RIGHTS OF THE ASSOCIATION. A. Privileged information, such as confidential credentials are specifically exempted from review or those items excluded under state or federal privacy acts. When the Association makes such request, the Board shall provide said documents within ten (10) business days when the Board offices are open.
5.3 Association members shall have the right to have their dues deducted in twenty-three (23) equal payments. Deduction information must be submitted to the treasurer’s office by September 15. Dues deduction will begin with the second pay in October.
5.4 Whenever the Board has reached a tentative conclusion to request additional tax millage from the community, it will give notice to the Association Executive Committee of the fact.
5.5 The principal and the Association-Principal Advisory Committee of each school shall meet monthly to discuss school-related matters and/or the implementation of the Agreement. Each committee shall consist of the building principal and up to seven (7) bargaining unit members. Faculty representatives on this committee may volunteer but shall not be required to serve on any other committee. The PAC shall be agenda driven; should there not be any agenda items, there shall not be a meeting in that month. A function of this committee shall be to conduct an annual building evaluation. The annual building evaluation will be conducted as follows:
A. The evaluation criteria shall be agreed upon by the Superintendent Advisory Committee (SAC).
B. The agreed-to evaluation criteria will be disseminated by the building principal to the staff.
C. The Board, through Evaluations will be returned to a person(s) designated by the superintendent or his designee, shall upon request provide committee after they are completed by staff.
D. All completed evaluations will be reviewed by the Association with any public documents which entire committee.
E. A person designated by the committee will assist the Association in developing intelligent, accurate, informed and constructive programs on behalf prepare a summation of the teachers and their pupils, together with any other available information which may be necessary evaluations for the Association to process grievances under this Agreementcommittee review.
1. F. The committee-prepared summation will be presented to the staff at a faculty meeting by a person(s) selected by the committee prior to the closing of school in the spring of that particular academic year.
5.6 The Association President or designee shall be given the opportunity to address the Board at all meetings.
5.7 The Association shall be provided given a place on the agenda of building faculty meetings for brief reports and announcements.
5.8 The Association shall have the right to utilize school courier for Association business.
5.9 The Association shall have the right to schedule meetings on school property when not in conflict with previously scheduled activities.
5.10 One copy for each school plus three additional copies of the minutes Board agenda shall be provided to the president of official the Association at the same time it is provided to members of the Board. In addition, the Board meetings and all other printed materials agenda will be put up on the Zanesville City Schools web site prior to each Board meeting. All bargaining unit members shall be electronically notified that are distributed to the Board members at official meetings except materials deemed confidential by law as soon as possible after such meetingsagenda has been posted on the web site. A copy of the official agenda minutes of each Board meeting shall be provided for the president of the meeting will Association or designee free of charge. 5.12 An Association-Superintendent Advisory Committee shall be formed. The committee shall meet monthly to discuss school-related matters, and under procedures approved such as school calendar, and/or the implementation of this Agreement. The SAC shall be agenda driven; should there be no agenda items, the SAC will not meet that month. Any building level issues must first be addressed at the PAC level before being presented at the SAC. An equal number of members shall be appointed by the principal or superintendent Superintendent and the president of schools. the Association, that number to be agreed to cooperatively between the Superintendent and the Association's president.
5.13 Membership in the Association will be offered on a continuing basis, with those bargaining unit members wishing to discontinue their membership notifying the treasurer and the Association in writing by September 15 of the year they wish to disaffiliate.
5.14 The Association Board agrees to reimburse the Board for any damage to equipment entrusted to its use and care.
2. All reasonable requests for use automatic payroll deductions of office, lounge, and workroom bulletin boards shall be granted to the Association.
3. School mail service shall be granted to the Association.
4. The Association agrees to pay at school cost for all materials used for its purposes.

E. In accordance with the terms of this article, each bargaining unit member within 30 days of employment shall, a fair share fee as a condition of employment, join of an amount not to exceed the total dues of the Association from the pay of all members of the bargaining unit who elect not to become members of the Association, or pay who elect not to remain members.
A. The treasurer of the Board shall, upon notification from the Association that a service member has terminated membership, commence the check-off of the fair share fee with respect to the former member, and the amount of the fee yet to be deducted shall be the annual fair share fee less the amount previously paid.
B. Payroll deduction of fair share fees shall begin at the second payroll period in January, except that no fair share fee deductions shall be made for bargaining unit members employed after January 1 until sixty (60) days subsequent to initial employment.
C. Dues, rates, and fair share fee rates shall be transmitted by the Association to the treasurer of the Board for the purpose of determining amounts to be payroll-deducted, and the Board agrees to promptly transmit all amounts deducted to the Association. Members of the bargaining unit whose employment commences after the starting date of each year shall have their dues, rates, and fair share fee rates pro-rated for the remainder of the initial year of employment.

1B. The Association shall have the right to use school equipment, shall pay the actual costs for all materials and supplies used and any repairs required as a result of its use by the Association.
C. Use of facilities and equipment will terminate once a letter of intent to strike, as required by state statute, has been received by the District.
D. The Association shall have the right to post notices of activities and matters of Association business on teacher bulletin boards. The District shall provide bulletin board space for exclusive use by the Association in each building's faculty lounge. The Association shall have the use of all equipment at reasonable timesteacher boxes, when such equipment is not in useDistrict email, and under procedures approved courier services for communication. Association use of the District’s e-mail system shall comply with the District’s acceptable use policy.
E. The Association shall have the right to make brief announcements (not more than five (5) minutes) at faculty meetings and/or in faculty bulletins.
F. Whenever any teacher is requested by the principal District to participate during working hours in negotiations, grievance proceedings, conferences, or superintendent meetings he/she shall suffer no loss in pay. An employee may seek assistance in filing an individual grievance or seeking contract clarification during the working day so long as it does not conflict with student contact responsibilities.
G. The Superintendent shall schedule time during the pre-school year in-service period when representatives of schoolsthe Association will be available to explain and answer questions regarding the licensed contract and related policies and procedures to both non-members and general membership.
H. The District shall make available to the Association President an advance agenda, Board minutes and a copy of the Board packet, exclusive of confidential information, at the same time they are sent or given to Board members.
I. The Association will be granted six (6) days of full pay and five (5) days minus the cost of the substitute of paid Association leave each year. Such leave shall be contingent upon the availability of a qualified substitute. Such leave days may be taken in any order or combination as directed by the Association. The Association agrees to reimburse shall pay the Board for any damage to equipment entrusted to its use and carecost of the substitute if a substitute is actually retained.
2J. Bargaining unit members who are absent due to request by OEA/NEA shall not experience any loss of pay or benefits. All reasonable requests OEA/NEA shall pay the daily rate for use a substitute if a substitute is actually retained or the full salary of office, lounge, and workroom bulletin boards the absent member if the reason for the absence is one for which public funds may not be expended. Such leave shall be granted to contingent upon the Associationavailability of a qualified substitute. Requests for such leave days will be made by the Association President at least five (5) workdays in advance.
3. School mail service K. The District shall be granted to notify the AssociationAssociation President that a new teacher has been hired.
4L. When the contract requires or the District desires Association representation on committees, the District will notify the Association President of such need. The Association agrees will select the MREA representatives to pay at school cost for all materials used for its purposessuch committees and will so notify the District.

RIGHTS OF THE ASSOCIATION. A. Designated Association members and/or officers shall be granted reasonable time off with pay during working hours to investigate and seek to settle grievances. In addition, time with pay shall be granted to attend hearings and to attend other meetings and conferences with State officials or coalitions on contract negotiations. D. Association representatives will be permitted to visit Association officers and committee members on State premises for the purpose of discussing Association business.
E. The Association or any committee thereof shall have the right to use school buildings and facilities without charge the College Central Main System for professional meetings during times when the building is covered by the operating staff. Room arrangements shall be made with the principal involved.

F. Nothing contained herein shall be construed to deny or restrict any employee rights he may have under the General Laws of the State of Rhode Island or other applicable laws and regulations.

The State recognizes the Association’s right to have access to information relative to budget, staffing projections as they pertain to this unit, names and addresses and salaries of all employees in the bargaining unit and agenda of all open Board of Governors meetings. Where material is normally available to the public, the Association will utilize the same avenues of acquisition as the public. It is understood that this shall not be construed to require the Community College to compile information and statistics that are not readily available. Upon written request, the Association shall furnish relevant information requested by the Community College.
H. The President of the College, the Personnel Director or the Labor Relations Administrator may meet with the President of the Association upon request at a mutually convenient time.
I. It is hereby agreed that a representative appointed by the President of the Association may be included on all search and screening committees for Chief College Administrator.
J. An employee shall have use of all equipment at reasonable times, when such equipment is not in use, and under procedures approved by the principal right to talk with a Union representative concerning Union business during working hours free from employer domination or superintendent of schools. The Association agrees to reimburse the Board for any damage to equipment entrusted to its use and careinterference.

3I. The CCVASE shall have the right to be placed on the agenda of any regular or special Board meeting providing the Superintendent is notified two (2) working days prior to the meeting. 4J. If an initial orientation program for new employees is held, the Association, upon request, shall be placed on the program's agenda, so long as the Association continues to be recognized as the sole and exclusive representative of the employees in the bargaining unit, and any organization competing for such representation shall be excluded from new employee orientation.
K. Upon request, the names of new employed staff shall be available to the Association within ten (10) days following Board approval of their contract.
L. The President of the Association shall receive from the Board a directory listing the names and job assignments on record of all employees of the Board. This directory will be provided on or before October 1 of each year.
M. The Association agrees shall continue to pay at school cost for all materials used for its purposesbe the sole and exclusive representation of the employees in the bargaining unit under the provision of this agreement.

B. The Board specifically recognizes the right of its professional staff to invoke the assistance of the Michigan Employment Relations Commission.

The Board, through the superintendent or his designee, shall upon request provide the Association with any public documents which will financial and personnel data necessary to assist the Association in developing intelligent, accurate, informed and constructive programs on behalf of the teachers and their pupils, together with any other available information recommendations. E. The Association shall be allowed a place on the agenda of the Orientation Program for new teachers to explain services available through the Association within time allotted by administration. The Association shall have use be allowed within time allotted a place on the agenda of the first General meeting of all equipment teachers at reasonable timesthe opening of school. During such presentations the Association will encourage all teachers to participate in after-school and evening activities of the School District.
F. Upon the signed written request of any professional employee, when such equipment is not in usethe Employer agrees that the Cumberland Valley School District will make ten (10) or twenty (20) equal deductions from the employee’s pay, and under procedures approved as elected by the principal or superintendent employee, to be paid to the Association for the purpose of schoolsUnited Teaching Professional dues. RIGHTS OF THE ASSOCIATION. A. 14.01 The Association, or any committee thereof, shall be authorized to use the interschool mail.

2.3.4 Representatives of the Michigan Employment Relations CommissionAssociation and unit members shall be permitted to transact Association business on school property providing it does not interfere with unit member duties.
C. 2.3.5 The BoardSchool Board shall authorize four (4) full days per month to the Association President, through or the superintendent or his President's designee, with the cost of the substitute for four (4) days to be provided by the District. The Association President and his/her supervisor at the beginning of the school year shall upon request develop and present for the Superintendent's approval a plan for utilizing substitutes that will enhance the instructional program provided by the Association President.
2.3.5.1 The School Board shall authorize Association leave for other unit members, specified by the Association President not to exceed a total of twenty (20) days per year. The cost of the substitutes will be abated to the District by the Association. No individual unit member shall be granted more than three (3) days leave under this section.
2.3.6 The School Board shall grant a reasonable number of representatives of the Association reasonable periods of compensated release time for the purpose of planning for negotiations or for consulting on possible grievances as well as time for actual negotiating and grievance procedures.
2.3.7 The Board shall provide the Association with any public documents which names, addresses and telephone numbers of all bargaining unit personnel no later than October 30th of each school year. The names, addresses and telephone numbers of all bargaining unit personnel employed after October 1st of each year will assist be supplied to the Association in developing intelligentwithin twenty (20) days of their first date of paid service. The name of each unit member whose status of employment changes during the year shall be supplied within twenty (20) days of such status change. F. Nothing contained herein shall be construed to deny or restrict any MBU rights they may have under the General Laws of the State of Rhode Island or other applicable laws and regulations.
G. The State recognizes the Association's right to have access to information relative to budget, staffing projections as they pertain to this unit, names and addresses and salaries of all MBUs and agendas of all open Board of Governors meetings. Where material is normally available to the public, the Association will utilize the same avenues of acquisition as the public. It is understood that this shall not be construed to require the Community College to compile information and statistics that are- not readily available. Upon written request, the Association shall furnish relevant information requested by the Community College.
H. The President of the College, the Personnel Director or the Labor Relations Administrator may meet with the President ofthe Association upon request at a mutually convenient time.
I. It is hereby agreed that a representative appointed by the President of the Association shall be included on all search and screening committees for any Senior Leadership Team Positions, including but not limited to, Vice President, Associate Vice President, Chief Financial Officer, and Chief Information Officer.
J. A MBU shall have use of all equipment at reasonable times, when such equipment is not in use, and under procedures approved by the principal right to talk with a Union representative concerning Union business during working hours free from employer domination or superintendent of schools. The Association agrees to reimburse the Board for any damage to equipment entrusted to its use and careinterference.
2. All reasonable requests for use of office, lounge, and workroom bulletin boards shall be granted to the Association.
3. School mail service shall be granted to the Association.
4. The Association agrees to pay at school cost for all materials used for its purposes.
5. Any deviations from above shall be done only with the full knowledge and consent of the building principal.
E. In accordance with the terms of this article, each bargaining unit member within 30 days of employment shall, as a condition of employment, join the Association or pay a service fee to the Association.

RIGHTS OF THE ASSOCIATION. A. The Board agrees to observe the rights of teachers as outlined in Section 17.455 (9) Lawful to Organize; 17.455 (10) Unfair Labor Practices; 17.455 (11) Exclusive Representation Grievance Procedure, of Act 379 of Public Acts of Michigan 1965.
B. The Board specifically recognizes the right of its professional staff to invoke the assistance of the Michigan Employment Relations Commission.
C. The Board, through the superintendent or his designee, shall upon request provide the Association with any public documents which will assist the Association in developing intelligent, accurate, informed and constructive programs on behalf of the teachers and their pupils, together with any other available information which may be necessary for the Association to process grievances under this Agreement.

The Association shall be provided with copies of the minutes of official Board meetings and all other printed materials that are distributed to Board members at official meetings except materials deemed confidential by law as soon as possible after such meetings. A copy of the official agenda of the meeting will be available to the Association at the Superintendent's office prior to said meeting.
2. The Board shall furnish the Association all available information concerning the financial resources of the district including, but not limited to, tentative budgetary requirements and allocations.
D. The Association or any committee thereof shall have the right to use school buildings and facilities without charge for professional meetings during times when the building is covered by the operating staff. Room arrangements shall be made with the principal involved.
