Retention and Security of Original Checks. Customer shall retain physical checks that represent the deposit for no longer than (30) days following the date of their transmittal to Bank and agrees to make the originals available to Bank within seventy-two (72) hours of Bank’s request for fraud control purposes. Such physical checks must be securely stored, to prevent unauthorized access to the items until they are destroyed (locked cabinet, etc.). You understand that in all cases you are solely responsible for safeguarding all items you retain, during the reasonable period of time described above from destruction, alteration or theft. Items are to be securely destroyed in a commercially reasonable manner that renders it unusable or otherwise unreadable (shredding) on the thirty-first (31st) day following the date of the deposit.

Retention and Security of Original Checks. After you receive confirmation that we have approved your remote deposit, you must securely store the original check for 10 business days. After this time lapse, you should destroy the original check by cross-cut shredding or another commercially acceptable means of destruction. After destruction of an original check, the image will be the sole evidence of the original check. If you do receive a notification that your remote deposit has been declined, please review the information and images submitted to ensure accuracy. If there were clear errors and it is an eligible item, please redeposit the eligible item with the corrected information and follow the retention timeline carefully. Once confirmation of remote deposit is received, you agree that you will never re-present the original check. If any Item is presented or deposited more than once, whether by remote deposit or by any other means, we may, at our discretion, reject it or return it and charge it against your Account without prior notice to you. Notifications and Receipt of Item. All checks processed for deposit through the Service will be treated as "deposits" under your current Account Agreement with us and will be subject to all terms of the Account Agreement. When we receive your request for a remote deposit, we will confirm submission via email to you. We shall not be deemed to have received request nor the check image for deposit until we have confirmed receipt to you. Confirmation of receipt does not mean that the check image contains no errors. We are not responsible for any image that we do not receive. Processing Images. Following receipt, we may process the image by preparing a "substitute check" or clearing the item as an image. Once approved, you will receive another email of confirmation. We reserve the right, at our sole and absolute discretion, to reject any image for remote deposit into your account. We will notify you of rejected images.

Funds that are deposited using Your Mobile RDC Services will not be deemed “received” by Us until We have received an electronic image that meets all of the requirements for deposits (including all requirements to create a Substitute Check) stated in these Terms and in any additional documentation related to the Mobile RDC service. Funds from Your Mobile RDC Services will be available to You no later than nine (9) Business Days after the day we receive Your deposit. Once the funds are available, You can withdraw the funds and We reserve the right to use the funds to pay items and transactions drawn on Your account. For determining the availability of Your deposits, every day is a Business Day, except Saturdays, Sundays, and holidays. If You make a deposit via the Mobile RDC Service by the cut-off time of 8:30 p.m. Central Time on a day that is not a Business Day, We will consider such deposit made on the next Business Day We are open. In some cases the funds You deposit via the Mobile RDC Service may be delayed for a longer period.
