REDUCTION IN STAFF. SENIORITYA. No new teachers shall be hired in subject areas before teachers who are laid off from other subject areas who may be highly qualified and meet effectiveness ratings established in the administrative guidelines, are recalled or decline the opening. The following language will be recommended to the Board by both parties to be adopted as an administrative Policy:
1. Temporary personnel
2. Probationary teachers according to seniority and non-degree tiebreaker number and certification
3. Tenure teachers according to seniority and certification. The Board of Education shall decide the number of teachers to be laid off. The layoff will only occur through a complete year or seniority break on the teacher seniority list. In special layoff situations due to a discontinuation of a particular program offering, or to allow for maximum reemployment whereby certification is limited to an individual teacher only, that teacher may be laid off firstindividually to avoid a major disruption to the overall education program. D. In the event of a decision by the Board of Education to close a school or schools, the following procedure shall be utilized:
1. By May 10, the teachers in the buildings to be closed will displace the least senior teachers in the school district according to seniority and certification by building and/or department in the master schedule for the following school year. The teachers from the closed buildings will select their new assignments with the most senior teacher making the first selection. On those occasions when there is such a reduction in the total number of permanent positions, the following procedures will be used:
1A. Staff reductions will first be accomplished through attrition of staff.
B. Teachers who are not on a continuing contract with the District will be terminated prior to teachers who are on a continuing contract with the District. If more than one teacher is to be laid off in a designated area, the District shall first compare in ascending order of seniority, the least senior teacher with the more senior teachers. Once a determination is made with respect to that teacher, the next most junior teacher shall be compared to the remaining more senior teachers in ascending order of seniority. This process shall continue until all teachers who are to be laid off are determined. In instances where a more senior teacher is significantly less qualified solely because of the teacher's experience and training related to the remaining available positions in the designated area, the District shall make a good faith effort to reassign teachers in said designated area being reduced in accordance with the teacher's qualifications so that the senior teachers may be retained. In reassigning teachers in order to insure, as much as possible, that a junior teacher(s) does not displace a senior teacher(s) the District shall reassign teachers in such a manner that if it is necessary for the junior teacher(s) to displace a senior teacher(s), as much as possible, the more senior teacher(s) is retained. If after such reassignments the junior teacher(s) is still significantly more qualified than a senior teacher, the senior teacher may be laid off first. In special layoff situations due to a discontinuation of a particular program offering, or to allow for maximum reemployment whereby certification is limited to an individual teacher only, that teacher may be laid off firstindividually to avoid a major disruption to the overall education program. This is provided that qualified tenure teachers Prior to the slotting meeting, the Board will provide the Association with a list of positions for the coming year. Teachers who are available.

D. In the event of a decision by the Board of Education to close a school or schools, the following procedure shall be utilized:
1. By May 10, the teachers in the buildings to be closed will displace the least senior teachers in the school district according to seniority and certification by building and/or department in the master schedule for the following school year. The teachers from the closed buildings will select their new assignments with the most senior teacher making the first selection. This procedure must be implemented prior to the beginning of the slotting procedure.
2. If these teachers cannot displace any other teachers according to #1 above, then they are to be considered displaced and will be assigned according to the approved slotting procedure.
E. In the event of a decision by the Board of Education to consolidate two schools into one school or to consolidate programs, the following procedure shall be utilized:
1. By May 10, the teachers in the buildings to be consolidated will select their assignments from the consolidated building’s master schedule with the most senior teacher making the first selection. This procedure must be implemented prior to the beginning of the slotting procedure.
2. If these teachers cannot make a selection according to #1 above, then they are to be considered displaced and will be assigned according to the approved slotting procedure.
3. During any period when By March 1 the number teachers in the programs to be consolidated will select their assignments from the consolidated program schedule with the most senior teacher, including tie breaker number, making the first selection. In the event a teacher is properly certified in a teaching field, and has fifteen (15) or more hours in that field but lacks the necessary requirements #3 above then they are to be highly qualified, they shall have one considered part of their assigned (1current) year to complete the necessary requirements, if approved by the State of Michigan
1) Seniority is defined as length of unbroken service within the bargaining unit building staff and shall be computed from the bargaining unit member’s initial date of hire. Seniority date shall be determined by the date said teacher contract was signed, given approval by the Board of Education. If necessary, ties in seniority will be broken by drawing lots with the Association President present.
2) A seniority list shall be published by the District by October 15 of each school year. A copy of the seniority list and subsequent revisions and updates, if made, shall be forwarded to the Association and the building representatives.
3) Time spent on unpaid leave, for one semester or more, shall not be construed as a break in continuous service. However, the time spent placed on that leave would be deducted from the initial date of hire on the seniority list. Seniority will be lost if on unpaid leave or layoff for three years, unless mutually extended in writing by the District and the Associationmaster schedule according to their certification.
4) No person other than a member of the bargaining unit shall possess, retain or accrue seniority within the bargaining unit.
5) Members who transfer to a non-bargaining unit position shall retain only that seniority accrued while members of the bargaining unit.
6) Involuntarily reduced assignments shall count as if the service were at the full teaching load and will count as full-time seniority. Voluntary reduced assignments shall count only for the time spent on the job and shall receive the pro rata amount toward their seniority.

7. If such teacher reductions are necessary, the Association shall be asked for recommendations using the aforementioned criteria (No. 6).
8. If any such teachers desire to be reemployed when future vacancies occur, they shall keep the Board advised of his/her current address and telephone number.
9. Procedure for recall shall be as follows:
a. Seniority tenure teachers will be recalled in inverse order of layoff for positions for which they are certified and qualified as determined by number six (6).
10. It is understood and agreed that provisions hereof with respect to staff reduction shall in no way be construed as a waiver of rights otherwise available under the Tenure Act without specifications or agreement as to what such rights may be.
11. Any teacher recalled to work from layoff shall be entitled to at least two (2) weeks written notice delivered to his/her last known address prior to being required to report to work. REDUCTION IN STAFF. SENIORITYA. The Committee retains the right to determine the number of teaching positions and other professional positions which are needed in the school system. It also retains the right to determine the employees to be laid off in accordance with the procedures and standards set forth below:

REDUCTION IN STAFF. SENIORITYIt is within the sole discretion of the Board of Education to reduce the education program, curriculum and staff. In order to promote an orderly reduction of teaching personnel the following procedures shall be followed:

1. Probationary Before any teachers are laid off, an attempt will be made to meet any reduction in the number of teaching positions or other professional positions through normal attrition.
2. A teacher with professional status shall not be laid off if there is a teacher not on professional status whose position the teacher on professional status is qualified to fill.
3. In determining the order in which professional status teachers or school nurses shall be laid off, the Committee shall consider only the following factors in laying off teachers within a discipline: the teachers’ job performance as evidenced by the member’s past two (2) summative overall evaluation ratings as compared to other teachers’ past two (2) summative overall evaluation ratings in the discipline targeted to be reduced with evaluations with ratings of Proficient and non-degree Exemplary being considered equal and the best interests of the students as evidenced by the recommendation of the Superintendent, professional training, and experience within a discipline during the continuous years of service in the Xxxxxx Public Schools. In the event that two or more teachers will are, in the judgment of the Committee, deemed to be substantially equal on the basis of evaluation, the recommendation of the Superintendent, professional training, and experience within a discipline during the continuous years of service in the Xxxxxx Public Schools, the least senior of such teachers shall be laid off first. REDUCTION IN STAFF. SENIORITYA. In cases requiring a reduction of the teacher's work force due to a decrease in student enrollment, to allow for maximum reemployment, or because of insufficient funds, the order of reduction shall be:

(b) Teachers whom the Board advised Committee has designated to be laid off pursuant to the provisions of Section 15.2(a)(i) above shall be given notice of said designation on June 1st of the school year in which they are to be laid off.
(a) Seniority shall be defined as a person’s total length of continuous service measured in years and days from the date of last hire in the Dedham Public Schools. Continuous service during an entire school year shall be treated as one year regardless of the number of actual teacher days in that school year. Service during a portion of the school year shall be measured in teacher days provided that the accumulation of one hundred (180) teacher days shall be counted as one year for purposes of this article. Said continuous service shall include time spent on paid leaves of absence, but shall not include time spent on unpaid leaves of absence. However, unpaid leaves of absence shall not be deemed to break seniority from date of last hire. A teacher employed on a regular part-time basis shall receive seniority credit during any period of part-time employment pro-rated according to the teacher’s regular schedule. For example, a teacher regularly employed for one (1) continuous year on a one-half (1/2) time basis, shall receive one-half (1/2) year’s seniority.
(b) Termination shall not be deemed a break in seniority. A teacher returning from a layoff shall be credited with all of her/his previously accumulated seniority. For the purpose of layoff in the event that employees have equal seniority, as herein before defined, the teacher has attained the highest level of education recognized on the salary schedule shall be considered senior. When determining seniority in accord with the highest level of education recognized on the salary schedule, the date used will be February 1 following timely posting of the seniority list. Further ties, if any, shall be resolved by lot before March 1 of each year and the seniority list amended accordingly as of such date and posted by April 1. The drawing of lots will establish the seniority of previously tied parties hereafter unless one party’s seniority changes because of a change in educational attainment, as described above. If after such change in educational attainment, teachers again become tied, such further ties shall be resolved by lot in the same manner.
15.4 Each year the Committee shall publish a seniority list setting forth the seniority of all employees as of October 1 of such year. REDUCTION IN STAFF. SENIORITYA. In the event it becomes necessary to reduce the number of Paraeducators or Administrative Assistants presently in the employ of this District, the Committee agrees that it will adhere to such procedures as may be required by law. Any employee who is terminated under this Article may leave a written notice that he or she desires to return to Hampshire Regional for employment in the event future vacancies in comparable positions develop, and such notice will contain the address, phone number, and email address where such Paraeducator may be contacted. The Committee agrees to contact such persons for possible re-employment if vacancies develop. Failure of the employee to respond to the notifications as to his or her intentions within twenty-one (21) days from the date of notification will raise a conclusive presumption that the employee no longer desires to return to the Hampshire Regional District. If no such vacancy arises within twelve (12) months of the date of the employee’s termination, then no further right to recall will exist.
C. Seniority for each category of employee as defined in Article I, Sections B (1 and 2) of this agreement, shall be determined according to the following criteria:
1. Probationary and non-degree teachers will The initial employment date for an employee whose paid employment began not less than one
(1) nor more than three (3) days prior to the first day of classes shall be laid off first. This is provided recorded as September 1st of that qualified tenure teachers are availableyear.
2. No teacher The initial employment date for an employee whose employment began at any other time shall be discharged or laid off pursuant to a necessary reduction in personnel unless he/she has written notification of said actionthe date upon which paid employment actually began.
3. During any period when the number of the teaching staff is reducedIn cases where two or more individuals are equally senior, the Board order of seniority for such individuals shall be determined by first using the dates upon which the school committee voted their respective employment. If voted upon collectively, preference will not hire a new teacher be given to replace an incumbent teacher the employee who is qualified and available to fill an available teaching positionhas achieved the highest level of training.
4. The Board Seniority is defined as an employee’s length of service from the most recent date of employment. Employment will use its efforts to assist all released teachers to secure employment in other school districtsbe defined as the first day for which compensation was received. Part-time employees will have their seniority prorated on the time actually worked.
5. The Board shall provide notice of layoff to the Association and the individuals involved no later than the third (3rd) Friday in May for the subsequent school year. The Board shall give not less than sixty (60) days’ notice of layoff to the Association and the individuals involved for the current school year.
6. If it becomes necessary to lay off tenure teachers, the following factors Employees shall be used:
a. If the teacher is fully certified by the State of Michigan and has a major or minor in the teaching field (based upon total semester hours earned), credited for seniority in the Rockford Schools shall prevail.
b. In the event a teacher is properly certified in a teaching field, and has fifteen (15) or more hours in that field but lacks the necessary requirements to be highly qualified, they shall have one (1) year to complete the necessary requirements, if approved by the State of Michigan
1) Seniority is defined as length of unbroken service within the bargaining unit and shall be computed from the bargaining unit member’s initial date of hire. Seniority date shall be determined by the date said teacher contract was signed, given approval by the Board of Education. If necessary, ties in seniority will be broken by drawing lots purposes with the Association President present.
2) A seniority list shall be published by the District by October 15 of each school year. A copy of the seniority list and subsequent revisions and updates, if made, shall be forwarded to the Association and the building representatives.
3) Time spent on unpaid leave, for one semester or more, shall not be construed as a break in continuous service. However, the all time spent on that any leave would be deducted from the initial date of hire on absence provided for in this Agreement and while eligible for recall under Section B of this Article.
D. A list specifying the seniority list. Seniority will be lost if on unpaid leave or layoff for three years, unless mutually extended in writing by the District and the Association.
4) No person other than a of each member of the bargaining unit shall possess, retain or accrue be prepared by the Superintendent and forwarded to the Association President within thirty (30) days following execution of this Agreement. An updated seniority within list shall be supplied by the bargaining unitSuperintendent by October 15 of each year thereafter.
5) Members who transfer to a non-bargaining unit position shall retain only that seniority accrued while members of the bargaining unit.
6) Involuntarily reduced assignments shall count as if the service were at the full teaching load and will count as full-time seniority. Voluntary reduced assignments shall count only for the time spent on the job and shall receive the pro rata amount toward their seniority.
d. Approved leaves do not break or extend seniority.
e. In the event two (2) or more tenure teachers have the identical qualifications and certifications, the following factors shall weigh equally in the final determination:
1. Highest degree held;If an employee or the Association does not file a grievance within (30) days after an updated seniority list is verified by the Association President, all grievances regarding the seniority of said list shall be waived. The Association President will have twenty-five (25) days to verify such seniority list.
2. Seniority Notwithstanding the above, errors in department the list which are the result of omissions, miscalculations, or teaching field;
3typing may be corrected during the month of March of each year provided the party initiating the correction notifies the other party in writing. Teaching competence;
4. Number of years since teaching in his/her field.
7. If such teacher reductions are necessary, the Association shall be asked for recommendations using the aforementioned criteria (No. 6).
8. If any such teachers desire to be reemployed when future vacancies occur, they shall keep the Board advised of his/her current address and telephone number.
9. Procedure for recall shall be as follows:

Any teacher recalled to work from layoff shall be entitled to at least two (2) weeks notice delivered to his/her last known address by certified mail, return receipt requested prior to being required to report to work. It is expressly understood and agreed are verified by both the Board and the Association that the beginning of the two (2) week requirement shall begin only after the teacher signs the return receiptparties.
12. The refusal of a current full-time properly certified and qualified tenure person of a part-time position shall not remove the individual from the recall list. This provision shall not invalidate any other section or article of this Agreement.

The refusal of a current full-time properly certified and qualified tenure person of a regular part-time position basis shall not remove receive seniority credit during any period of part-time employment pro-rated according to the individual from the recall listEducational Interventionist's regular schedule. 3. The Association will be given an opportunity to review the layoff list prior to notification to the individual teachers to be laid off. Notice will be mailed within seven (67) calendar days of Board action (not when minutes are approved).
104. It is understood and agreed that provisions hereof Any layoff pursuant to this Agreement shall automatically terminate the individual's employment contract. Insurance premiums will continue on a pro-rated basis consistent with respect the Master Contract. In no case will fringe benefits be continued for less than one month.
