Procedure for Grievance. 15.2.1 Except by mutual agreement, failure by the employer at any level to communicate a decision within the specified time limit shall permit the grievant to proceed to the next level. Except by mutual agreement, failure by the grievant, at any level, to appeal a grievance to the next level within the specified time will be deemed acceptance of the decision as rendered. 15.2.2 Indicated time allotments for specific steps in the time limits may be extended by mutual agreement of both parties. 15.2.3 The grievant is encouraged to attend all stages of the grievance process, but must attend the Informal Stage and Level I Stage unless by mutual agreement the grievant is excused. At all other stages, the grievant must indicate in writing the desire to be excused from the process. 15.2.4 Upon mutual consent, timelines will be accelerated for a grievance filed preceding long vacation periods, such as summer, so that the grievance may be adjudicated without undue delay. 15.2.5 All documents, communications and records dealing with the processing of a grievance will be filed in a separate grievance file and will not be kept in the personnel file of any participant. 15.2.6 A bargaining unit member may be represented by the Association at any level of the grievance proceeding. 15.2.7 When Level I, II, or III hearings are scheduled by management during the work day, the grievant, one representative and necessary witnesses will receive time off without loss of compensation for the purpose of processing the grievance. Both the grievant and the representative will be allowed up to four (4) hours of release time during the work day for the purpose of obtaining information about a filed grievance for Levels I and II, and up to eight (8) hours of release time for Level III, providing the release time does not occur during the instructional day. 15.2.8 The Association president or authorized designee may file a grievance where provisions of the contract are being violated. The president shall follow the informal stage before submission of the grievance at Level II. 15.2.9 All decisions rendered at Levels I and II of the grievance procedure will be in writing setting forth the decision and the reasons and will be transmitted promptly by the District to parties directly concerned and to the Association. Time limits for appeal provided the grievant in each level shall begin the day following receipt of a written decision. 15.2.10 In a case where an aggrieved bargaining unit member has no assigned immediate supervisor, the grievance will commence at Level II. 15.2.11 Forms necessary for processing and filing grievances will be developed in joint consultation by management and the exclusive representative.

Xxxxx 0 If the grievance has not been satisfactorily resolved at the second Level, the GESSA employee may file a grievance with the Assistant Superintendent for Human Resources.
