Return of Confidential Information and Materials. The Employee agrees to return to the Company either before or immediately upon the termination of the Employee’s employment with the Company any and all information, materials or equipment which constitutes, contains, or in any way relates to the Confidential Information and any other document, equipment or materials of any kind relating in any way to the business of the Company in the possession, custody or control of the Employee which was obtained by the Employee during the course of or as a result of the Employee’s employment with the Company whether confidential or not, including, but without limitation, any copies thereof which may have been made by or for the Employee. The Employee shall also provide the Company, if requested to do so, the name of the new employer of the Employee and the Company shall have the right to advise any subsequent employer of the Employee’s obligations hereunder.
Return of Confidential Information and Materials. Executive agrees to return to Employer either before or immediately upon the termination of Executive’s employment with Employer any and all information, materials or equipment which constitutes, contains, or in any way relates to the Confidential Information and any other document, equipment or materials of any kind relating in any way to the business of Employer in the possession, custody or control of Executive which was obtained by Executive during the course of or as a result of Executive’s employment with Employer whether confidential or not, including, but without limitation, any copies thereof which may have been made by or for Executive. Executive shall also provide Employer, if requested to do so, the name of the new employer of Executive and Employer shall have the right to advise any subsequent employer of Executive’s obligations hereunder.
Return of Confidential Information and Materials. Employee shall, immediately upon AXOGEN’s request, or the termination of Employee’s employment, for any reason, whether by Employee or AXOGEN, return to AXOGEN all Confidential Information and other materials furnished to Employee, and any and all third-party property, and/or copies of the same, and all documentation, notebooks and notes, reports and any other materials whether electronic or print media containing or derived from the Confidential Information and other materials furnished to Employee by AXOGEN.
Return of Confidential Information and Materials. If this Agreement is terminated in its entirety, Novartis shall promptly return to XOMA all Know-How, data, materials and other Confidential Information made available to Novartis by XOMA under this Agreement.

BDI Pharmaceuticals may retain a copy of the Confidential Information that must thereafter be used solely as a legal record of the Confidential Information under this Agreement.

Upon any ------------------------------------------------ termination of this Agreement, PIONEER and MAXYGEN shall promptly return to the other party all Confidential Information received from the other party hereto (except one copy of which may be retained by legal counsel for archival purposes and ensuring compliance with Section 6) and other pertinent obligations under this Agreement, and all PIONEER Materials and MAXYGEN Materials shall be returned to the owner thereof.
Return of Confidential Information and Materials. On the termination or expiration of this AGREEMENT, for any reason, XANODYNE and BIRI each shall return to the other all CONFIDENTIAL INFORMATION which it or its AFFILIATES or any of its or their respective designees, officers, directors or employees possess or control that belongs to the other, except that each may retain a copy solely for record-keeping purposes.

BDI Pharmaceuticals may retain a copy of the Confidential Information that must thereafter be used solely as a legal record of the Confidential Information under this Agreement.
Return of Confidential Information and Materials. In the event that this Agreement is terminated by either Party pursuant to Section 2.3, 12.1, 12.2, 12.3 or 12.4, each Party shall return to the other its Confidential Information and unused Materials and Patient Tissues, if any; provided, however, that one copy of such other Party's Confidential Information may be retained for such returning Party's legal archives.
