Purpose of Lease. This lease is for the benefit of both parties. Nonetheless, the terms of the Lease are material to the Landlord’s ability to provide space to those businesses that Landlord determines in its sole discretion are capable of developing or growing into successful enterprises which will not need the lower-than-market benefits and other services offered by the Landlord and not traditionally found in other leasehold arrangements (with the possible exception of other business incubator leases). As a result, the Landlord will continue to possess, during and after the termination of this Lease, without threat of liability, claim or legal action of any sort, all the rights retained by it and set forth herein which include but are not limited to the right to review all business and financial records of the Tenant, and to right to terminate the Lease at any time. The Tenant accepts such conditions, although they may prove onerous to its operations. Tenant hereby waives any and all rights that it may have or assert to have to make any claim or file any legal action against the Landlord, its directors, agents, officers or other representatives for any decision made or which it fails to make regarding the financial promise of the Tenant’s business, its ability to be financially successful, or its rights to terminate the Lease. This exemption from liability extends to any advice received by the Tenant from the Landlord or from third party consultants provided by the Tenant.
Purpose of Lease. The Lessee has a need to lease space in Helena, Montana for office purposes. The Lessor has space available for lease in Helena, Montana, suitable for the stated purpose.
Purpose of Lease. The grant of lease by the Lessor to the lessee in respect of the Schedule property is for the purpose of developing a Power Plant under MNRE Scheme notified on 8th March 2019.
Purpose of Lease. The Tenant undertakes that during the entire period of the lease, the apartment (and any part of it) shall be used solely for residential purposes.
Purpose of Lease. 2.1 Party B promises to Party A that the Property will be leased for office use in compliance with applicable national and municipal provisions on property use and property management.
2.2 Party B guarantees that within the term of the lease, without prior written consent from Party A or prior approval from the competent authority, the aforesaid agreed upon purpose of use will not be changed.
Purpose of Lease. 1. Pursuant to M.G.L. c.30B, the Town solicited proposals for the construction, operation, and maintenance of an ice skating rink. The Town hereby leases to the Lessee the Leased Premises described in Article III below for the purposes of providing for the professional services necessary to construct and for the day-to-day management and operation, in the best interests of the Town of Belmont, of the ice skating rink, and appurtenant facilities, (together, the “Facility”) located in Belmont, MA. Said Facility shall not be used for any other purpose by the Lessee or its employees, agents and representatives without the prior written approval of the Town.
2. It is the intent of the parties hereto that the management and operation of the Facility shall be self-supporting and that all expenses incurred in the course of such operation shall be paid from the revenues derived from the fees charged for programs, goods and services provided by the Lessee. In consideration of the Lessee providing the management and operation services as described in this Lease, any and all surplus revenue remaining after all expenses associated with the operation of the Facility have been paid, and after payments required by this Lease have been made, shall become the property of the Lessee as a management fee. Additionally, any deficit in revenue to operational expenses shall be Xxxxxx’s sole financial responsibility. Notwithstanding any other provisions of this Lease, the Town shall have no obligation to pay any such expenses.
3. The Lessee shall exercise due care and diligence in performing under this Lease in accordance with the applicable professional standards in the eastern Massachusetts area.
Purpose of Lease. 7.1. The Lessee declares and undertakes that it leases the Leased Premises for the purpose as stated and as defined in Appendix F of this Agreement and solely for that purpose.
7.2. The Lessee undertakes to use the Leased Premises solely in accordance with the Purpose of Lease without any violation of or deviation from the Purpose of Lease. Any modification or expansion of the Purpose of Lease are subject to the prior and written approval of the Lessor and the Lessor shall be entitled to reject any modification or expansion as aforesaid for reasonable reasons.
7.3. Without derogating from the generality of the aforesaid, the Lessee confirms that it is aware that the operation of the Leased Premises in deviation from or in violation of the Purpose of Lease might cause breach of other lease agreements made between the Lessor and other lessees in the Building, except for constituting a fundamental breach of this Agreement, and therefore the Lessor shall be entitled, without derogating from its right to seek any other relief or remedy, in any event of use in deviation from or in violation of the Purpose of Lease, to obtain an injunction against such operation of the Leased Premises as aforesaid.
7.4. The Lessee declares that it was not granted and did not receive any promise regarding exclusivity and/or exclusive use of the Leased Premises and the [Signature and Stamp: Ogen Yielding Real Estate Ltd and Polypid Ltd.] [Signed] business conducted therein, if any, and the Lessor might lease units in the Project for the purpose of conducting similar, corresponding and even identical businesses to its business and the Lessee waives any claim and/or suit in connection therewith.
Purpose of Lease. The Purpose of Lease is offices and laboratory only.
Purpose of Lease. A. Execution of this lease provides the lessee temporary hangar space with the term as a condition of the executed lease. The temporary use of hangar space is restricted to the conditions stated within the provision of the lease agreement. Execution by both parties is an agreement to these terms and conditions. Lessor contracts management and maintenance of the hangars, inspection authority, and hangar waiting list to SkyVista Aviation.
Purpose of Lease. The Lessee has a need to lease space in Livingston, Montana for the specific purpose of conducting Lessee’s business. The Lessor has space available for lease which is suitable for the stated purpose.
