RESTRICTION DUTY. 5.1 An Employee may be directed to be contactable and to be available to perform extra duty outside of the Employee’s ordinary hours of duty, subject to payment under this clause. 5.2 Payment will be made subject to the following conditions: (a) Unless otherwise approved by the Commissioner, an Employee in a classification the minimum salary of which exceeds the maximum salary of the classification of Administrative Officer 6 is not eligible to receive payment; (b) The restriction situation is imposed by prior written direction, or is subsequently approved in writing; (c) The provisions of clause 4 (Emergency Duty) will not apply where an Employee is recalled to duty while restricted; (d) An Employee who does not maintain a required degree of readiness while restricted will not be eligible to receive payment. 5.3 Payment rates (a) An Employee who is required to remain contactable and available to perform extra duty outside of the Employee’s ordinary hours of duty will, subject to sub-clause 5.2, be paid an allowance in addition to salary at a rate for the type of restriction as follows: i. On call An Employee who is instructed prior to ceasing ordinary duty to be on restriction duty will be paid at the rate specified in accordance with clause 31 (On-call Allowance) in Part 3 of this Agreement. ii. Stand by An Employee who is instructed prior to ceasing ordinary duty to be on restriction duty and to remain at the Employee’s home and available for immediate recall to duty: 50% of the Employee’s ordinary rate of salary for the proportion of the period of restriction calculated in accordance with paragraph (b). iii. Home duty An Employee who is required to stand by at home to perform intermittent duties at home normally involving receiving and/or making telephone calls, and who may be required to perform restriction duty: 75% of the Employee’s ordinary rate of salary, or not less than 50% or more than 100% of ordinary salary as approved by the Commissioner, for the proportion of the period of standing by calculated in accordance with paragraph (b), provided that the rate on Sundays is single ordinary rate of salary and the rate on public holidays is 125% of ordinary rate of salary.

RESTRICTION DUTY. 5.1 a) An Employee may employee performing restriction duty in accordance with clause 36 will be directed to be contactable and to be available to perform extra duty outside paid: • at a rate of 7.5% of the Employee’s employee's hourly rate of salary for each hour restricted Monday to Friday; • at a rate of 10% of the employee's hourly rate of salary for each hour restricted Saturday and Sunday; and • at a rate of 15% of the employee's hourly rate of salary for each hour restricted on public holidays.
b) The hourly rate of payment will be calculated according to the following formula: annual salary X 6 X % of salary prescribed at c) or d) 313 37.5
c) An employee's salary for the purpose of calculation of restriction allowance will include higher duties allowance and any other allowances in the nature of salary.
d) Where approval has been made for payment of restriction allowance to an employee above the salary barrier, the annual salary component of the formula at will be the annual salary payable to an APS Level 6.
e) Restriction allowance will be payable for each hour or part hour the employee is restricted outside the employee's ordinary hours of duty. Any part of a period of restriction for which the employee receives another payment will not be included for calculating payments.
f) Where an employee who has been restricted under this subclause is required to perform duty, but is not required to be recalled to work, overtime payment will be made, subject to payment under this clausea one hour minimum payment.
5.2 Payment g) Where an employee who has been restricted outside the employee's normal hours is recalled to duty at a place of work, payment in accordance with the relevant overtime provisions will be made subject to a 3 hour minimum payment.
h) Payment of restriction allowance will be subject to the following conditions:
(a) Unless otherwise approved by : • the Commissioner, an Employee in a classification the minimum salary of which exceeds the maximum salary of the classification of Administrative Officer 6 is not eligible to receive payment;
(b) The restriction situation is imposed by prior written direction, or is subsequently approved in writing;
(c) The provisions of ; and • emergency duty under sub-clause 4 (Emergency Duty) 19.2 will not apply where an Employee employee is recalled to duty while restricted;
(d) An Employee who does not maintain a required degree of readiness while restricted will not be eligible to receive payment.
5.3 Payment rates
(ai) An Employee who Notwithstanding the provisions of this Section, where an employee is required to remain contactable and available to perform extra duty placed in a restriction situation outside of the Employee’s employee's ordinary hours of duty willduty, subject to sub-clause 5.2, be paid an allowance in addition to salary at a rate for the type of restriction as follows:
i. On call An Employee who is instructed prior to ceasing ordinary duty to be on restriction duty will employee may be paid at an alternative rate having regard to the rate specified in accordance with clause 31 (On-call Allowance) in Part 3 of this Agreement.
ii. Stand by An Employee who is instructed prior to ceasing ordinary duty to be on restriction duty and to remain at the Employee’s home and available for immediate recall to duty: 50% circumstances of the Employee’s ordinary rate of salary for the proportion of the period of restriction calculated in accordance with paragraph (b)situation.
iii.
