Right to request. (a) An Employee entitled to parental leave pursuant to the provisions of Clauses 56.8 and/or 56.9 may request the Employer to allow the Employee: (i) to extend the period of parental leave provided for in Clause 56.8 by a further continuous period of leave not exceeding 12 months; or (ii) to return from a period of parental leave on different working arrangements until the child reaches school age, or is under 18 and has a disability; to assist the Employee in reconciling work and parental responsibilities. “Different working arrangements” may include changes in hours of work, patterns of work or location of work. (b) The Employer shall consider the request having regard to the Employee’s circumstances and provided the request is genuinely based on the Employee’s parental responsibilities may only refuse the request on reasonable grounds related to the effect on the workplace or the Employer’s business. Such grounds might include cost, lack of adequate replacement staff, loss of efficiency and the impact on customer service.

Such refusal may only occur after the Employer has discussed the request with the employee and genuinely tried to reach agreement with the Employee about making changes to the Employee’s working arrangements to accommodate the Employee’s circumstances that have given rise to the request.
