RESPONSIBILITIES OF PUBLISHER. 6.1. The Publisher shall use the information provided to it by JCS Online Resources Ltd for the fulfilment of this subscription in accordance with all applicable laws concerning the protection of personal information and in compliance with the General Data Protection Regulation. The Publisher shall keep this information for as long as required to fulfil the Licensee’s subscription.
6.2. The Publisher shall ensure access and use of the Licensed Work in accordance with this Licence.
6.3. The Publisher shall cause product support to be provided to the Licensee, Authorised Schools and Authorised Users.
6.4. The Publisher shall send an email or other documentation with access instructions to the Licensee or where applicable to Authorised Schools within two working days after receiving the Order Confirmation Email (Publisher) from JCS Online Resources Limited that the terms and conditions of the Licence have been accepted.

The Publisher shall send an email or other documentation with access instructions to the Licensee or Authorised Schools within two working days after receiving the Order Confirmation Email (Publisher) from JCS Online Resources Limited that the terms and conditions of the Licence have been accepted.
RESPONSIBILITIES OF PUBLISHER. 4.1 Publisher shall provide the Customer with a customer number necessary to enable the Customer to submit the Online Registration Materials.
4.2 Publisher shall use all reasonable efforts:
4.2.1 to make the Publications available by means of the World Wide Web to the Customer throughout the Subscription Period;
4.2.2 to ensure that the Server has sufficient capacity and rate of connectivity to provide the Customer with a quality of service consistent with current standards in the World Wide Web on-line information provision industry;
4.2.3 to restore access to the Publications as soon as possible in the event of an interruption or suspension of the service.
4.3 Publisher agrees to make available to the Customer a monthly COUNTER compliant usage report throughout the Subscription Period detailing the level of use of the Publications by the Customer's Authorised Users per month, but only to the extent such monthly usage reports are made available by the party hosting the Publications on behalf of the Publisher. This report will not identify individual Authorised User usage, but will be provided in respect of the IP address range(s) given by the Customer in the Online Registration Materials as a whole. The Publisher will not be able to provide accurate usage reports if the Customer stores the Publications on any cache or proxy server, or accesses the Publications through an agent gateway.
4.4 The Publisher reserves the right to withdraw from the Publications content that it no longer retains the right to provide or that it has reasonable grounds to believe is unlawful, harmful, false, or infringing.
4.5 The Publisher reserves the right to suspend access to the Publications in the event of any unauthorised use of the Publications.
4.6 The Publisher shall defend the Customer against all claims, suits, proceedings, losses, liabilities, and damages (including costs, expenses, and reasonable attorneys' fees) asserted by third parties against the Customer which arise out of a breach of the Publisher's warranties under Clause 6.1 below. This indemnity shall not cover the Customer to the extent that a claim results from the Customer's negligence or wilful misconduct. 6.2 Publisher shall cause product support to be provided to the Institution and to Authorised Users.

The Publisher and JCS Online Resources Ltd, acting on behalf of the Publisher, shall not, and shall not seek to, collect Personal Data in relation to any Authorised User other than as is reasonably and properly required for the administration of this Licence, and shall fully comply with its obligations under the applicable Data Protection Laws in relation to the collection, use, retention and appropriate security of any such Personal Data processing.
6.3. The Publisher shall ensure access and use of the Licensed Work in accordance with this Licence;
6.4. The Publisher provide for customer support services to the Authorised Institution via e- mail or phone, including answering e-mail enquiries relating to the use, functionality and content of the Product;
6.5. The Publisher make available to the Authorised Institution usage statistics, on at least a monthly basis;
6.6. The Publisher send an email or other documentation with access instructions to the Licensee within two working days after receiving the Order Confirmation Report (Publisher) from JCS Online Resources Limited that the terms and conditions of the Licence have been accepted;
6.7. The Publisher provide electronic product documentation free of charge to the Institution. The Institution is permitted to make copies of all documentation and to distribute it to Authorised Users and Authorised Demonstrators and Authorised Demonstrators provided it is either duplicated in full, or a proper ownership acknowledgement is included.

4.1.1 to make each Publication available online to the Customer throughout that Publication’s Publication Term;
4.1.2 to ensure that the Server has sufficient capacity and rate of connectivity to provide the Customer with a quality of service consistent with current industry standards for publishers publishing materials online;
4.1.3 to restore the Customer’s access to the Publications as soon as possible in the event of an interruption or suspension of the service; and
4.1.4 to provide, or arrange for a third party to provide, customer support services to the Customer.
4.2 To the extent the following monthly usage reports are made available by the party hosting the Publication(s) on behalf of the Publisher (for clarity, this excludes any Publications self-hosted by the Customer) and subject to the last sentence of this Clause, the Publisher will make available to the Customer monthly usage reports throughout the Publication Term for each Publication, detailing the level of use of each Publication by the Customer's Authorised Users per month. The Publisher shall use reasonable efforts to ensure that such usage reports are compliant with the most recent release of the COUNTER Code of Practice for Journals and Databases (available at ). The Customer acknowledges that the Publisher will not be able to provide accurate usage reports if the Customer stores the Publication(s) on any cache or proxy server, or accesses the Publications through an agent gateway.
