendations regarding payments from the SNPLMA and FLTFA special accounts to Federal agencies. The opinion advised that XXXXXX does not authorize “advance payments.” Further, although the SNPLMA does not include a general authority to utilize reimbursement of funds, reimbursement may be utilized under the Economy Act if applicable. The Solicitor advised that the Executive Committee revise the SNPLMA Implementation Agreement to provide for payment of an Agency’s necessary project expenses without use of the reimbursement mechanism and that “payments for approved projects should be made at logical stages in the life of a project while it is being implemented.” Project reimbursements/payments are made to the eligible agency/entity for which the projects were approved with one exception. That exception is payment for consultation with the Fish and Wildlife Service under the Endangered Species Act. This consultation is required for many projects across all project categories. Due to the extensive number of required consultations, funds for the Endangered Species Act consultation will be transferred directly to the FWS on a project-by-project basis following the transfer process below. The agencies/entities and FWS will identify those projects requiring such consultation and provide an estimate of the cost of the consultation as a separate line item on the Estimated Necessary Expense Form (Appendix B-1 to B-8), so that the SNPLMA Division can effect the transfer in a manner that allocates consultation costs to the appropriate projects.

  • Special Account 1. For the purposes of this Schedule:

  • Payment Account (a) On or prior to the Closing Date, the Property Trustee shall establish the Payment Account. The Property Trustee and any agent of the Property Trustee shall have exclusive control and sole right of withdrawal with respect to the Payment Account for the purpose of making deposits in and withdrawals from the Payment Account in accordance with this Trust Agreement. All monies and other property deposited or held from time to time in the Payment Account shall be held by the Property Trustee in the Payment Account for the exclusive benefit of the Securityholders and for distribution as herein provided, including (and subject to) any priority of payments provided for herein.

  • Withdrawals from Accounts Amounts credited to the Certificate Account and the Trust Account on any Distribution Date shall be withdrawn by Xxxxxx Xxx for application towards the distributions required hereby. In the event that amounts shall remain in the Certificate Account in any month following distribution of the Lower Tier Distribution Amount for such month, such amounts may be withdrawn by Xxxxxx Mae as compensation for its administrative and guaranty obligations or as reimbursement to Xxxxxx Xxx for any advance by it pursuant to such guaranty obligations under Sections 2.04 and 3.07 hereof. Any amount so withdrawn shall no longer be a part of the Lower Tier REMIC.

  • Special Accounts 1. For the purposes of this Schedule:

  • Final Account 57.1 The Contractor shall supply to the Engineer a detailed account of the total amount that the Contractor considers payable under the Contract before the end of the Defects Liability Period. The Engineer shall issue a Defect Liability Certificate and certify any final payment that is due to the Contractor within 56 days of receiving the Contractor's account if it is correct and complete. If it is not, the Engineer shall issue within 56 days a schedule that states the scope of the corrections or additions that are necessary. If the Final Account is still unsatisfactory after it has been resubmitted, the Engineer shall decide on the amount payable to the Contractor and issue a payment certificate, within 56 days of receiving the Contractor’s revised account.

  • Escrow Account 31.1.1 The Concessionaire shall, prior to the Appointed Date, open and establish an Escrow Account with a Bank (the “Escrow Bank”) in accordance with this Agreement read with the Escrow Agreement.

  • Operating Account To the extent funds are not required to be placed in a lockbox pursuant to any Loan Documents, Property Manager shall deposit all rents and other funds collected from the operation of the Property in a reputable bank or financial institution in a special trust or depository account or accounts for the Property maintained by Property Manager for the benefit of the Company (such accounts, together with any interest earned thereon, shall collectively be referred to herein as the “Operating Account”). Property Manager shall maintain books and records of the funds deposited in and withdrawals from the Operating Account. With funds from Company, Property Manager shall maintain the Operating Account so that an amount at least as great as the budgeted expenses for such month is in the Operating Account as of the first of each month. From the Operating Account, Property Manager shall pay the operating expenses of the Property and any other payments relative to the Property as required by this Agreement. If more than one account is necessary to operate the Property, each account shall have a unique name, except to the extent any Lender requires sub-accounts within any account. Within three (3) months after receipt by Property Manager, all rents and other funds collected in the Operating Account, after payment of all operating expenses, debt service and such amounts as may be determined by the Property Manager to be retained for reserves or improvements, shall be paid to the Company.

  • Reserve Account (a) On the Closing Date, the Seller shall deposit the Specified Reserve Balance into the Reserve Account. Amounts held from time to time in the Reserve Account shall be held by the Trust Collateral Agent for the benefit of the Noteholders.

  • Custodial Account Funds in any custodial accounts established by the Servicer and maintained in respect of the REMIC may be invested and, if invested, shall be invested in Eligible Investments selected by the Servicer which shall mature not later than the Business Day immediately preceding the next Remittance Date, and any such Eligible Investment shall not be sold or disposed of prior to its maturity. All such Eligible Investments shall be made in the name of the REMIC or its nominee. All income and gain realized from any such investment shall be, as long as the Servicer is servicing the Mortgage Loans held by the REMIC, for the benefit of the Servicer as additional compensation and shall be subject to its withdrawal or order from time to time. The amount of any losses incurred in respect of any such investments shall be deposited in the relevant account by the Servicer out of its own funds immediately as realized. The foregoing requirements for deposit in such account are exclusive, it being understood and agreed that, without limiting the generality of the foregoing, payments of interest on funds in such account and, as long as the Servicer is servicing the Mortgage Loans held by the REMIC, payments in the nature of prepayment fees, late payment charges, assumption fees or any similar fees customarily associated with the servicing mortgage loans paid by any mortgagor need not be deposited by the Servicer in such account and may be retained by the Servicer as additional servicing compensation. If the Servicer deposits in such account any amount not required to be deposited therein, it may at any time withdraw such amount, any provision herein to the contrary notwithstanding.

  • Suspense Account The Security Trustee and any Creditor Party may, for the purpose of claiming or proving in a bankruptcy of a Borrower or any other Security Party, place any sum received or recovered under or by virtue of this Guarantee or any Security Interest connected with it on a separate suspense or other nominal account without applying it in satisfaction of the Borrowers’ obligations under the Loan Agreement or the Master Agreements.
