Common use of RIGHTS OF THE BOARD Clause in Contracts

RIGHTS OF THE BOARD. (a) The Board, on its own behalf and on behalf of the electors of the district, hereby retains and reserves unto itself without limitation, all powers, rights, authority, duties and responsibilities conferred upon and vested in it by the laws and Constitution for the State of Michigan and the United States, to manage and direct the Montrose Community Schools provided that such rights and responsibilities shall be exercised by the Board in the conformity with the provisions of this Agreement, but such rights established by law may not be infringed upon by any provision of this contract. (b) The exercise of the legislative powers, right, authority, duties and responsibilities by the Board, the adoption of policies, rules, regulations and practices in furtherance thereof, and the use of judgment and discretion in connection therewith shall be limited only to the extent such specific and express terms hereof are in conformance with the Constitution and laws of the State of Michigan and the Constitution and law of the United States.
