Positive Test. (1) First time. (a) The member shall be referred to the City’s Employee Assistance Program (EAP). (b) There shall be no discipline if the member successfully completes all EAP recommendations. (c) A member's failure to participate in or complete the counseling and rehabilitation program may be grounds for discipline. (d) A member may be disciplined for separate concurrent violation(s) of rules, directives, etc., notwithstanding the drug test results. (e) A member shall be subject to follow-up testing for a period of two (2) years after the member's completion of counseling, treatment and/or aftercare.
