RETAILER OF LAST RESORT EVENT. If we are no longer entitled by law to sell energy to you due to a Retailer of Last Resort (RoLR) event occurring in relation to us, we are required under the National Energy Retail Law and the Rules to provide relevant information (including your name, billing address and metering identifier) to the entity appointed as the relevant designated retailer for the RoLR event and this contract will come to an end.
RETAILER OF LAST RESORT EVENT. If we are no longer entitled by law to sell electricity to you due to a RoLR event occurring in relation to us, we are required under the Code to provide relevant information (including your name, billing address, and metering identifier) to the entity appointed as the relevant designated retailer for the RoLR event, and this agreement will come to an end. Please refer to Xxxxxxx-Xxxxxxxx.xxx.xx/xxxxxxxxx (Code of Conduct for Retail Electricity Licensees) for more information on the RoLR framework. No later than twenty-one (21) business days from the RoLR event:
(a) we will notify you in writing that we are facing a RoLR event; and
(b) we may notify you in writing (if applicable), if another retailer is willing to accept novation of your agreement (same terms and conditions of your existing agreement with us) and we will seek your agreement to accept the novation within the period of time stipulated by us. No later than eleven (11) business days from the RoLR event:
(a) we will notify you in writing of your options to:
(i) novate (if applicable) your agreement (same terms and conditions of your existing agreement with us) and we will seek your agreement to accept the novation within the period of time stipulated by us; or
(ii) terminate the agreement and enter into a new agreement with another retailer; or
(iii) purchase electricity from the MSSL under the DSA framework. During a RoLR event: if you do not indicate your preference, you are deemed to have agreed to purchase electricity from the MSSL under the DSA with effect on and from the Default Supply Effective Date.
RETAILER OF LAST RESORT EVENT. If a Last Resort Event occurs in respect of a Connection Point:
(a) EnergyAustralia must provide the Customer's name, billing address and national metering identifier for the relevant Connection Point to the applicable Retailer of Last Resort within the timeframe required by the laws of the relevant Jurisdiction: and
(b) this Contract will automatically terminate in respect of such Connection Point.
RETAILER OF LAST RESORT EVENT. If we are unable to continue selling energy to you due to a Last Resort Event, then:
(a) under the Energy Laws we must give information about you (including your name, billing address and metering identifier) to the entity that is appointed as the designated retailer for the Retailer of Last Resort;
(b) this Agreement will automatically end on the date on which we can no longer sell energy to you; and
(c) you will not be responsible for any cost incurred in connection with the transfer to the different Retailer.

If we are no longer entitled by law to sell electricity to you due to a Retailer of Last Resort (RoLR) event occurring in relation to us, we are required under the energy laws to provide relevant information (including your name, billing address and metering identifier) to the entity appointed as the relevant designated retailer for the RoLR event and this contract will come to an end. Some obligations placed on us under this contract may be carried out by another person. If an obligation is placed on us to do something under this contract, then: we are taken to have complied with the obligation if another person does it on our behalf; and if the obligation is not complied with, we are still liable to you for the failure to comply with this contract. This contract may only be amended in accordance with the procedures set out in the energy laws. We will publish any amendments to this contract on our website. a residential customer—includes the licence number of a driver licence (or driver’s licence) issued under the law of a State or Territory. a business customer that is a sole trader or partnership—includes the form of identification for a residential customer for one or more of the individuals that conduct the business or enterprise concerned and an Australian Company Number or Australian Business Number or the body corporate; or; a business customer that is a body corporate—means Australian Company Number or Australian Business Number of the body corporate. billing cycle means the regular recurrent period for which you receive a xxxx from us. business day means a day other than a Saturday, a Sunday or a public holiday. business customer means a customer who is not a residential customer. customer means a person who buys or wants to buy electricity from a retailer. customer connection contract means a contract between you and your distributor for the provision of customer connection services. designated retailer means the financially responsible retailer for the premises (where you have an existing connection) or the local area retailer (where you do not have an existing connection) for the premises; disconnection means an action to prevent the flow of electricity to the premises but does not include an interruption. distributor means the person who operates the system that connects the embedded network to the distribution network. embedded network means the privately owned electricity network to which your premises are connected. You will automatically become party to a new electricity retail contract with the designated retailer.
