Responsibility for Your Account. You are responsible as between for any activity that occurs through Your account and You agree You will not sell, transfer, license or assign Your account, followers, username, or any account rights. With the exception of administrators that are expressly authorized by Blackbaud to assist in the creation of other authorized user accounts, Blackbaud prohibits the creation of such accounts, and You agree that You will not create an account for anyone other than Yourself. You must notify Blackbaud immediately of any breach of security or unauthorized use of Your account. Blackbaud will not be liable for any losses caused by any unauthorized use of Your account. You shall be solely responsible for ensuring accuracy, completeness, and compliance of any documents, information, records and other output (“Output”) provided to any third party, and all liabilities and responsibilities in connection with such Output, and Blackbaud and Subscriber shall be responsible for the accuracy, completeness, or compliance thereof. (An organization sponsoring a program(s) using the Services or Your employer if You are an employee of an organization sponsoring a program(s) using the Services are the “Subscriber”.) Blackbaud and Subscriber shall not be liable for the accuracy, completeness or authenticity of End User data furnished by End User or any other third party, and shall have no obligation or responsibility to audit, check or verify the End User data. Neither You nor any other person will have any claim or cause of action against Blackbaud or Subscriber as a result of any professional or other Services rendered or withheld in connection with the use of the Services, End User data, Output or the Services.

Responsibility for Your Account. You are responsible for maintaining the confidentiality of Your account and any codes, passwords and personal identification numbers used in conjunction with the Services and for all uses of the Services in association with Your account whether or not authorized by You. You agree to immediately notify Claro Enterprise Solutions of any unauthorized use of Your account of which You become aware.

YOU UNDERSTAND AND AGREE THAT YOU ARE SOLELY RESPONSIBLE FOR ALL LOSS OR DAMAGE OF ANY KIND RESULTING FROM ACTS OR OMISSIONS OF YOUR ACCOUNT ADMINISTRATOR AND ANY PERSON TO WHOM YOU OR YOUR ACCOUNT ADMINISTRATOR GIVES ANY ADMINISTRATIVE OR AUTHORIZED USER RIGHTS WITH RESPECT TO YOUR ACCOUNTS THROUGH THE DIGITAL BANKING SOLUTION. YOU ARE ALSO RESPONSIBLE FOR ALL LOSS OR INJURY RESULTING FROM ANY UNAUTHORIZED USE OF A USERNAME, PASSWORD OR OTHER MEANS TO ACCESS YOUR ACCOUNT, UNLESS YOU ARE A CONSUMER (AS DEFINED BY REGULATION E, 12 C.F.R. PART 205), IN WHICH CASE YOUR RESPONSIBILITIES ARE AS SET FORTH IN THE EFT STATEMENT.

Any transaction made using your Sign-On ID and Pass Code is conclusively presumed to have been authorized by you to the maximum extent allowed by law.

  • Responsibility for Evaluation Within each school the Principal will be responsible for the evaluation of employees assigned to that school. Evaluation will be made by the Principal or a qualified administrator. An employee assigned to more than one school will be evaluated by the Principal of the school in which the employee is assigned for the greater amount of time, with input provided by the Principal of the other school. Any Principal or person charged with the responsibility of evaluation of employees may involve other staff and students in the process if acceptable to the certificated teacher being evaluated.
