Proving Period. Contract Instructors who transfer to a new MDS shall have a thirteen (13) workweek trial period to demonstrate satisfactory performance in the new assignment. The Company, in its sole discretion, may transfer the employee back to the position last held by the employee if the Company determines the employee is not performing satisfactorily in the new assignment. Upon transferring back to the prior assignment, the employee will receive the applicable rate of pay for that crew position and will maintain his MDS certification date for his prior assignment. If a surplus is created by this action, layoff provisions of Section 6.2 and 6.4 shall apply.

  • Funding Period The Funding Period, if any, shall not have terminated.

  • Tolling Period If it becomes necessary or desirable for the Corporation to seek compliance with the provisions of Section 14.2 by legal proceedings, the period during which Grantee shall comply with said provisions will extend for a period of twelve (12) months from the date the Corporation institutes legal proceedings for injunctive or other relief.

  • Billing Period The calendar month shall be the standard period for all charges and payments under this Agreement. On or before the fifteenth (15th) day following the end of each month, Seller shall render to Buyer an invoice for the payment obligations incurred hereunder during the preceding month, based on the Energy Delivered in the preceding month, and any RECs deposited in Buyer’s GIS account or a GIS account designated by Buyer to Seller in writing in the preceding month.
