Rights of the Parties. 6.1 The Board agrees to make available to the Union upon reasonable written request all information, reports and budgets which are available to the public. The District will send to the Union District Vice-President copies of new written work rules; job postings; and within the bargaining unit, new hires, leaves of absence, promotions and transfers. 6.2 A copy of current Board policy and Board minutes and agendas shall be made available online to the Vice-President of the Union as soon as they are made available to the public. The Union shall provide the Board with copies of its constitution, bylaws, and a correct roster of elected and appointed individuals. 6.3 The employer recognizes and agrees to deal with the accredited Union Stewards and any Union officer employed by the district or his representatives as employed by the district in all matters relating to grievances and the implementation of this Agreement. 6.4 The District Vice-President and/or District Secretary and/or shop Xxxxxxx and/or Executive Officers of the Union may leave the place of work without loss of pay only under the following circumstances and conditions: 6.5 The time shall be devoted to proper investigation and processing of grievances as specified under Article 4. 6.6 Authority to leave the workplace or to enter another location shall be requested of the immediate supervisor with a reason for leaving, destination and estimated time for return. Authority shall not be unreasonably withheld. 6.7 Before entering a work area, the meeting time and location shall be approved by the appropriate supervisor of that work area. 6.8 In no event shall employees be released or allowed to enter a work area during work hours if the supervisor determines that operational needs cannot be put off to another time. Reasonable efforts will then be made to make a time and a place available as soon as practicable. 6.9 Union officers, agents, or employees shall not change job orders or interfere in any way with employees' full and faithful performance of their job assignments. 6.10 A written list giving the names of the Stewards, the Chairman of the Grievance Committee, the President of the Union, the Executive Vice-President, Executive Secretary, Executive Treasurer, District Vice-President, and Secretary/Treasurer of the Union shall be furnished to the employer immediately after their designation and the Union shall notify the employer promptly of any changes in such list. 6.11 Accredited representatives of the state and national Union shall be permitted to transact union business on school property at all reasonable times. The Union representative shall obtain approval of the Maintenance Operations Specialist or Custodial Operations Specialist or designee prior to any visit to any building in the district. Such access shall not be unreasonably denied. 6.12 The Union shall have the right to use school buildings for Union business on the same basis as other school affiliated organizations in accordance with district policy.

10:3 The Association may use the school office, inter-office mail, District email system and bulletin board space for posting notices in areas readily available to employees and assigned for the dissemination of information by means of notices, circulars, or other similar materials pertaining to Association business under the following provisions:
(a) the material must identify clearly the individuals(s) and/or organization responsible for the information contained therein;
(b) a copy of the material for general distribution or an opportunity to copy material being distributed must be given to the building principal or designee prior to or at the time of posting or dissemination in that building. If the material is to be distributed or posted system-wide, a copy also must be furnished to the Superintendent or designee prior to or at the time of posting or dissemination; and,
(c) the use of the mail system and bulletin boards may not interfere with the normal business of the school.
10:4 A copy of current Board Policy and Board minutes (agendas) shall be maintained on line. Such documents shall be maintained and provided in a timely manner, and the Association President will have access to said documents as they are made available to the public.
10:4.1 A copy of in-service plans will be provided to the Association, as soon as it is available. 10:5 The building representative will have the right to speak to employees during regularly scheduled faculty meetings if the representative notifies the building principal at least one (1) day in advance of the scheduled meetings. The requirement for one (1) days' advance notice may be waived by mutual agreement. The exact order of the agenda for the building representative will be at the discretion of the Principal.
10:6 The Association will have the right to use on school premises office and A-V equipment as designated by the principal when not otherwise being used. The Association will pay for the cost of materials and supplies. The Association also agrees that it will pay for the repair or replacement of equipment damaged during such use.
10:7 Accredited representatives of the Local, State, and the National Association will be permitted to transact official Association business on school property at all reasonable times, provided that this will not interfere with or interrupt the program of the school district. The Association representative will obtain approval of the principal of the building or other person in charge of the building which the representative is visiting by reporting to the office. Such approval will not be unreasonably withheld.
10:8 Whenever by mutual agreement of the parties any employees participate during working hours in negotiations, they will suffer no loss in pay, nor will they be required to make up the time lost.
10:9 The Association will have input into the preparation of the District calendar and the District budget. Final determination of the calendar and budget will reside with the Board.
10:10 Except as limited by this Agreement, the Red Clay Consolidated School District Board, on its own behalf and on behalf of the citizens of the District hereby retains and reserves unto itself all powers, rights, authority, duties, and responsibilities conferred upon and vested in it by the laws and the Constitution of the State of Delaware and of the United States, and including the right to administer and to supervise the schools of the District and will have the authority to determine policy and adopt rules and regulations for the general administration and supervision of the schools of the District. Such administration, supervision, and policy will be conducted and formulated in accordance with Delaware law and the policies, rules, and regulations of the State Board of Education. Additionally, nothing contained herein will be considered to deny or to restrict the Board of its rights, responsibilities, and authorities provided by applicable law(s).
10:11 The Board, subject to Delaware Code and in accordance with the policies, rules and regulations of the State Board of Education, will in addition to other duties:
(a) determine the educational policies of the District and prescribe rules and regulations for the conduct and management of the schools;
(b) enforce the provisions of Title 14 relating to school attendance;
(c) grade and standardize all the schools under its jurisdiction and may establish kindergartens and playgrounds and such other types of schools, as in its judgment will promote the educational interest of the District;
(d) adopt courses of study;
(e) select, purchase, and distribute free of charge such textbooks, and other materials of instruction, stationery, furniture, equipment, apparatus and supplies as are necessary to the work of the schools;
(f) provide forms on which regular school employees will make such reports as may be required by the Board;
(g) make all reports required by the Secretary of the Department of Education, at such time, upon such items, and in such form as may be prescribed by the State Secretary of the Department of Education; and,
(h) appoint personnel.
10:12 In a bona fide emergency affecting the health, safety or welfare of the students of the District, the Board or designee may take appropriate actions.
10:13 The District will provide a telephone in the classroom or in an area easily accessible to the Association President. Such telephone will not be utilized during normal class time except in an emergency.
10:14 The District will provide a total of twenty (20) person days per year of release time with full pay for Association-related activities to employees designated by the Association President. Use of such days must be by prior notice to the Superintendent and the employee's building administrator. In a given year, should the Association exhaust its days and need additional time, it may request same of the Superintendent whose decision shall be final. Such time will be in addition to sick leave and/or personal days.
10:15 The District will provide a total of two hours during one of the new teacher orientation days (including a meal time) for the Association to address and/or provide information to new employees.

Rights of the Parties. 6.1 SECTION A – RECOGNITION SECTION B – I.U.P.A. ACTIVITIES
1. The Employer shall allow reasonable time off with pay for I.U.P.A. members conducting official business vital to both the Union and the Employer; provided, however, that the activity may be lawfully funded by the Employer under applicable decisions of the Public Employment Relations Commission; provided further that such time off shall be taken at the consent of the Sheriff or his designee or by the authority of the Board agrees of County Commissioners. Examples of appropriate uses of release time include participation in labor-management meetings, representing employees in grievance meetings and other contract administration matters. When absent from work to make available perform internal I.U.P.A. business, I.U.P.A. officers and members will be charged annual leave or leave without pay, if no accrued annual leave is available. In all instances, before leaving the work area or otherwise devoting on-duty time to the Union upon reasonable written request all informationperformance of I.U.P.A. business, reports the I.U.P.A. officers shall notify their supervisor, obtain approval and budgets which are available to the publicnotify their supervisor when they return.
2. The District Employer will send attempt to arrange shift schedules or grant time during the Union District Vice-President copies course of the normal work day in a manner that the employee members who are part of the I.U.P.A.'s negotiating team will be provided time with pay for purposes of negotiating a new written work ruleslabor agreement; job postings; and within provided: that no more than two members of the bargaining unit, new hires, leaves of absence, promotions and transfersI.U.P.A.'s negotiating team shall be on paid status during negotiations sessions.
6.2 3. A copy of current Board policy and Board minutes and agendas this Agreement shall be made available online posted in a conspicuous place in the Sheriff's Office. The Employer agrees to provide suitable space for the Vice-President bulletin board in each place of work. Postings by the I.U.P.A. on such boards are to be confined to official business of the Union as soon as they are made available I.U.P.A.
4. Bargaining unit employees may make occasional but limited use of County- owned communications resources (telephone, voice mail, electronic mail) for personal communications; specifically, incidental personal use is permitted. Incidental personal use is use that is both brief in duration and accumulation and does not interfere with or impair the conduct of official county business due to the publicvolume, frequency, or impede employees’ performance of their official duties. The Union shall provide the Board with copies of its constitution, bylaws, and a correct roster of elected and appointed individuals.

Rights of the Parties. 6.1 4:1 All employees employed for more than thirty (30) days are eligible to become a member of UAW.
4:1.1 The Board employer agrees to deduct the membership dues, service fee, or V-CAP contribution from the earned wages of each employee who has become a member of UAW. Such deductions shall be made after the employee executes the appropriate written form(s). On or before the first (1st) of each month, the UAW shall deliver to the employer additional executed authorization forms under which membership dues, service fees, or V-CAP deductions shall be made from the semimonthly payroll. The UAW will notify the District thirty (30) days prior to any changes in dues or fees.
4:1.2 Services fees, for employees who have executed the appropriate written forms to become a member of UAW shall, for this Article, be as determined by the UAW.
4:2 The District agrees to make available to the Union UAW, upon reasonable written request request, all information, reports reports, and budgets which are available to the public. The District will send public and shall, upon reasonable written request, make available to the Union UAW other statistics, information and records necessary for negotiations. This information shall be handled in a manner respecting the privacy rights of District Vice-President copies of new written work rules; job postings; employees, students and within the bargaining unit, new hires, leaves of absence, promotions and transfersparents.
6.2 4:3 The UAW shall be provided a locked bulletin board at both locations for posting notices in areas readily available to employees and assigned for the dissemination of information by means of notices, circulars, or other similar materials pertaining to UAW business. A copy of current Board policy and Board minutes and agendas materials distributed or posted shall be made available online given to the Vice-President Supervisor of Transportation or designee at the time of posting or distribution. Items posted in the locked bulletin board will not be posted in any other location within the transportation buildings without prior approval from administration. The union may also use the mailbox system.
4:3.1 UAW representatives shall have the right to speak to employees during regularly scheduled meetings if the representative notifies the transportation supervisor at least two (2) days in advance of the Union as soon as they are made available to the publicscheduled meeting. The Union requirement for two (2) days advance notice may be waived by mutual agreement. Placement on the meeting agenda shall provide be at the Board with copies discretion of its constitution, bylaws, and a correct roster of elected and appointed individualsthe transportation supervisor.

Prior approval shall be obtained from the Supervisor of Transportation.
4:5 The UAW International representative shall have the right to speak to employees during regular scheduled transportation meetings at an appropriate time as mutually established with the Supervisor of Transportation. Employees will not be compensated for attendance at union meetings.
4:6 Accredited representatives of the UAW shall be permitted to transact official UAW business at the bus yard at reasonable times when the yard is open and such transactions do not interfere with or disrupt employee performance and responsibility. Representatives must make their presence known to an administrator in the transportation department.
4:7 Whenever, by mutual agreement of the parties; any representatives of the UAW participate during regularly scheduled work hours in negotiations, they shall suffer no loss in pay nor shall they be required to make up the time lost.
4:8 The District shall grant unpaid leave to one or more Union members for the purpose of attending Union meetings, conferences and training programs, for a total of 60 hours per fiscal year (from July 1 to June 30 of the following year) for the bargaining unit as a whole with the exclusion of Union Summer School and the Constitutional Convention. For an employee to receive unpaid leave for Union business business, the employee's immediate supervisor must be given reasonable notice of the need for the leave and the dates of said leave.
4:9 The District shall immediately inform the Union Chairperson of all newly hired employees into Bargaining Unit position, and afford adequate paid time, not to exceed three (3) hours, for the new hire and the Chairperson (or his/her designee) to conduct an orientation.
4:10 The Board shall not discriminate against, interfere with, restrain nor coerce employees in the right to organize or to join or participate in UAW activities.
4:11 Except in an emergency, notices for meetings shall be posted 48 hours in advance.
4:12 New Hire Contact sheet to be given to each new hire with new hires information on it and submitted to the same basis as other school affiliated organizations union in accordance with district policya timely manner, at least once a month.
4:13 In no event shall an employee be required to operate a bus that fails to meet any Federal or State law, standard or regulation.

Such access shall not be unreasonably denied.
6.12 6:6 Whenever members of the bargaining unit are mutually scheduled to participate in negotiations during working hours, they shall suffer no loss of pay, provided that no more than four (4) custodial personnel are scheduled to participate.
6:7 The Union union shall have the right to use school buildings for Union business on the same basis as other school affiliated organizations in accordance with district District policy.
6:8 The union may use the school and District inter-office mail system and bulletin board space for posting notices in areas readily available to employees and assigned for the dissemination of information by means of notices, circulars, or other similar materials pertaining to Union business under the following provisions:

6:9 The Union shall have the right to use school facilities and equipment in place by qualified operators, including typewriters, mimeographing machines, other duplicating equipment, calculating machines and all types of audio-visual equipment at reasonable times, when such equipment is not otherwise in use. The Union shall pay for the reasonable cost of all materials and supplies incident to such use, and for any repairs necessitated as a result thereof. Prior approval shall be obtained from the building principal where the equipment is located.
6:10 No employee shall be prevented from wearing official pins or insignias of the Union or its affiliates.
6:11 Whenever any employee is required to appear before the Board or an agent of the Board, i.e. Human Resources Administrator, Assistant Superintendent, Superintendent, concerning any matter which could adversely affect the continuation of that employee in his/her position or employment or the salary or any increments pertaining to salary, then he/she shall be given written notice of the reasons for such interview 48 hours prior to the date of said hearing and shall be entitled to consult with and have a Union representative to advise and represent him/her during such meeting or interview.
6:12 No employees shall be disciplined, reprimanded or reduced in pay except for just cause. Any such action will be considered with due regard to privacy.
6:12.1 No employee shall be given a written reprimand, nor have disciplinary action taken against him/her, without just cause. Any such action will considered with due regard to privacy. The progression of discipline for infractions may be: • Verbal Warning • Written Warning • Suspension for Less Than Five Days • Five or More Days Suspension • Termination The extent of disciplinary action taken for serious infractions shall be commensurate with the offense. Discipline may be imposed within fifteen (15) working days of the District's knowledge of the infraction unless the employee is on a leave of absence or under investigation for the alleged infraction.
6:12.2 Disciplinary material older than 24 months shall not be relied upon for subsequent discipline, provided that the employee has received no similar disciplinary material during that 24-month period. Such discipline material 24 months or older shall be, at the request of the employee, removed from the employee’s personnel file. This provision shall not apply to arrest records involving serious matters or other material where the District is legally prohibited from removing materials. In the event an employee raises his or her disciplinary record in a grievance hearing, the District may rely on any and all discipline.

6:14 Nothing contained herein shall be considered to deny or restrict the Board of its rights, responsibilities and authority under the Delaware School Laws or any other national, state, county, district, or local laws or regulations.
6:15 In a bona fide emergency affecting the health, safety or welfare of the students of the District, the Board or designee may take appropriate action.
6:16 Copies of this Agreement shall be printed at the expense of the Board. The Board shall provide the Union with a copy for each employed custodial personnel plus an additional twenty-five (25) copies. The Union will distribute the individual copies, supplied by the District to each member of the bargaining unit.

Rights of the Parties. 6.1 6:1 The Board agrees to make available to the Union upon reasonable written request all informationbudgets, reports reports, statistics, information and budgets records necessary for negotiations to the extent to which such information is in the public domain.
6:2 Administrative directives, which are available not confidential, to administrative and supervisory personnel and which affect the public. The District will send employment relations of employees shall also be mailed to the Union District Vice-President copies at the time of new written work rules; job postings; and within the bargaining unit, new hires, leaves issuance or posting of absence, promotions and transfersthe directive.
6.2 A copy of current Board policy and Board minutes and agendas shall be made available online to the Vice-President of the Union as soon as they are made available to the public. The Union shall provide the Board with copies of its constitution, bylaws, and a correct roster of elected and appointed individuals.
6.3 6:3 The employer recognizes and agrees to deal with the accredited Union Stewards stewards and any Union officer employed by the district President or his representatives as employed by the district in all matters relating to grievances and the implementation interpretation of this the Agreement.
6.4 The District Vice-President and/or District Secretary and/or shop Xxxxxxx and/or Executive Officers of the Union may leave the place of work without loss of pay only under the following circumstances and conditions:
6.5 The time shall be devoted to proper investigation and processing of grievances as specified under Article 4.
6.6 Authority to leave the workplace or to enter another location shall be requested of the immediate supervisor with a reason for leaving, destination and estimated time for return. Authority shall not be unreasonably withheld.
6.7 Before entering a work area, the meeting time and location shall be approved by the appropriate supervisor of that work area.
6.8 In no event shall employees be released or allowed to enter a work area during work hours if the supervisor determines that operational needs cannot be put off to another time. Reasonable efforts will then be made to make a time and a place available as soon as practicable.
6.9 Union officers, agents, or employees shall not change job orders or interfere in any way with employees' full and faithful performance of their job assignments.
6.10 6:4 A written list giving the names of the Stewardsstewards, the Chairman chairman of the Grievance Committeegrievance committee, the President of the Union, the Executive Vice-President, Executive Secretary, Executive Treasurer, District Area Vice-President, and Secretary/Secretary- Treasurer of the Union shall be furnished to the employer immediately after their designation and the Union shall notify the employer promptly of any changes in such list.
6.11 6:5 Accredited representatives of the state Local, State, and national National Union shall be permitted to transact union official Union business on school property at all reasonable times. The Union representative shall obtain approval of the Maintenance Operations Specialist principal of the building or Custodial Operations Specialist or designee prior other person in charge of the building which the representative is visiting by reporting to any visit to any building in the districtofficial. Such access shall not be unreasonably denied.
6.12 6:6 Whenever members of the bargaining unit are mutually scheduled to participate in negotiations during working hours, they shall suffer no loss of pay, provided that no more than four (4) custodial personnel are scheduled to participate.
6:7 The Union union shall have the right to use school buildings for Union business on the same basis as other school affiliated organizations in accordance with district District policy.
6:8 The union may use the school and District inter-office mail system and bulletin board space for posting notices in areas readily available to employees and assigned for the dissemination of information by means of notices, circulars, or other similar materials pertaining to Union business under the following provisions:
(a) the material must identify clearly the individual(s): and/or organization responsible for the information contained therein;
(b) a copy of the material for general distribution or an opportunity to copy material being distributed must be given to the building principal or designee prior to or at the time of posting or dissemination in that building. If the material is to be distributed or posted system-wide, a copy also must be furnished to the Superintendent or designee prior to or at the time of posting or dissemination; and
(c) the mail system and bulletin boards may not be unreasonably used so as to interfere with the normal business of the school.
6:9 The Union shall have the right to use school facilities and equipment in place by qualified operators, including typewriters, mimeographing machines, other duplicating equipment, calculating machines and all types of audio-visual equipment at reasonable times, when such equipment is not otherwise in use. The Union shall pay for the reasonable cost of all materials and supplies incident to such use, and for any repairs necessitated as a result thereof. Prior approval shall be obtained from the building principal where the equipment is located.
6:10 No employee shall be prevented from wearing official pins or insignias of the Union or its affiliates.
6:11 Whenever any employee is required to appear before the Board or an agent of the Board, i.e. Human Resources Administrator, Assistant Superintendent, Superintendent, concerning any matter which could adversely affect the continuation of that employee in his/her position or employment or the salary or any increments pertaining to salary, then he/she shall be given written notice of the reasons for such interview 48 hours prior to the date of said hearing and shall be entitled to consult with and have a Union representative to advise and represent him/her during such meeting or interview.
6:12 No employees shall be disciplined, reprimanded or reduced in pay except for just cause. Any such action will be considered with due regard to privacy.
6:12.1 No employee shall be given a written reprimand, nor have disciplinary action taken against him/her, without just cause. Any such action will considered with due regard to privacy. The progression of discipline for infractions may be: • Verbal Warning • Written Warning • Suspension for Less Than Five Days • Five or More Days Suspension • Termination The extent of disciplinary action taken for serious infractions shall be commensurate with the offense. Discipline may be imposed within fifteen (15) working days of the District's knowledge of the infraction unless the employee is on a leave of absence or under investigation for the alleged infraction.
6:12.2 Disciplinary material older than 24 months shall not be relied upon for subsequent discipline, provided that the employee has received no similar disciplinary material during that 24-month period. Such discipline material 24 months or older shall be, at the request of the employee, removed from the employee’s personnel file. This provision shall not apply to arrest records involving serious matters or other material where the District is legally prohibited from removing materials. In the event an employee raises his or her disciplinary record in a grievance hearing, the District may rely on any and all discipline.

If request is approved, such documents and all directly-related documents will be removed. The employee will be advised in writing of the disposition of the request.
