Prepayment review. In the event Contractor subjects a Network Provider to prepayment review or any review requiring the Provider to submit documentation to support a claim prior to the Contractor considering it for payment as a result of suspected Fraud, Waste, Abuse, mismanagement, or misconduct, Contractor shall adhere to the following within ninety (90) days of requiring such action: 5.35.9.1 Conduct a medical and coding review on the claims subject to prepayment review. When Fraud, Xxxxx, Abuse, mismanagement, or misconduct is still suspected after conducting the review, submit to the OIG a suspected Fraud referral, including all referral components as required by the OIG. 5.35.9.2 A prepayment review shall not be conducted for a Provider listed as under investigation or litigation involving the federal or state government or other circumstances as deemed appropriate by the OIG.

Prepayment review. If the Contractor subjects a provider to prepayment review or any review requiring the provider to submit documentation to support a claim prior to the Contractor considering it for payment, as a result of suspected Fraud, Waste and/or Abuse, the Contractor must obtain written consent from MDHHS- OIG prior to placing any providers on prepayment review. To obtain consent, the Contractor must submit its request to place a provider on prepayment review via the MDHHS-OIG sFTP. Requests must be made using MDHHS-OIGs Prepayment Review Request template and at a minimum include: i. Subject name, address, phone number, provider NPI and type, and any other identifying information; ii. Date the Contractor plans to place the subject on prepayment review; iii. The reason for the prepayment review (i.e., the risk(s) identified); iv. The data or information relied upon in placing the provider on prepayment review (i.e., how the risk was identified); v. The specific billing codes that will be subject to prepayment review; and vi. The documentation to be reviewed by the Contractor prior to approval of the selected claims and how that review will mitigate the risk(s) identified.
Prepayment review. The RAC shall identify Medicare overpayments and underpayments using the post payment claims review process. Any other source of identification of a Medicare overpayment or underpayment (such as prepayment review) is not included in the scope of this contract.

Provision for written policies for all employees of the Contactor, and of any contractor or agent, that provide detailed information about the False Claims Act and other Federal and State laws described in section 1902(a)(68) of the Act, including information about rights of employees to be protected as whistleblowers. Contractor must include in any employee handbook a description of the laws and the rights of employees to be protected as whistleblowers. 7. Provision for the prompt referral of any potential credible allegation of Fraud that the Contractor identifies to MDHHS-OIG. If the credible allegation of Fraud referral results in a suspension issued by MDHHS OIG, the Contractor must defend their credible allegation of Fraud conclusion in any appeal. The Contractor must have written documentation of internal controls and policies and procedures in place that are designed to prevent,detect and report known or suspected Fraud, Waste and Abuse activities. a. Contractor must refer all potential credible allegations of Contractor employee and provider Fraud with an identified overpayment of over $5,000 via MDHHS-OIG’s secure file transfer protocol (sFTP) using MDHHS-OIG’s standard Fraud referral template. All other credible allegations of fraud with an overpayment of less than $5,000 must be i. Contractor questions regarding whether suspicions should be classified as Fraud, Xxxxx and Abuse should be presented to MDHHS-OIG for clarification.

  • Prepayment Penalty Each Mortgage Loan that is subject to a Prepayment Penalty as provided in the related Mortgage Note is identified on the related Mortgage Loan Schedule. With respect to each Mortgage Loan that has a Prepayment Penalty feature, each such Prepayment Penalty is enforceable and will be enforced by the Seller during the period the Seller is acting as Interim Servicer for the benefit of the Purchaser, and each Prepayment Penalty is permitted pursuant to federal, state and local law. Each such Prepayment Penalty is in an amount not more than the maximum amount permitted under applicable law and no such Prepayment Penalty may be imposed for a term in excess of five (5) years with respect to Mortgage Loans originated prior to October, 1, 2002. With respect to Mortgage Loans originated on or after October 1, 2002, the duration of the Prepayment Penalty period shall not exceed three (3) years from the date of the Mortgage Note unless the Mortgage Loan was modified to reduce the Prepayment Penalty period to no more than three (3) years from the date of the related Mortgage Note and the Mortgagor was notified in writing of such reduction in Prepayment Penalty period. With respect to any Mortgage Loan that contains a provision permitting imposition of a premium upon a prepayment prior to maturity: (i) prior to the Mortgage Loan's origination, the Mortgagor agreed to such premium in exchange for a monetary benefit, including but not limited to a rate or fee reduction, (ii) prior to the Mortgage Loan's origination, the Mortgagor was offered the option of obtaining a mortgage loan that did not require payment of such a premium, and (iii) the Prepayment Penalty is disclosed to the Mortgagor in the mortgage loan documents pursuant to applicable state, local and federal law. This representation and warranty is a Deemed Material and Adverse Representation;

  • Final Repayment Date On the final Repayment Date, the Borrowers shall additionally pay to the Agent for the account of the Creditor Parties all other sums then accrued or owing under any Finance Document.

  • Prepayment (a) Provided no Event of Default has occurred and is continuing, Borrower may voluntarily prepay the Indebtedness in full and not in part (i) only on or prior to the day that is two (2) years after the Start-Up Day, and such prepayment shall be subject to payment of Prepayment Premium, and (ii) only on or after the date which is sixty (60) days prior to the Maturity Date and there shall be no Prepayment Premium or penalty assessed against Borrower by reason of such prepayment; provided, however, that Borrower shall give to Lender at least fifteen (15) days prior written notice of any such prepayment. (b) Subject to Section 8.40, at any time during the term of the Loan, if any Borrower is required by Lender under the provisions of any Mortgage to prepay the Loan or any portion thereof in the event of damage to or destruction of, or a Taking of any Individual Property, such Borrower shall pay any Insurance Proceeds or Condemnation proceeds in the following manner and order of priority (i) first, to prepay the Loan to the full extent of the Insurance Proceeds or the Condemnation Proceeds, as applicable, to the extent of the Allocated Loan Amount for the applicable Individual Property, and (ii) to the Borrowers. (c) All prepayments of the Indebtedness made pursuant to this Section shall be applied by Lender in accordance with the provisions of Section 2.7 hereof. (d) No Borrower shall be permitted at any time to prepay all or any part of the Loan except as expressly provided in this Section.
