Common use of Promotion or Transfer Clause in Contracts

Promotion or Transfer. (a) Any employee in the bargaining unit who is granted a promotion or transfer by the Employer to a position within the bargaining unit shall be on a trial period for thirty (30) calendar days. During this trial period, the employee must demonstrate that he/she can satisfy the requirements of the work performance criteria for the job, to the satisfaction of the Employer. (b) Should the employee be unable to satisfy the requirements of the work performance criteria in the trial period, or should the employee decide during the trial period that he/she does not want to continue in the job, then the employee shall be returned to his/her former position. In such circumstances, the Employer shall have the right to require all employees who changed positions in consequence of the promotion or transfer, to move back into their positions and wage rates which they occupied prior to the promotion or transfer. (c) Any employee in the bargaining unit who applies for, and is awarded, a position with the Employer outside the bargaining unit shall be on a trial period for thirty-five (35) calendar days. During this trial period, the employee of the Employer, at either’s sole discretion, may decide to have the employee return to his/her former position within the bargaining unit. In such circumstances, the Employer shall have the right to require all the employees who changed positions within the bargaining unit, in consequence of the movement of the employee to a position outside of the bargaining unit, to move back into their positions and wage rates which they had previously occupied.
