Plan Changes, Additional Construction, Etc. A. The State will make changes in the Project Plans and contract construction, which may include the City participation construction covered under this Agreement, and will enter into any necessary addenda and change orders with the State's contractor that are necessary to cause the contract construction to be performed and completed in a satisfactory manner. The State District Engineer's authorized representative will inform the appropriate City official of any proposed addenda and change orders to the construction contract that will affect the City participation construction covered under this Agreement.

The State reserves the right to invoice Blaine for the cost of any additional Blaine-requested work and plan changes, construction contract addenda, change orders, and associated construction engineering before the completion of the contract construction.

The State shall make changes in the plans and contract construction, which may include the City cost participation construction covered under this Agreement, and shall enter into any necessary addenda, change orders and supplemental agreements with the State's contractor that are necessary to cause the contract construction to be performed and completed in a satisfactory manner. However, the State District Engineer's authorized representative will inform the appropriate City official of any proposed addenda, change orders and supplemental agreements to the construction contract that will affect the City cost participation construction covered under this Agreement. The City hereby authorizes the State to enter into, for and on behalf of the City, the change orders and supplemental agreements specified in this paragraph. The contract construction may encounter contaminated materials during the construction of the City utility facilities. Excavation and disposal of contaminated material will be paid for as extra work at the time of discovery. The State and the City will cooperate in determining the cost responsibility of the extra work necessary as a result of the contaminated material.
