Pressures at Delivery Points. All System Compressor Stations (a) shall be designed for a suction pressure of from one hundred (100) psig to one hundred forty (140) psig and (b) shall be designed for and shall be operated at a discharge pressure sufficient to effect delivery to the relevant Downstream Pipeline or Processing Plant.

It is understood by the Parties that Gatherer will use reasonable efforts to maintain pressure to allow delivery into the Upstream Delivery Points upstream of the Processing Plant. Gatherer shall not be liable for any delivery failures into any Downstream Pipelines caused by such Downstream Pipeline’s failure or refusal to accept Residue Gas or NGLs, as applicable, in each case except to the extent caused by Gatherer’s breach of its obligations under this Agreement, gross negligence or willful misconduct.
