Hour Minimum. An employee who is called back in situations not covered by Paragraph 2 of this Section for any overtime work required of an employee on a day when no work was scheduled for the employee, or for which the employee is required to return to the place of employment, and where less than twelve (12) hours’ notice has been provided to the employee shall be considered to be at least two (2) hours in duration. Any Fire Prevention Inspector I, II, or III or Assistant Fire Marshal who is called back in situations not covered in Paragraph 2 for any overtime work required of an employee on a day when no work was scheduled for the employee, or for which the employee is required to return to the place of employment, including while on standby pay, shall be considered to be at least two (2) hours in duration regardless of the time notification.

When personnel are needed to assist another Division and the overall overtime rotation list is exhausted, the least senior employee/employees shall be required to work said overtime.

When an employee, because of failure of the Company to inform him by notice or otherwise that no work will be available, reports for work on schedule, in good faith, and is advised there is no work available he shall receive four (4) hours' pay at what would have been his applicable hourly rate but such four (4) hours shall not be considered time worked for the purpose of applying the overtime provisions of this Article. Hour Minimum. Any employee reporting for work at the regular starting time, after being hired or after being referred to the Employer from the Hiring Hall, and for whom no work is provided, shall receive pay for four (4) hours at the regular rate of wages, unless he/ she has been notified not to report. Any employee who reports to work and for whom work is provided shall receive not less than four (4) hours pay, and if he/she works more than four (4) hours in any one (1) day shall receive not less than a full day’s pay. In the event any employee is called to work on weekdays after the regular shift, Saturdays, Sundays or Holidays, he/she shall receive four (4) hours pay at the applicable overtime rate as a minimum and, if he/she is required to work in excess of four (4) hours shall receive not less than a full day’s pay at the applicable overtime rate. In each instance the pay shall include overtime rate on the taxable fringe benefit contributions including defined contributions.

Every employee in a position for which step rate increases in compensation are provided may be considered for an increase in compensation to the next higher step rate within his compensation grade following one (1) year at the minimum and one (1) year at each intermediate step rate, reaching the maximum rate not earlier than the third year. All step increases shall be upon the written recommendation of DPW Director and with the approval of the Town Administrator. Less than full time employees shall be considered for step rate increases every two (2) years between steps; exceptions to the foregoing may be granted at the sole discretion of the Town Administrator.
