Permit Issuance Conditions. District will issue a Permit(s) to Licensee only when District determines, in its sole judgment, which shall not be unreasonably withheld, that (i) it has sufficient Capacity to accommodate the requested Attachment(s), (ii) permitting the Attachment(s) is consistent with safety and reliability requirements, and (iii) Licensee meets all generally applicable engineering standards and practices.
Permit Issuance Conditions. The Utility will issue a Permit(s) to Licensee only when the Utility determines, in its sole judgment, which shall not be unreasonable withheld, that (i) it has sufficient Capacity to accommodate the requested Attachment(s),

Town will issue a Permit(s) to Licensee only when Town determines, in its sole discretion, exercised reasonably, that: (i) it has sufficient Capacity to accommodate the requested Attachment(s); (ii) Licensee meets all requirements set forth in this Agreement; and (iii) such Permit(s) comply with all Applicable Standards.
Permit Issuance Conditions. Utility will issue a Permit to Licensee only when Utility determines, in its sole judgment, reasonably exercised, that (i) it has sufficient capacity to accommodate the requested Wireless Attachments, (ii) Licensee meets all requirements set forth in this Agreement, and (iii) the affected Poles can safely accommodate the proposed Wireless Attachments consistent with all applicable Engineering Standards and Good Utility Practice.
Permit Issuance Conditions. Owner Utility will issue a Permit(s) to Attaching Utility only when Owner Utility determines, in its sole judgment, that (i) it has sufficient Capacity to accommodate the requested Attachment(s), (ii) Attaching Utility meets all requirements set forth in this Agreement, and (iii) such Permit(s) comply with all Applicable Standards. DataLink shall comply with the considerations set out in Appendix D when determining whether a particular Pole has sufficient Capacity to accommodate the requested Attachment(s).
Permit Issuance Conditions. Utility will issue one or more Permit(s) to Licensee only when Utility determines, in its sole judgment, exercised reasonably, that (i) it has sufficient Capacity to accommodate the requested Attachment(s),
Permit Issuance Conditions. The City will issue a Permit(s) to Licensee only when the City determines, in its sole judgment, exercised reasonably, that (i) it has sufficient Capacity to accommodate the requested Attachment(s), (ii) Licensee meets all requirements set forth in this Agreement, and (iii) such Permit(s) comply with all Applicable Standards. Notwithstanding, the City reserves the right to deny or modify Licensee access to any City Facilities, on a competitively-neutral and non-discriminatory basis, where City determines that Licensee’s proposed attachment will (a) jeopardize the public health, safety or welfare, or (b) unreasonably limit or harm the capacity, functionality, reliability, governmental interests or aesthetics of City’s Facilities, or (c) violate applicable zoning restrictions or other laws and regulations, or (d) exceed the capacity of the Facilities to include taking into consideration the reserved capacity of the Facilities, or (e) interfere with the City’s intended use of the Facilities, and (f) interfere with any other reasonable governmental interest.
Permit Issuance Conditions. The Town will issue one or more Permit(s) to Grantee only when the Town determines, in its sole judgment, exercised reasonably, that, in the case of the use of Municipal Facilities, there is sufficient capacity to accommodate the requested Attachment(s), andthat in all cases (i) Grantee meets all requirements set forth in this Agreement, and (ii) such Permit(s) comply with all Applicable Standards and with applicable Law, including, without limitation, Chapter 172 of the Town Code.
Permit Issuance Conditions. JEA will issue a Permit(s) to Licensee only when JEA determines, in its reasonable judgment that: (i) it has sufficient capacity to accommodate the requested Attachments within the Communications Zone; (ii) Licensee meets all requirements set forth in this Agreement; and (iii) such Permit(s) comply with all Applicable Standards.
Permit Issuance Conditions. Grant PUD will issue a Permit(s) to Licensee only when Grant PUD determines, in its sole judgment, which shall not be unreasonably withheld, that (i) it has sufficient Capacity to accommodate the requested Attachment(s), (ii) permitting the Attachment(s) is consistent with safety and reliability requirements, and (iii) Licensee meets all generally applicable engineering standards and practices.
