Perpetual Care. (a) As part of the Co-Proponents’ Environmental Plans and Programs, in particular as required by section 4.1(k), the Co-Proponents shall develop a comprehensive Perpetual Care plan that must address improvements in records management, communication with future generations, long-term access to funds for the Project and analysis of different possible future scenarios that might affect the Perpetual Care of the Project.

Perpetual Care. The University will provide perpetual care of the Cemetery. This includes the Cemetery including, but not limited to, maintenance of grounds, infrastructure, and roads. Perpetual care does not include, and the University will not be responsible for, maintenance, upkeep or repair of any marker, monument or headstone or of any permanently affixed vases or ornaments unless the damage is a direct result of the act of University’s employees or contractors. The University takes no responsibility for loss or damage to flowers, vases, mementos, or ornaments that are not permanently affixed to the gravesite.

Perpetual Care. (A) The price for the burial sites in Beechwood Cemetery (as provided for in § 92.19) shall include perpetual care in the amount of $150 per grave site (five feet by ten feet space), and double burial plots (ten feet by ten feet) in the amount of $300, for plots sold pursuant to § 92.19(A)(1), and $200 per grave site for plots sold pursuant to § 92.19(A)(2). The perpetual care fee shall be paid at the time of lot purchase.
Perpetual Care. At the time of purchase of a cemetery lot in Xxxxxxxxx Cemetery, a fee shall be paid for the perpetual care of the cemetery lot. Monies to pay for the Perpetual Care shall be placed in a Perpetual Care fund. This fund is an irrevocable trust from which deposits cannot be withdrawn, and the income from said fund shall be used by the City of Xxxxxxxx for the maintenance, repair and care of Xxxxxxxxx Cemetery. Amounts paid for Perpetual Care shall be set by Resolution of the City Council, and payments made for the purchase of a cemetery lot shall first be credited to the Perpetual Care fund. If the owner of said lot wishes to sell the lot back to the City of Xxxxxxxx as specified in Section 4 of this document, only the fee for the Cemetery Lot is to be refunded. Perpetual Care payments cannot be withdrawn from this irrevocable trust, even in the event of cancellation or sale back to the City of Xxxxxxxx.

Ephraim City will also be responsible for all necessary growth and development within the cemetery.
