PRELIMINARY APPRO VAL. The plaintiff shall move the Court for an order preliminarily approving the settlement of the Action in accordance with the terms of this Settlement Agreement in the form of the Order Preliminarily Approving Class Action Settlement and Notice to the Class, attached hereto as Exhibit 4 (the “Preliminary Approval Order”), including the form of notice and the method of notice. Plaintiff may represent that the United States does not oppose the motion. Upon the preliminary approval of this Settlement Agreement by the Court, as evidenced by entry of the Preliminary Approval Order, all discovery and other proceedings in the Action shall be stayed until further order of the Court, except such proceedings as may be necessary either to implement the Settlement Agreement or to comply with or effectuate the terms of the Agreement.

  • Motion for Preliminary Approval The Parties agree to jointly prepare and file a motion for preliminary approval (“Motion for Preliminary Approval”) that complies with the Court’s current checklist for Preliminary Approvals.

  • Preliminary Schedule A preliminary schedule of construction indicating the starting and completion dates of the various stages of the Work, including any information and following any form as may be specified in the Specifications. Once approved by District, this shall become the Construction Schedule. This schedule shall include and identify all tasks that are on the Project’s critical path with a specific determination of the start and completion of each critical path task as well as all Contract milestones and each milestone’s completion date(s) as may be required by the District.

  • Preliminary 4. The business of the Company may be commenced at any time after incorporation.
