RIGHTS OF BOARD. It is expressly agreed that all rights which ordinarily vest in the Board, except those which are clearly and expressly relinquished herein by the Board, shall continue to vest exclusively in, and be exercised exclusively by, the Board without prior negotiations with the Association either as to the taking of action under such rights or with respect to the consequences of such action during the term of this agreement. Such rights include, but are not limited to, the right to the executive management and the administrative control of the school system and its properties, facilities, equipment, and activities of its employees during employee working hours: to hire all employees and, determine their qualifications and conditions of their continued employment, their placement, or their dismissal, suspension, layoff, or demotion, promotion, or transfer.
RIGHTS OF BOARD. The Board, for itself and on behalf of the voters and taxpayers of the District, hereby retains and reserves unto itself, without limitations, all powers, rights, authority, duties and responsibilities conferred upon and vested in it by the laws and Constitution of the State of Kansas and the United States. Nothing contained herein shall be considered to deny or restrict the Board of its rights, responsibilities, and authority under the State school or local laws or regulations as they pertain to education. The Board and the WTA agree, except as expressly provided otherwise in this agreement, that the determination and administration of school policy, the operation and management of the schools are vested exclusively in the Board; and that the Board is the legally constituted body for that purpose.
RIGHTS OF BOARD. The exercise of rights, authority, duties, and responsibilities of the Board, the adoption of policies, rules, regulations, and practices thereof, and the use of judgment and discretion shall be limited only by the terms of this Agreement and provisions of Chapter 4117 of the Ohio Revised Code.
RIGHTS OF BOARD. The Board and Superintendent hereby retain and reserve unto themselves, without limitation, all powers, rights, authority, duties, and responsibilities conferred upon them and vested in them by the laws and Constitution of the State of Ohio including, but not limited to, the right and responsibility to:
X. Xxxxxxxxx matters of inherent managerial policy which include, but are not limited to, areas of discretion or policy such as the functions and programs of the Board, standards of services, the Board's overall budget, utilization of technology, and organizational structure;
B. Direct, supervise, evaluate, or hire employees;
C. Maintain and improve the efficiency and effectiveness of the Board's operations;
D. Determine the overall methods, process, means, or personnel by which the Board's operations are to be conducted;
E. Suspend, discipline, demote, or discharge for just cause, or layoff, transfer, assign, schedule, promote, or retain employees;
X. Xxxxxxxxx the adequacy of the work force;
X. Xxxxxxxxx the overall mission of the Board as a unit of government;
H. Effectively manage the work force, and;
I. Take actions to carry out the mission of the Board as a governmental unit. The foregoing rights shall be limited only by the express terms of this Agreement.
RIGHTS OF BOARD. A. The Board reserves to itself sole jurisdiction and authority over matters of policy and according to provisions of State law, retains the right, subject only to the limitations imposed by the language of this Agreement, in accordance with applicable laws and regulations:
1. to hire, promote, transfer, assign and retain employees in positions within the school district, and for just cause to suspend, demote, discharge or take other disciplinary action against employees.
2. to abolish any such position for reasons of economy or because of reduction in the number of pupils or of change in the administrative or supervisory organization of the district or for other good cause (18A:29-9).
3. to maintain the efficiency of the school district operations entrusted to them.
4. to determine the means by which such operations are to be conducted and,
5. to take whatever action may be necessary to carry out the mission of the school district in situation of emergency.
6. to withhold the increment (increase in salary) of any administrator for inefficiency or other just cause in accordance with N.J.S.A. 18A:29-14. The rights of the Board shall include, but not be limited to, the provisions set forth in this Article.
B. It is understood by all parties that under the rulings of the courts of New Jersey and the State Commissioner of Education, the Board is forbidden to waive any rights or powers granted it by law.
RIGHTS OF BOARD. A. There is reserved exclusively to the Board all responsibilities, powers, rights, and authority vested in it by the laws and constitutions of Michigan and the United States or which have heretofore been properly exercised by it, excepting where expressly and in specific terms limited by the provisions of the Agreement.
B. It is agreed that the Board retains the right, among others, to establish and equitably enforce reasonable rules and personnel policies relating to the duties and responsibilities of teachers and their working conditions which are not inconsistent with the provisions of this Agreement or violative of law. The Board agrees, however, that prior to the effective date of any such rules or personnel policies established by it related to hours, wages, and working conditions of teachers, it shall give the Association reasonable notice of any proposed rule or policy. Such notification shall be given to afford the Association the opportunity to consult with the Board's representatives as to the same before its effective date. The parties agree that emergency situations may arise where prior notification and consultation are not possible.
C. Yearly update copies of these rules and personnel policies will be made available in the central office of each school building.
RIGHTS OF BOARD. The Board and the Association agree, except as otherwise expressly provided for in this agreement, that the determination and administration of school policy, the operation and management of the schools, and the direction of employees are vested exclusively in the Board; and that the Board is the legally constituted body for that purpose. The parties further agree that those terms and conditions of employment, as so defined in KSA 72-5413 (l), which are not covered in this agreement may be amended, modified, rescinded or adopted by the Board of Education as Board policy during the life of this agreement, and the Association expressly waives its right to bargain collectively with the Board of Education during the life of this agreement on such subjects and matters.
RIGHTS OF BOARD. Except as otherwise specifically provided in this agreement, or otherwise specifically agreed to in writing between the parties, the determination of educational policy, the operation and management of the schools and the control, supervision and direction of the teachers are vested exclusively in the Board. Nothing in this Article shall be construed as prohibiting the parties from meeting and consulting in accordance with 26 M.R.S.A. §965(1)(C).
RIGHTS OF BOARD. It is specifically understood that the Board reserves unto itself all rights and powers not expressly specified herein, as authorized by New Jersey Statutes or other applicable laws and legislation.
RIGHTS OF BOARD. A. The Union recognizes that the Board and the Superintendent are the bodies of authority solely vested with the right to run and fund the Xxxxxxxx Xxxxx Local Schools, that the Board and Superintendent shall have the right to take any action they consider necessary and proper to effectuate management policy express or implied, and that there is no duty to bargain over such decisions. The Board recognizes that it is obligated to bargain about the wages, hours, terms and conditions of employment, and the continuation, modification, or deletion of an existing provision of this Agreement. Changes may be made at all times during this Agreement by mutual consent of both parties and shall be attached in the form of Articles or Memoranda of Understanding.
B. Except as modified by a specific and express term of this Agreement, the Board hereby retains and reserves to itself and the Superintendent all powers, rights, authority, duties and responsibilities conferred upon and vested in them by the laws and the Constitution of the State of Ohio, and of the United States, including but not limited to the right to: determine matters of inherent managerial policy which include, but are not limited to, areas of discretion or policy such as the functions and programs of the Board, standards of services, its overall budget, utilization of technology, and organizational structure; manage and direct employees, including the right to select, hire, supervise, evaluate, retain, promote, transfer, assign, schedule, or lay off employees; maintain and improve the efficiency and effectiveness of school operations; determine the overall methods, process, means, or personnel by which school operations are to be conducted including the management and determination of the location, type and number of facilities, the type of equipment, programs and work to be performed; suspend, discipline, demote, or terminate employees; determine the adequacy of and effectively manage the work force; determine and carry out the overall mission, goals, programs and services of the school district and to utilize personnel in a manner determined by the Board to effectively and efficiently meet these purposes; promulgate and enforce work rules, orders, policies and procedures; and determine the hours of work and work schedules. The exercise of any of the foregoing management rights are limited only by the expressed terms of this Agreement.
