Repayment of Funds. If AMO declares that an Event of Default has not been cured to its exclusive satisfaction, AMO reserves the right to declare that prior payments of Funds become a debt to Canada which the Recipient will reimburse forthwith on demand to AMO for transmission to Canada.
Repayment of Funds. Unless Treasury extends the time period, a recipient shall repay to the Secretary any amounts subject to recoupment in accordance with instructions provided by Treasury:
(1) Within 120 calendar days of receipt of the notice of recoupment provided under paragraph (c) of this section, in the case of a recipient that does not submit a request for reconsideration in accordance with the requirements of paragraph (d) of this section; or
(2) Within 120 calendar days of receipt of the Secretary’s decision under paragraph (e) of this section, in the case of a recipient that submits a request for reconsideration in accordance with the requirements of paragraph (d) of this section.
Repayment of Funds. The Grantee shall repay to the City the full amount of any City Funds lost, misapplied, unaccounted for, or inadequately accounted for in violation of this Agreement.
Repayment of Funds. If: on expiry or on any earlier termination of this Agreement, any or all of the Funds: have not been spent or committed in accordance with this Agreement; or cannot, by reconciliation between the accounts and records maintained by the Recipient and the Project Budget, be shown, to the reasonable satisfaction of the Department, to have been spent or committed in accordance with this Agreement; or at any time the Department forms the reasonable opinion that any Funds have been used, spent or committed by the Recipient other than in accordance with this Agreement, the Department may by written notice to the Recipient: require the Recipient to repay that part of the Funds, and the Recipient must repay to the Department the amount set out in the notice, within 20 Business Days of receipt of the notice; deduct an equivalent amount from the Funds payable to the Recipient pursuant to this Agreement or from any other amounts payable to the Recipient under any other agreement with the Department; or require the Recipient to use all or part of those Funds as the Department in its sole and unfettered discretion sees fit.
Repayment of Funds. In the event that RISE, DHCD or HUD determines that any funds were expended by the Awardee for unauthorized or ineligible purposes or the expenditures constitute disallowed costs in any other way, RISE, DHCD or HUD may order repayment of the same. The Awardee shall remit the disallowed amount to RISE within thirty (30) days of written notice of the disallowance.
A. The Awardee agrees that funds determined by RISE to be surplus upon completion of the Agreement will be subject to cancellation by RISE.
B. The Awardee agrees that upon expiration of this Agreement, the Awardee shall transfer to RISE any CDBG-NDR funds on hand at the time of the expiration and any accounts receivable attributable to the use of CDBG-NDR funds.
C. RISE shall be relieved of any obligation for payments if funds allocated to RISE cease to be available for any cause other than misfeasance of RISE itself.
D. RISE reserves the right to withhold payments pending timely delivery of program reports or documents as may be required under this agreement.
E. Awardee acknowledges that all “Program Income,” as that term is defined in 24 CFR 570.500, received by Awardee shall be immediately remitted to RISE, and that Awardee shall have no right to retain Program Income without the written consent of RISE.
Repayment of Funds. (1) Federally Required Repayments or Penalties. Contractor shall be responsible for federal disallowances or penalties resulting from any disallowance or costs for cases that are claimed through or related to this IAC that DFPS must: (1) repay any Title IV-E funds, or (2) make any related penalty or other payments. In the event that DFPS is required to make such payment(s), Contractor shall repay the costs associated with all cases that are claimed through this contract and any other penalty. DPFS may immediately deduct/recoup such entire payment owed by Contractor against the amounts otherwise payable from DFPS to Contractor to the extent and until such entire payment amount has been credited. DFPS shall notify Contractor of the reason for and calculation of, as well as any such deductions of any such payment amount for which Contractor is responsible.
(2) Calculation of Repayment. Contractor's share of any such required federal repayment or penalty shall be equal to the sum of: (i) all disallowed costs associated with cases claimed through this IAC plus (ii) a proportionate share of any DFPS administrative or programmatic expenses disallowed as a result of extrapolated audit exceptions. The proportionate share of such expenses shall be determined using a percentage: the numerator of which is the aggregate sum of disallowed costs pertaining to Contractor claims during the relevant audit period, and the denominator of which is the aggregate sum of disallowed costs for all Title IV- E funds provided to DFPS during the same audit period.
Repayment of Funds. (a) Each of the following is a Repayment Event:
(i) where the department terminates the Funding Agreement because of an Event of Default in accordance with section 17(b)(ii); or
(ii) where the department terminates the Funding Agreement in accordance with clause 17(c).
(b) If a Repayment Event occurs, the department must notify the AFP in writing that a Repayment Event has occurred.
(c) Without limiting the department’s rights at Law, if a Repayment Event occurs, the department may require the AFP to repay Funds paid to the AFP under this Funding Agreement, within 20 Business Days after the date of the notice given to the AFP by the department (in accordance with clause 18(b)).
Repayment of Funds. The Municipality shall repay Funds to UCPR where:
(a) The Municipality has used the Funds for a purpose not agreed to by UCPR;
(b) The Municipality still has Funds under its charge, management or control upon the expiry or termination of this Agreement;
(c) The Municipality receives an overpayment by UCPR and is notified by UCPR of said overpayment, within fifteen (15) Business Days of receiving a written demand from UCPR.
Repayment of Funds. District funding shall be subject to repayment after expiration of this Agreement if, upon audit examination, the District finds any of the following: (1) Recipient has spent funds for purposes other than as provided for herein, including but not limited to construction materials not used in the Project; (2) Recipient has failed to perform a continuing obligation of this Agreement; (3) Recipient has received duplicate funds from the District for the same purpose; (4) Recipient has been advanced or paid unobligated funds; (5) Recipient has been paid funds in excess of the amount Recipient is entitled to receive under the Agreement; and/or
Repayment of Funds. An employee will pay no penalties, fees or interest as a result of the overpayment. The employee shall have the right to select one of the two following options for the repayment of the funds:
