REDUCTION OF STAFF. A. The term “seniority” in this Article shall mean length of service as a bus driver with the District.
B. In the event staff reduction becomes necessary, the District will release personnel in the inverse order of their length of service but may give consideration to special qualifications and experience, and minority employment. In the absence of such considerations and exemptions, layoff shall be based on seniority. The ATU shall be provided the opportunity to consult with the District when the necessity of such reductions is determined. Whenever possible, two (2) weeks written notice of layoff shall be given to each employee to be laid off under the provisions of this Article. Persons given such notice may not exercise the paid leave provisions of Article 15, except for sick leave when supported by a doctor’s statement, quarantine, mandatory court appearances or jury duty. This provision applies only to regular employees.
C. Reductions shall be by seniority within a classification; however, the District may assign employees from a higher classification to a lower classification within an employee group. The District shall not assign employees to a lower salary level without a corresponding change in job assignment or responsibility.
D. An employee who rejects an assignment of equal pay and classification shall, by doing so, forfeit all rights under this Article. An employee offered an assignment of lower classification and salary, due to staff reduction, may elect layoff and retain the recall rights provided by this Article.
E. An employee who is terminated due to such reduction in staff shall have preference in filling positions within their employee classification and shall be recalled by the District for employment in such classification based upon seniority with the District; provided, however, they are qualified for the assignment. Employees so terminated shall retain such right of recall for a period of three (3) years from the date of termination. Employees so recalled by the District shall be reinstated with seniority rights accumulated as of the date of their termination. Any employee recalled by the District for a position comparable to the one from which they were terminated and who rejects such an assignment shall relinquish all rights provided in this Article and Agreement.
F. By May 30, the District shall attempt to notify employees, whose work years correspond with the school year, of the intended employment status with the District for ...
REDUCTION OF STAFF. 37.01 When the Company proposes to terminate one or more employees as a result of a decision to reduce the number of Permanent Employees:
(a) The Company will notify the Association of its intent at least 30 Days prior to the date on which the intention will be announced to employees.
(b) The parties will meet as soon as possible after the notice is given and as often as required thereafter to discuss the Company's decision. In these meetings, the parties will discuss the reasons for and impacts of the termination and specifically (without restricting the generality of the foregoing):
(i) the proposed implementation dates of the terminations
(ii) the anticipated number, type and location of employees who will be affected
(iii) anticipated changes to the terms and working conditions of employees affected by the terminations and
(iv) the means by which the terminations and related changes will be communicated to employees.
(c) Prior to terminating an employee, the Company will, whenever possible, provide the employee with an opportunity to relocate and/or be placed in a Job that is available and for which the employee has or can, through training provided by the Company, reasonably acquire the skills for the Job.
(a) If the Company needs to reduce the workforce, it will invite employees from the Job Classes being reduced to volunteer for severance.
(b) The Company will choose the employees to be terminated from the list of volunteers.
(c) If there are insufficient volunteers to meet the proposed reduction, the Company may select other additional employees to be terminated.
REDUCTION OF STAFF. Full-Time Seniority Employees
REDUCTION OF STAFF. Involuntary transfers to reduce staff may be made at the end of the school year based upon enrollment estimates and during the year based upon actual enrollments. The supervisor shall determine the level (K-3, 4-6), the subject area, or program to be reduced. Elementary site administrators shall poll their staffs as to qualifications for and interest in changing levels.
12.7.3.1. Volunteers may be transferred to achieve the desired reduction. If no unit member volunteers for transfer, the unit member who has the least seniority at the level, in the subject area, or with the affected program shall be transferred. However, a unit member who has taught in the District for at least two (2) school years in a different subject or at a different level within the last nine (9) years or at least one (1) school year within the last five (5) years and is deemed qualified by the Human Resource Services Division may exercise seniority rights within that other subject, level, or program.
12.7.3.2. When October enrollment justifies, a unit member may be returned to his/her site with the agreement of the division head. A unit member involuntarily transferred after October 15 will not be transferred again during the same year for the same purpose.
12.7.3.3. Counselors who are deemed in excess shall be placed on an interview list and considered for vacant counseling positions during the next school year.
REDUCTION OF STAFF. A. When by reason of decreased enrollment of pupils, return to duty of regular teachers after leaves of absence, or by reason of suspension of schools or territorial changes affecting the District or for financial reasons, the Employer decides that it will be necessary to reduce the number of Teachers, it may make a reasonable reduction. In making such reduction, the Employer shall proceed to suspend contracts in accordance with the recommendation of the Superintendent who shall, within each certification/licensure affected, give preference to Teachers on continuing contracts. Prior to proceeding with an anticipated staff reduction, the Association President shall be notified by the Superintendent of the Board's intent to consider a staff reduction. A meeting shall be held between representatives of the Board and representatives of the Association to review the appropriate data indicating a need for a reduction in staff. The parties shall discuss why the reduction is necessary, what areas of certification/licensure may be affected, the possible extent of the anticipated reduction and the possible effects of the reduction.
1. The Board shall handle all staff reductions first through normal attrition.
2. Limited contract teachers shall be reduced by using the following order:
a. Area of licensure/certification;
b. Competency as determined by formal evaluation;
c. When evaluations are comparable, by lowest seniority in the District.
3. Continuing contract teachers shall be reduced only after all limited contract teachers in the teaching field of assignment by using the following order:
a. Area of licensure/certification;
b. Competency as determined by formal evaluation;
c. When evaluations are comparable, by lowest seniority in the District.
B. If the District incurs a reduction or elimination of state or federal dollars, the Board may suspend the contracts of Unit Members, provided the elimination or reduction of state or federal dollars is not caused by any action of the Employer. Suspension of contracts shall be made using the procedures of this Article. Current state and federal programs are:

REDUCTION OF STAFF. In the event that the board determines to reduce staff, employees will be laid off under the following procedures:

As a result of authority granted to the Board by the Kansas Constitution and Kansas statutes, the Board has the responsibility of determining composition of the professional staff necessary to implement and maintain educational programs of the District. From time to time, as the result of decreasing enrollment, limited financial resources, changes in educational programs, or other circumstances, it may be necessary to reduce the number of professional employees employed by the District. A decision to reduce professional staff will, in all cases, remain within the sole discretion and judgment of the Board. The Board may retain any professional employee whom it deems necessary to staff all the programs of the District, including curricular, co-curricular, and extra-curricular programs of the District. It is the policy of this District to use normal attrition of the staff; i.e., resignations, retirement, leaves of absence, as the first means of achieving a reduction in professional staff. In the event that further reduction of professional staff is necessary, it shall be accomplished in a fair and orderly manner as provided in this policy.

REDUCTION OF STAFF. In the event that the Employer declares the need for a reduction of staff in a particular classification, prior to issuing notices of layoff, the Employer shall attempt to reduce disruption to the workplace through offering voluntary severance as outlined in Memorandum of Agreement # 5.
