Pregnant Employee Rights. (a) The Employer shall not terminate the employment of an employee because of her pregnancy. (b) The Employer may require an employee to commence a leave of absence without pay where the employee's position cannot be reasonably performed by a pregnant woman or the performance of the employee's work is materially affected by the pregnancy. Such action shall not be taken until the employee has been advised of the Employer’s concerns and provided the opportunity to provide medical evidence establishing her ability to work. (c) Should an employee become ill arising out of her pregnancy prior to the commencement of her pregnancy leave or during her pregnancy leave, she shall be granted sick leave pay in accordance with the provisions of Article 16.
