Return and Destruction of Data. Upon termination of the Agreement, or upon the request of Guardian, Broker shall return all Nonpublic Information to Guardian in a mutually agreed upon, industry standard format, at no cost to Guardian. For any Nonpublic Information that Broker does not or cannot return, Broker shall permanently destroy it. Broker may retain Nonpublic Information in electronic format for regulatory and compliance purposes, and in the form of system backups maintained in the ordinary course of business, subject to (i) these Security and Privacy Requirements, including, without limitation, any records retention schedules specified by Guardian; and (ii) any confidentiality obligations set forth in the Agreement.
Return and Destruction of Data. (a) Protecting PII from unauthorized access and disclosure is of the utmost importance to the District, and the Contractor agrees that it is prohibited from retaining PII or continued access to PII or any copy, summary or extract of PII, on any storage medium (including, without limitation, in secure data centers and/or cloud‐based facilities) whatsoever beyond the period of providing Services to the District, unless such retention is expressly authorized for a prescribed period by the Service Agreement or other written agreement between the Parties, expressly requested by the District for purposes of facilitating the transfer of PII to the District or expressly required by law. As applicable, upon expiration or termination of the Service Agreement, the Contractor will transfer PII, in a format agreed to by the Parties to the District.
Return and Destruction of Data. 5.1 NYC Health + Hospitals retains all rights to its own data, including but not limited to files, documents, and metadata generated, stored or shared with Vendor (“NYC Health + Hospitals’ Data”) pursuant to this Agreement. 5.2 Within 30 days of expiration or termination of the Agreement Vendor shall at no additional cost to NYC Health + Hospitals recover any and all NYC Health + Hospitals’ Data and/or Confidential Information in the possession of its employees, agents or subcontractors and: 5.2.1 Provide a comprehensive, complete and accurate export of all such data to NYC Health + Hospitals’ in a commercially readable format that maintains the integrity and accessibility of the data for NYC Health + Hospitals’ future use; 5.2.2 Destroy all NYC Health + Hospitals’ Data and/or Confidential Information consistent with industry best practices within Vendor’s possession or control; and

Nothing in the DPA authorizes Provider to maintain personally identifiable data beyond the time period reasonably needed to complete the disposition.

  • RETURN AND DELETION OF CUSTOMER DATA The Braze Services allow import, export, and deletion of Customer Data by authorized Dashboard Users at all times during the term of a customer’s subscription. Following termination or expiration of the Braze Services, Braze shall securely overwrite or delete Customer Data within 60 days following any such termination in Braze’s production instance, and in accordance with the Agreement, applicable laws and the Documentation.

If you have activated a cloud solution to synchronize your device (e.g. Samsung Cloud or Apple iCloud), it may be necessary for you to delete the safeguard saved in the cloud to delete the data saved in the cloud. Images taken with the Pavillon treasure xxxx App are saved on your device and are not automatically deleted from your device when the app is uninstalled. The Pavillon App is not authorized to do this under requested permissions. This is a security setting for the iOS and Android operating systems.   • Return/Destruction of PHI 15.1 Business Associate in connection with the expiration or termination of the contract or grant shall return or destroy, at the discretion of the Covered Entity, all PHI received from Covered Entity or created or received by Business Associate on behalf of Covered Entity pursuant to this contract or grant that Business Associate still maintains in any form or medium (including electronic) within thirty (30) days after such expiration or termination. Business Associate shall not retain any copies of the PHI. Business Associate shall certify in writing for Covered Entity (1) when all PHI has been returned or destroyed and (2) that Business Associate does not continue to maintain any PHI.   • Damage and Destruction If all or any part of the Premises shall be damaged or destroyed by fire or other casualty, this Lease shall continue in full force and effect, unless terminated as hereinafter provided, and Landlord shall repair, restore or rebuild the Premises to the condition existing at the time of the occurrence of the loss; provided, however, Landlord shall not be obligated to commence such repair, restoration or rebuilding until insurance proceeds are received by Landlord, and Landlord’s obligation hereunder shall be limited to the proceeds actually received by Landlord under any insurance policy or policies, if any, less those amounts (i) which have been required to be applied towards the reduction of any indebtedness secured by a mortgage covering the Premises or any portion thereof, and (ii) which are used to reimburse Landlord for all costs and expenses, including but not limited to attorneys’ fees, incurred by Landlord to recover any such insurance proceeds. Tenant agrees to notify Landlord in writing not less than thirty (30) days prior, to the date Tenant opens for business in the Premises of the actual cost of all permanent leasehold improvements and betterments installed or to be installed by Tenant in the Premises (whether same have been paid for entirely or partially by Tenant), but exclusive of Tenant’s personal property, movable trade fixtures and inventory. Similar notifications shall be given to Landlord not less than thirty (30) days prior to the commencement of any proposed alterations, additions or improvements to the Premises. If Tenant fails to comply, with the foregoing provisions, any loss or damage Landlord shall sustain by reason thereof shall be borne by Tenant and shall be paid immediately by Tenant upon receipt of a xxxx therefore and evidence of such loss, and in addition to any other rights or remedies reserved by Landlord under this Lease, Landlord’s obligations under this Article to repair, replace and/or rebuild the Premises shall be deemed inapplicable, and in lieu thereof, Landlord may, at its election, either restore or require Tenant to restore the Premises to the condition which existed prior to such loss, and in either case Tenant shall pay the cost of such restoration. Tenant covenants and agrees to repair or replace Tenant’s fixtures, furniture, furnishings, floor coverings, equipment and stock in trade and reopen for business in the Premises within thirty (30) days after notice from Landlord that the Premises are ready for re-occupancy. No damage or destruction to the Premises shall allow Tenant to surrender possession of the Premises nor affect Tenant’s liability for the payment of rents or charges or any other covenant herein contained, except as may be specifically provided in this Lease. Notwithstanding anything to the contrary contained in this Section or elsewhere in this Lease, Landlord, at its option, may terminate this Lease by giving Tenant notice thereof within one hundred and eighty (180) days from the date of the casualty if:

  • Access To, Return, and Disposition of Data Upon written request of LEA, Operator shall dispose of or delete all Data obtained under the Service Agreement when it is no longer needed for the purpose for which it was obtained, and transfer said data to LEA or LEA’s designee within sixty (60) days of the date of termination and according to a schedule and procedure as the Parties may reasonably agree. Operator acknowledges LEA’s obligations regarding retention of governmental data, and shall not destroy Data except as permitted by LEA. Nothing in the Service Agreement shall authorize Operator to maintain Data obtained under the Service Agreement beyond the time period reasonably needed to complete the disposition. Disposition shall include (1) the shredding of any hard copies of any Data; (2) Data Destruction; or (3) Otherwise modifying the personal information in those records to make it unreadable or indecipherable. Operator shall provide written notification to LEA when the Data has been disposed of. The duty to dispose of Data shall not extend to data that has been de-identified or placed in a separate Student account, pursuant to the other terms of the DPA. The LEA may employ a “Request for Return or Deletion of Data” FORM, a sample of this form is attached on Exhibit “D”). Upon receipt of a request from the LEA, the Operator will immediately provide the LEA with any specified portion of the Data within five (5) business days of receipt of said request.
