Should Lessee assign, sublet or otherwise transfer use and occupancy of any portion of this land lease to a third party, in accordance with Section III., D., above, rent shall be severable, and the BOCC shall look solely to such third party for payment of all rentals with respect to such land lease on a pro- rata square footage basis.

RENTS, FEES AND CHARGES. The term Rents, Fees and Charges as used herein includes all rent payments required to be paid by Lessee under this Agreement, including Ground Rent, MAG and Percentage Fee, and also includes all other sum payable hereunder including, but not limited to, Maintenance and Operation charges, AVI Charges, Delinquency Charges, Returned Check Fees, Late Fees, Liquidated Damages, car carrier fines, all other fees incurred by Lessee as a result of operating under this Agreement, and all other sums paid by the Authority on behalf of Lessee pursuant to this Agreement.
RENTS, FEES AND CHARGES. A. Ground Rent. Lessee shall initially pay to the BOCC the following annual rents: Phase I Development: 52,216 sq. ft. x $.281659 = $14,707.11(“Phase I Development Rent”. Phase II Development: 50,805 sq. ft x $.281659 = $14,310 (“Phase II Development Rent”) The Phase I Development Rent (as adjusted for inflation) shall be payable beginning with the effective date of this Private Hangar Agreement through the end of the lease term. Thirty percent (30%) of the Phase II Development Rent (as adjusted for inflation) shall be payable beginning with the date of this Private Hangar Agreement through the date the Phase II Development is issued a Certificate of Occupancy. Thereafter, the Phase II Development Rent (as adjusted for inflation) shall be payable for the remainder of the lease term. If a Phase III is requested and approved, the rent due for that additional parcel will be added to this Private Hangar Agreement as a written amendment.
