Project Based Work shall continue for the period stated in the applicable Proposal. For the avoidance of doubt, should you wish to terminate the Project Based Work before completion, Unmatched shall not have any obligation to repay any charges paid by you.
Project Based Work. (a) This clause applies to the extent that Customer requests project based work including new hardware installation, data migrations and company relocations in the Order (Project Based Work). (b) Where specified in the Order, Supplier will provide the Project Based Work to Customer. (c) Project Based Work will be charged on either a time and materials basis in accordance with Schedule 3Rate Card or on a fixed fee basis, as advised by Supplier to Customer.
Project Based Work. 4.2.1 The Client agrees to pay the Service Provider a project fee of [Project Quote]. The Service Provider’s obligation to render the Services mentioned in Section 2 of this Agreement is conditional upon payment by the Client in the following terms (the ‘Project Based Schedule’): 4.2.1.1 50% down payment upon signing this agreement (the ‘Down Payment’). 4.2.1.2 The remaining 50% is to be paid upon completion of website before final delivery is made to The Client 4.2.1.3 The completion of the project is described hereunder: • Completion condition 1 • Completion condition 2 4.2.2 If during any time of the project duration the Client fails to make payment in terms of the Project Based Schedule, the Service Provider may cease provision of the Services until payment of the outstanding fee has been made. If a portion of such outstanding fee remains unpaid for more than 14 days after becoming due, a penalty of 15% of the outstanding amount will become due and payable. The Service Provider is not obligated to provide Services to the Client if there are any outstanding fees or penalties remaining due and payable.

  • Additional Work If changes in the work seem merited by Consultant or the City, and informal consultations with the other party indicate that a change is warranted, it shall be processed in the following manner: a letter outlining the changes shall be forwarded to the City by Consultant with a statement of estimated changes in fee or time schedule. An amendment to this Agreement shall be prepared by the City and executed by both Parties before performance of such services, or the City will not be required to pay for the changes in the scope of work. Such amendment shall not render ineffective or invalidate unaffected portions of this Agreement.

  • Project/Milestones Taxpayer provides refrigerated warehousing and logistic distribution services to clients throughout the United States. In consideration for the Credit, Taxpayer agrees to invest in a new refrigeration and distribution facility in the XxXxxxxxx Park area of Sacramento, California, and hire full-time employees (collectively, the “Project”). Further, Taxpayer agrees to satisfy the milestones as described in Exhibit A (“Milestones”) and must maintain Milestones for a minimum of three (3) taxable years thereafter. In the event Taxpayer employs more than the number of full-time employees, determined on an annual full-time equivalent basis, than required in Exhibit A, for purposes of satisfying the “Minimum Annual Salary of California Full-time Employees Hired” and the “Cumulative Average Annual Salary of California Full-time Employees Hired,” Taxpayer may use the salaries of any of the full-time employees hired within the required time period. For purposes of calculating the “Minimum Annual Salary of California Full-time Employees Hired” and the “Cumulative Average Annual Salary of California Full-time Employees Hired,” the salary of any full-time employee that is not employed by Taxpayer for the entire taxable year shall be annualized. In addition, the salary of any full-time employee hired to fill a vacated position in which a full-time employee was employed during Taxpayer’s Base Year shall be disregarded.

  • Project Schedule Construction must begin within 30 days of the date set forth in Appendix A, Page 2, for the start of construction, or this Agreement may become null and void, at the sole discretion of the Director. However, the Recipient may apply to the Director in writing for an extension of the date to initiate construction. The Recipient shall specify the reasons for the delay in the start of construction and provide the Director with a new start of construction date. The Director will review such requests for extensions and may extend the start date, providing that the Project can be completed within a reasonable time frame.

  • THE WORK The Work comprises the completed construction required by the Contract Documents and includes all labor necessary to produce such construction, and all materials and equipment incorporated or to be incorporated in such construction.

  • Project Goals The schedule, budget, physical, technical and other objectives for the Project shall be defined.

  • Modified Work Where the Hospital and the Union agree, the Hospital may implement modified/rehabilitative work programs in order to assist employees returning to work following illness or injury. To facilitate these programs, it is understood and agreed that provisions of the collective agreement may, where agreed, be varied. The specific terms of the program will be signed by the Hospital and the Union.
