Responsibility for Funds Transfers. You agree to assume full responsibility for and be bound by all funds transfer requests issued in your name, whether or not authorized, provided the funds transfer request was executed by Interaudi Bank in good faith and in accordance with procedures set forth in this Agreement. You authorize Interaudi Bank to execute and charge the designated account(s) for any and all instructions for funds transfers, provided such requests are given in the name(s) of any of the authorized signatories of the designated account(s) and are executed in accordance with the security procedures established by Interaudi Bank.

Responsibility for Funds Transfers. Bank agrees to make reasonable efforts to complete all ACH, wire or intrabank fund transfers requested. Bank will be responsible for acting only on those instructions actually received by it and cannot assume responsibility for malfunctions in communications facilities or acts of others not under its control that may affect the accuracy or timeliness of messages a Customer sends. Bank is not responsible if Customer provides incorrect instructions or if the instructions are not received prior to Bank's published cutoff times. Customer has no right to cancel or amend a transfer after Bank executes it. Bank may attempt to revoke a transfer that has not been executed if the request is received in a time and manner that gives it a reasonable time to act upon it, but Bank makes no warranty as to its ability to revoke or cancel a transfer once made. Customer agrees to hold Bank harmless against claims of third parties when Bank revokes or cancels any funds transfer instructions.

  • PERFORMING AGENCY RESPONSIBILITY FOR SYSTEM AGENCY’S TERMINATION COSTS If the System Agency terminates the Contract for cause, the Performing Agency shall be responsible to the System Agency for all costs incurred by the System Agency and the State of Texas to replace the Performing Agency. These costs include, but are not limited to, the costs of procuring a substitute vendor and the cost of any claim or litigation attributable to Performing Agency’s failure to perform any Work in accordance with the terms of the Contract.

If your monthly financial institution statement contains payments that you did not authorize, you must tell us at once. If you do not tell us within sixty (60) days after the statement was sent to you, you may lose any amount transferred without your authorization after the sixty (60) days if we can prove that we could have stopped someone from taking the money had you told us in time. If a good reason (such as a long trip or a hospital stay) prevented you from telling us, we will extend the time periods specified above to a reasonable period.

  • Responsibility for Evaluation Within each school the Principal will be responsible for the evaluation of employees assigned to that school. Evaluation will be made by the Principal or a qualified administrator. An employee assigned to more than one school will be evaluated by the Principal of the school in which the employee is assigned for the greater amount of time, with input provided by the Principal of the other school. Any Principal or person charged with the responsibility of evaluation of employees may involve other staff and students in the process if acceptable to the certificated teacher being evaluated.
