Review of Indian Children Currently in Placement. Following the effective date of this Agreement, the Department will provide the tribal social service agencies with information on all Indian children currently in placement, who have been sent under the compact to another state, or who have been sent by another state to the State of Minnesota. If resources permit, the Department will make such reports to the tribal social service agencies annually. The information shall include information received by the Department on the Interstate Compact Application Request To Place Child form that is used by the Department for the interstate placement of children. If a tribe learns of a placement of an Indian child that fails to meet the placement preferences or the good cause exceptions set forth in the Indian Child Welfare Act, the Minnesota Indian Family Preservation Act, or this Agreement, upon notice from the tribe, the Department will cooperate with the tribe in remedying the placement so that it conforms with the Indian Child Welfare Act, the Minnesota Indian Family Preservation Act and this Agreement.

Review of Indian Children Currently in Placement. After the effective date of this Agreement, the Department must provide ACFS with information on all SCIT Children or SCIT Descendant Children who are currently in placement within the State, who have been sent under the Compact to another state, or who have been sent from another state to the DHS of Michigan. The Department must provide an annual written report to ACFS regarding all such placements. The report must include all information received by the Department regarding each child’s placement, including the Interstate Compact Application Request to Place Child form used by the Department for the interstate placement of children. If SCIT learns of a placement of a SCIT Child that does not meet the placement preferences set forth in the Act or this Agreement, upon notice from SCIT, the Department must cooperate with SCIT to remedy the placement so that it conforms with the Act, or the Department must show Good Cause Not to Follow the Placement Preferences.

The information shall include information received by DHS on the 100-A form which is entitled AInterstate Compact Application Request To Place Child@ and which is used by DHS for the interstate placement of children. The information on that form includes: a. Full name of the child, and the child=s date of birth; b. Name/address/telephone number of the person(s) or agency responsible for planning for the child; c. Sex of the child; d. Name of the child=s natural parents; e. Whether the child is an Indian child; f. Name/address/ telephone number of the agency or person financially responsible for the child; g. Name/address/telephone number of the facility or home where child is to be placed; h. Type of care the child will be receiving; i. Legal status of the child (i.e., who has legal custody and whether parental rights have bee j. Whether other services have been requested and whether a home study has been requested; and k. Name/address/telephone number of supervising agency in receiving state. If a tribe learns of a placement of an Indian child that fails to meet the placement preferences or the good cause exceptions set forth in ICWA, MIFPA, or this Agreement, upon request from the tribe, DHS will assist the tribe in remedying the placement so that it conforms with ICWA, MIFPA, and this Agreement.
Review of Indian Children Currently in Placement. Within 120 days of the implementation of this Agreement DHS shall review all of its cases involving Indian Children. If the State of Tribe learns of a placement that fails to meet the placement preferences or the good cause exception in ICWA, DHS will work with the Tribe to develop a plan that is satisfactory to all parties.

Additional International Olympic Committee, International Red Cross and Red Crescent Movement names (including their IDN variants) may be added to the list upon ten (10) calendar days notice from ICANN to Registry Operator. Such names may not be activated in the DNS, and may not be released for registration to any person or entity other than Registry Operator. Upon conclusion of Registry Operator’s designation as operator of the registry for the TLD, all such names withheld from registration or allocated to Registry Operator shall be transferred as specified by ICANN. Registry Operator may self-­‐allocate and renew such names without use of an ICANN accredited registrar, which will not be considered Transactions for purposes of Section 6.1 of the Agreement.

  • ETHICS IN PUBLIC CONTRACTING This Contract incorporates by reference Article 9 of the Arlington County Purchasing Resolution, as well as all state and federal laws related to ethics, conflicts of interest or bribery, including the State and Local Government Conflict of Interests Act (Code of Virginia § 2.2-3100 et seq.), the Virginia Governmental Frauds Act (Code of Virginia § 18.2-498.1 et seq.) and Articles 2 and 3 of Chapter 10 of Title 18.2 of the Code of Virginia, as amended (§ 18.2-438 et seq.). The Contractor certifies that its proposal was made without collusion or fraud; that it has not offered or received any kickbacks or inducements from any other offeror, supplier, manufacturer or subcontractor; and that it has not conferred on any public employee having official responsibility for this procurement any payment, loan, subscription, advance, deposit of money, services or anything of more than nominal value, present or promised, unless consideration of substantially equal or greater value was exchanged.

  • Principal Place of Business; State of Organization Borrower will not cause or permit any change to be made in its name, identity (including its trade name or names), place of organization or formation (as set forth in Section 4.1.36 hereof) or Borrower’s corporate or partnership or other structure unless Borrower shall have first notified Lender in writing of such change at least thirty (30) days prior to the effective date of such change, and shall have first taken all action required by Lender for the purpose of perfecting or protecting the lien and security interests of Lender pursuant to this Agreement, and the other Loan Documents and, in the case of a change in Borrower’s structure, without first obtaining the prior written consent of Lender, which consent may given or denied in Lender’s sole discretion. Upon Lender’s request, Borrower shall, at Borrower’s sole cost and expense, execute and deliver additional security agreements and other instruments which may be necessary to effectively evidence or perfect Lender’s security interest in the Property as a result of such change of principal place of business or place of organization. Borrower’s principal place of business and chief executive office, and the place where Borrower keeps its books and records, including recorded data of any kind or nature, regardless of the medium or recording, including software, writings, plans, specifications and schematics, has been for the preceding four months (or, if less, the entire period of the existence of Borrower) and will continue to be the address of Borrower set forth at the introductory paragraph of this Agreement (unless Borrower notifies Lender in writing at least thirty (30) days prior to the date of such change). Borrower shall promptly notify Lender of any change in its organizational identification number. If Borrower does not now have an organizational identification number and later obtains one, Borrower promptly shall notify Lender of such organizational identification number.

  • Time Off for Union Business ‌ (a) Leave of absence without pay shall be granted upon request for the reasons set out below unless it would unduly interrupt the Employer's operations: (1) to an elected or appointed representative of the Union to attend conventions of the Union and bodies to which the Union is affiliated, to a maximum of 21 days per occurrence; (2) for elected or appointed representatives of the Union to attend to union business which requires them to leave their general work area; (3) for employees who are representatives of the Union on a bargaining committee. (b) Long-term leave of absence without pay shall be granted to employees designated by the Union to transact union business for specific periods of not less than 21 days unless this would unduly interrupt the operation of the department. Such requests shall be made in writing sufficiently in advance to minimize disruption of the department. Employees granted such leave of absence shall retain all rights and privileges accumulated prior to obtaining such leave. Seniority shall continue to accumulate during such leave and shall apply to such provisions as annual vacations, increments and promotions. (c) When leave of absence without pay is granted pursuant to Part (a) or (b), the leave shall be given with pay and the Union shall reimburse the Employer for salary and benefit costs, including travel time incurred, within 60 days of receipt of the invoice. It is understood that employees granted leave of absence pursuant to this clause shall receive their current rates of pay while on leave of absence. Leave of absence granted under this clause shall include sufficient travel time. The pay and benefits received by the employee and reimbursed by the Union under this article shall be based on the number of hours to which the Union indicates, in writing, the employee is entitled. This provision does not apply to employees on extended leaves of absence who are employed by the Union on a full-time basis. (d) Leave of absence with pay and without loss of seniority will be granted to an employee called to appear as a witness before an arbitration board, provided the dispute involved the Employer. On application, the Arbitration Board may determine summarily the amount of time required for the attendance of any witness. (e) The Union shall provide the Employer with reasonable notice to minimize disruption of the operation and shall make every reasonable effort to give a minimum of 14 days’ notice prior to the commencement of leave under (a) or (b) above. The Employer agrees that any of the above leaves of absence shall not be unreasonably withheld.

  • MEMBERS OF DIPLOMATIC MISSIONS AND CONSULAR POSTS Nothing in this Agreement shall affect the fiscal privileges of members of diplomatic missions or consular posts under the general rules of international law or under the provisions of special agreements.
