Recurring Debit Card Transactions. A recurring debit-card transaction occurs when you provide a merchant with your debit-card information, and it sets up a regularly or semi-regularly scheduled payment. The Credit Union is entitled to and will rely on how the merchant codes the particular debit-card transaction as “recurring” or “non-recurring.” If a recurring debit-card transaction is submitted to us and would be drawn against an insufficient available balance, we may decline it with no fee assessed or pay it. The amount of the negative balance does not determine whether or not a fee will be charged. Instead it is the amount of the transaction itself. If we pay the transaction and if the transaction is $20 or greater then a fee may be charged, regardless of how much that transaction takes the share negative. We may assess you a WeGotYa/ Courtesy Pay fee. For us to pay overdrafts for recurring debit card transactions, you must affirmatively opt-in by executing Xxxxxxxx’s WeGotYa/Courtesy Pay Services Opt-In/Opt-Out Form. • One-Time Debit Card Transactions. For us to pay overdrafts for non-recurring, or one-time, debit card transactions, you must affirmatively opt-in by executing Xxxxxxxx’s Opt-In Disclosure. If you do not opt in and a merchant asks us to authorize a transaction that would exceed your available balance, the Credit Union will decline the transaction at the point-of-sale, and it will not assess you a fee. If you opt in and a merchant asks us to authorize a transaction that would exceed your available balance, the Credit Union may pay the transaction, and, if it does so, you will be assessed an overdraft fee. The amount of the negative balance does not determine whether or not a fee will be charged. Instead it is the amount of the transaction itself. If the transaction is $20 or greater then a fee may be charged, regardless of how much that transaction takes the share negative (this may occur up to two (2) days after authorization). If your debit-card transaction is authorized with a sufficient available balance to cover the transaction, you will not be assessed a fee even if your actual balance is insufficient to cover the transaction at the time it is presented to us for payment.

  • Agency Cross Transactions From time to time, the Advisor or brokers or dealers affiliated with it may find themselves in a position to buy for certain of their brokerage clients (each an "Account") securities which the Advisor's investment advisory clients wish to sell, and to sell for certain of their brokerage clients securities which advisory clients wish to buy. Where one of the parties is an advisory client, the Advisor or the affiliated broker or dealer cannot participate in this type of transaction (known as a cross transaction) on behalf of an advisory client and retain commissions from one or both parties to the transaction without the advisory client's consent. This is because in a situation where the Advisor is making the investment decision (as opposed to a brokerage client who makes his own investment decisions), and the Advisor or an affiliate is receiving commissions from both sides of the transaction, there is a potential conflicting division of loyalties and responsibilities on the Advisor's part regarding the advisory client. The Securities and Exchange Commission has adopted a rule under the Investment Advisers Act of 1940, as amended, which permits the Advisor or its affiliates to participate on behalf of an Account in agency cross transactions if the advisory client has given written consent in advance. By execution of this Agreement, the Trust authorizes the Advisor or its affiliates to participate in agency cross transactions involving an Account. The Trust may revoke its consent at any time by written notice to the Advisor.

  • Fund Transactions The Advisor is authorized to select the brokers or dealers that will execute the purchases and sales of portfolio securities for the Fund. The Advisor will promptly communicate to the officers and the trustees of the Trust such information relating to portfolio transactions as they may reasonably request.
