Representation by Landlord. Landlord represents that, to the best of -------------------------- Landlord's knowledge, as of the date of this Lease the Project is in compliance with all currently applicable laws, rules and regulations, including, but not limited to, environmental laws and the Americans with Disabilities Act. Landlord also represents that the mechanical systems in the Building are "Year 2000 Compliant" (i.e., the computer applications in such systems have the ability to recognize correctly and perform properly date-sensitive functions involving certain dates prior to and any date after December 31, 1999).
Representation by Landlord. The Tenant acknowledges that there have been no representations made by the Landlord which are not set out in the Lease, and that the Lease constitutes the entire agreement between the Landlord and the Tenant and may be modified except as herein explicitly provided or except by subsequent agreement in writing duly signed by the Landlord and the Tenant and, if applicable, the Guarantor. Representation by Landlord. Landlord covenants, represents and warrants to Tenant as follows: (i) Landlord has a valid leasehold estate with respect to the Premises pursuant to the Ground Lease for the entire term of this Lease and any renewal term; (ii) Landlord has full power and authority to enter into and carry out the terms of this Lease without any consents from third parties; (iii) at such time as the Tower is made available to Tenant, the Tower will be registered and in compliance with all applicable regulations of the Federal Communications Commission and the Federal Aviation Administration; (iv) subject to the provisions of Article XXI below, Landlord will complete construction of the Tower as contemplated herein and make it ready for installation of Tenant's antenna by February 1, 1999; and (v) the uses of the Premises as provided herein are permitted by the Ground Lease. Following execution of this Lease, Landlord shall promptly give notice to the Tribe in accordance with the Ground Lease and provide Tenant with evidence of such notice, which notice Landlord represents is the only notice required under the Ground Lease for Tenant's non-disturbance protection.

Representation by Landlord. Landlord hereby represents and warrants to Tenant, except as outlined in the Levixx Xxxcxx xxxort dated 12/21/88 & 3/17/89 to the best of Landlord's knowledge: (i) the Premises and all operations conducted thereon prior to the Commencement Date are in compliance with all Laws regarding Hazardous Materials ("Hazardous Materials Laws"), and (ii) any handling, transportation, storage, treatment, disposal, release or use of Hazardous Materials that has occurred on or about the Premises prior to the Commencement Date has been in compliance with all Hazardous Materials Laws. Tenant acknowledges reviewing the correspondence dated March 1, 1990 from the Department of Health Services concerning the "mixing" that occurred with respect to DDT at the Project. Landlord further represents and warrants that no litigation has been brought or threatened, nor any settlements reached with any governmental or private party, concerning the actual or alleged presence of Hazardous Materials on or about the Premises, nor has Landlord received any notice of any violation, or any alleged violation of any Hazardous Materials Laws, pending claims or pending investigations with respect to the presence of Hazardous Materials on or about the Premises.
