Political Events Sample Clauses

Political Events. Any of the following events shall constitute Political Event: (a) Change in Law for which no relief is provided under the provisions of Article 13, resulting in Material Adverse Effect; (b) action of a Government Authority having Material Adverse Effect including but not limited to (i) acts of expropriation, compulsory acquisition or takeover by any Government Authority of the Project/Project Facilities and Services or any part thereof or of the Concessionaire’s or the Contractor’s rights under any of the Project Contracts, and (ii) any unlawful, unauthorized or without jurisdiction refusal to issue or to renew or the revocation of any Applicable Permits, in each case, for reasons other than the Concessionaire’s or the Contractor’s breach or failure in complying with the Project Requirements, Applicable Laws, Applicable Permits, any judgment or order of a Governmental Agency or of any contract by which the Concessionaire or the Contractor as the case may be is bound; (c) early determination of this Agreement by the Concessioning Authority for reasons of national emergency, national security or the public interest; (d) any failure or delay of a Contractor caused by any of the aforementioned Political Events, for which no offsetting compensation is payable to the Concessionaire by or on behalf of the Contractor; or (e) any event or circumstance of a nature analogous to any of the foregoing.
Political EventsChange in Law, other than any Change in Law for which relief is provided under this Agreement;
Political Events. A Political Event shall mean one or more of the following acts or events by or on account of any Government Instrumentality: a. an act of war (whether declared or undeclared), invasion, armed conflict or act of foreign enemy, blockade, embargo, riot, insurrection, terrorist or military action, civil commotion or politically motivated sabotage; b. industry-wide strikes for a continuous period of 48 (forty eight) hours and exceeding an aggregate period of 14 (fourteen) days in an Accounting Year; c. any Political Event that causes a Non-Political Event; d. change in Law, only if consequences thereof cannot be dealt with under and in accordance with the provisions of Article 25; e. compulsory acquisition in national interest or expropriation of the Project or rights of the Operator; f. unlawful or unauthorized or without jurisdiction revocation of or refusal to renew or grant without valid cause, any clearance, license, permit, authorization, no objection certificate, consent, approval or exemption required by Operator to perform their respective obligations under this Contract; provided that such delay, modification, denial, refusal or revocation did not result from Operator’s inability or failure to comply with any condition relating to grant, maintenance or renewal of such clearance, license, authorization, no objection certificate, exemption, consent, approval or permit; g. any event or circumstance of a nature analogous to any of the foregoing.

Political Events. Any of the following events which prevent the Affected Party from performing any of its obligations for a continuous period of not less than 7 (seven) Days from the date of its occurrence, shall constitute a Non-Political Event:

Political Events. (i) A Change in Law to which the provisions of Article 19.15 cannot be applied; (ii) Expropriation or compulsory acquisition by any Competent Authority of the Project or part thereof or rights of the Developer relating thereto; provided the same has not resulted from an act or default of the Developer or any Person claiming through or under it. (iii) Any unlawful or unauthorized or without jurisdiction revocation of, or refusal to renew or grant without valid cause any Clearance required by the Developer or any of the Subcontractors to perform their respective obligations hereunder (other than a consent the obtaining of which is condition precedent) provided that such delay, modification, denial, refusal or revocation did not result from the Developer’s or any Subcontractor’s (1) inability or failure to comply with any condition relating to grant, maintenance or renewal of such consents or permits; or (2) breach or failure in complying with the provisions hereof, including the Developmental Standards, the Applicable Laws, the terms of Clearances, any judgement or order or Directive of any Competent Authority or of any contract to which the Developer or such Subcontractor, as the case may be, is bound.

Political Events i. Change in Law, other than any Change in Law for which relief is provided under this Agreement; ii. expropriation or compulsory acquisition by MHRD or any of their nominated agencies of any material assets or rights of the Implementing Partner; iii. unlawful or unauthorised revocation of, or refusal by MHRD or any of their nominated agencies, GoI or any of its agencies to renew or grant any clearance or Required Consents required by the Bidder to perform its obligations without valid cause, provided that such delay, modification, denial, refusal or revocation did not result from the Bidder’s inability or failure to comply with any condition relating to grant, maintenance or renewal of such Required Consents applied on a non-discriminatory basis; iv. any judgment or order of any court of competent jurisdiction or statutory authority in India made against the Bidder in any proceedings for reasons other than failure of the Bidder to comply with Applicable Laws or Required Consents or on account of breach thereof, or of any contract, or enforcement of this Agreement or exercise of any of its rights under this Agreement; v. expropriation or compulsory acquisition by MHRD or any of their nominated agencies of any material assets or rights of the Bidder; vi. unlawful or unauthorized revocation of, or refusal by any authority other than MHRD or any of their nominated agencies to renew or grant any Required Consents required by the Bidder to perform its obligations without valid cause, provided that such delay, modification, denial, refusal or revocation did not result from the Bidder’s inability or failure to comply with any condition relating to grant, maintenance or renewal of such Required Consents applied on a non- discriminatory basis; vii. any requisition of the Project by any other authority; or viii. any requisition of the Project by MHRD or any of their nominated agencies. ix. For the avoidance of doubt, suspension of the Project in accordance with the provisions of this Agreement shall not be considered a requisition for the purposes of Force Majeure event.
