RECOGNITION OF THE UNION AND RIGHTS OF THE BOARD. 1.1 Recognition Pursuant to and in accordance with all applicable provisions of Act 379 of the Public Acts of 1965, as amended, the employer does hereby recognize the union as the exclusive representative for the purpose of collective bargaining in respect to rates of pay, wages, hours of employment, and other conditions of employment for the term of this Agreement of all employees of the employer included in the bargaining units described below: All Custodial, Food and Nutrition, Maintenance, and Transportation employees as agreed, excluding Director of Operations, Assistant Director of Operations, and Director of Food and Nutrition, and office employees as agreed. It is agreed that the Board retains the right, among others, to establish and equitably enforce reasonable rules relating to the duties and responsibilities of employees and their working conditions which are not inconsistent with the provisions of this Agreement or violative of law. C The Board and the Union agree that there shall be no discrimination against any employee by reason of race, creed, color, age, sex, national origin or disability as defined in the Americans with Disabilities Act (ADA). D The parties to this agreement recognize the right of every individual to be treated with respect and dignity and will conduct themselves accordingly.
