Common use of Public Holiday Night Duty Clause in Contracts

Public Holiday Night Duty. (a) An Employee, whether full time or part time, who is rostered to work on the night shift ending on the Public Holiday will receive the Public Holiday penalty rates for the entire shift. (b) Employees rostered to work on the night shift commencing on the Public Holiday will not receive the Public Holiday penalty rates for the entire shift. (c) An Employee not rostered to work on the night shift ending on the Public Holiday will receive the applicable rostered off benefit.

Public Holiday Night Duty. 69.10.1 An employee who works on a night shift which begins or ends on a Public Holiday will receive: (a) An Employeethe Public Holiday penalty rate, whether full for the time or part time, who is rostered to work on the night shift ending worked on the Public Holiday will receive (with a minimum of 4 hours at the Public Holiday penalty rates for the entire shift.public holiday rate in respect of that public holiday); and (b) Employees rostered to work the rate which would ordinarily apply, for time worked other than on the night shift commencing on the Public Holiday will not receive the Public Holiday penalty rates for the entire shiftpublic holiday. (c) An Employee not rostered to work on the night shift ending on the Public Holiday will receive the applicable rostered off benefit.
